87STATEMENT OF THE CASE

91On September 14, 2016, Petitioners , Belynda Fernandez and

99Enrique Diaz , on behalf of and as parents and natural guardians

110of Bella B. Diaz ( Bella ), a minor, filed a Petition for Benefits

124Pursuant to Florida Statute Section 766.301 et seq. (Petition)

133with the Division of Administrative Hearings (DOAH) for a

142determination of compensability under the Florida Birth - Related

151Neuro logical Injury Compensation Plan (Plan). The Petition named

160Guillermo Antonio Lievano , M . D. , as the physician who provided

171obstetric services for the birth of Bella on July 31, 2013, at

183Baptist Hospital in Miami, Florida .

189DOAH served NICA and Guillermo Antonio Lievano, M.D., with a

199copy of the Petition on September 23, 2016. The docket reflects

210that DOAH received a n undated return receipt from the United

221States Postal Service on October 11, 2016, showing that Baptist

231Hospital had been served with a copy of the Petit i on.

243On September 30, 2016, Baptist H ospital filed a Petition to

254Intervene which was granted. A s of the date of this Summary

266Final Order of Dismissal, Dr. Lievano has not petitioned to

276intervene into this proceeding.

280On December 13 , 201 6 , NICA filed a Motion for Summary Final

292Order, requesting that a s ummary f inal o rder be entered finding

305that the claim was not compensable because Bella did not sustain

316a Ðbirth - related neurological injuryÑ as that term is defined in

328section 766.302(2), Flo rida Statutes . O n the same day as the

341Motion for Summary Final Order was filed, Interv e nor Baptist

352Hospital filed a Motion for Extension of Time to inform as to its

365position regarding whether a hearing would be necessary.

373IntervenorÓs motion was granted a nd the parties were instructed

383to inform the undersigned no later than January 13, 2017, as to

395whether a hearing was necessary. Intervenor filed a notice that

405that Intervenor does not believe that a hearing is necessary and

416does not object to NICAÓs Motio n for Summary Final Order.

427Petitioners did not file a response to NICAÓs Motion, nor file a

439response to the Order directing the parties to indicate whether

449they were seeking a hearing.

454FINDINGS OF FACT

4571. Bella B. Diaz was born on July 31 , 2 013 , at Baptis t

471Hospital located in Miami , Florida.

4762. Donald Willis, M.D. (Dr. Willis), was requested by NICA

486to review the medical records for Bella . In a report dated

498November 2 , 201 6 , Dr. Willis described his findings in pertinent

509part as follows:

512Cesarean secti on was done for post - dates with

522unfavorable cervix and decreased FHR

527variability. Birth weight was 3,385 grams.

534Amniotic fluid was clear. The newborn was

541not depressed. Apgar scores were 9/9.

547Pediatric evaluation at delivery stated the

553Ðbaby came out vigorously crying.Ñ No

559resuscitation was required. The baby was

565taken to the normal nursery.

570The initial meconium drug screen was positive

577for cannabinoids, but repeat testing the

583following day was negative. Chest X - ray

591suggested an enlarged heart, but ECHO was

598essentially normal.

600The baby was transferred to the NICU about 3

609hours after birth due to clinically evident

616Jaundice. Neurologic exam was normal. The

622baby did not have any respiratory distress.

629ABO blood type incompatibility was diagnosed

635as the cause of Jaundice and managed with

643phototherapy.

644The baby was noted to have poor feeding and

653neurologic evaluation initiated. EEG was

658done on the day after birth and was abnormal,

667consistent with diffuse encephalopathy. The

672abnormal EEG findings we re felt to be only

681due to immaturity and expected to improve.

688Follow - up EEG at 1 month of age was normal,

699but EEG at 16 months of age was again

708abnormal with findings suggestive of global

714cortical dysfunction.

716MRI at one month of age was normal. Follow

725up MRI at 6 months of age was essentially

734normal with Ðdelayed myelination for the age

741of the patient.Ñ No structural defects were

748seen.

749An extensive Genetic evaluation was negative.

755Chromosome analysis showed a pericentric

760inversion of chromosome #9, w hich is

767considered a normal variation. Microarray

772was negative.

774Evaluation at 19 months of age described a

782child that was unable to walk or stand

790unassisted and with global developmental

795delay. No obvious cause was identified.

801In summary, labor was i nduced for post - dates.

811There was no change in the cervix after

819overnight cervidil induction. Primary

823Cesarean section delivery was done the

829following morning. The newborn was not

835depressed. Apgar scores were 9/9. The baby

842was Ðactive and responsiveÑ a t birth. No

850resuscitation was required. The baby was

856taken to the normal newborn nursery. Shortly

863after delivery the baby was transferred to

870the NICU for clinically apparent Jaundice.

876Poor feeding lead to further evaluation,

882including MRI, which was no rmal. Genetic

889evaluation was negative.

892There was no apparent obstetrical event that

899resulted in loss of oxygen or mechanical

906trauma to the babyÓs brain during labor,

913delivery or the immediate post delivery

919period.

9203. Dr. Willis reaffirmed his opinion in an affidavit dated

930December 12, 2016.

9334. A review of the file reveals that no contrary evidence

944was presented to dispute Dr. WillisÓ finding that there was no

955apparent obstetric event that resulted in oxygen deprivation or

964mechanical trauma during lab or, delivery, or the immediate post -

975delivery period. Dr. WillisÓ opinion is credited.

982CONCLUSIONS OF LAW

9855 . The Division of Administrative Hearings has jurisdiction

994over the parties to and the subject matter of these proceedings.

1005§§ 766.301 - 766.316, Fla . Stat.

10126 . The Plan was established by the Legislature Ð for the

1024purpose of providing compensation, irrespective of fault, for

1032birth - related neurological injury claims Ñ relating to births

1042occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

10537 . The injured infant, her or his personal representative,

1063parents, dependents, and next of kin may seek compensation under

1073the Plan by filing a claim for compensation with DOAH.

1083§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1091which adm inisters the Plan, has Ð 45 days from the date of service

1105of a complete claim . . . in which to file a response to the

1120petition and to submit relevant written information relating to

1129the issue of whether the injury is a birth - related neurological

1141injury. Ñ § 766.305(4), Fla. Stat.

11478 . NICA has determined that Petitioner s do not have a claim

1160that is compensable under the Plan and has filed a Motion for

1172Summary Final Order, requesting that an order be entered finding

1182that the claim is not compensable.

11889 . In ruling on the motion, the a dministrative l aw ju dge

1202must make the following determination based upon the available

1211evidence:

1212(a) Whether the injury claimed is a birth -

1221related neurological injury. If the claimant

1227has demonstrated, to the satisfaction of t he

1235administrative law judge, that the infant has

1242sustained a brain or spinal cord injury

1249caused by oxygen deprivation or mechanical

1255injury and that the infant was thereby

1262rendered permanently and substantially

1266mentally and physically impaired, a

1271rebuttable presumption shall arise that the

1277injury is a birth - related neurological injury

1285as defined in s. 766.303(2).

1290§ 766.309(1), Fla. Stat.

129410 . The term Ð birth - related neurological injury Ñ is defined

1307in section 766.302(2) as follows:

1312Ð Birth - related neurolo gical injury Ñ means

1321injury to the brain or spinal cord of a live

1331infant weighing at least 2,500 grams for a

1340single gestation or, in the case of a

1348multiple gestation, a live infant weighing at

1355least 2,000 grams at birth caused by oxygen

1364deprivation or mecha nical injury occurring in

1371the course of labor, delivery, or

1377resuscitation in the immediate postdelivery

1382period in a hospital, which renders the

1389infant permanently and substantially mentally

1394and physically impaired.

139711 . The evidence, which is not refuted , established that

1407there was no apparent obstetrical event that resulted in loss of

1418oxygen or mechanical trauma to BellaÓs brain during labor,

1427delivery or the immediate post - delivery period. Thus, Bella is

1438not eligible for benefits under the Plan.

1445CONCL USION

1447Based upon the foregoing Findings of Fact and Conclusions of

1457Law, it is ORDERED that the Petition filed by Belynda Fernandez

1468and Enrique Diaz , o n behalf of and as parents and natural

1480guardians of Bella D. Diaz , a minor, is dismissed with prejudice.
