50This cause came on for consideration upon a Motion for
60Summary Final Order filed by Respondent, Florida Birth - Related

77December 13, 2016.
80STATEMENT OF THE CASE
84On September 21, 2016, Petitioners, Ada Fernandez and
92Anthony Portuondo, on behalf of and as parents and natural
102guardians of Aydrian Portuondo (Aydrian), a minor, filed a
111P etition for Benefits Pursuant to Florida Statute Section 766.301
121et seq. (Petition) with the Division of Administrative Hearings
130(DOAH) for a determination of compensability under the Florida
139Birth - Related Neurological Injury Compensation Plan (Plan). The
148Petition named Julio E. Arronte, M.D., as the physician who
158provided obstetric services for the birth of Aydrian on
167October 16, 2014, at South Miami Hospital in Coral Gables,
177Florida.
178DOAH served NICA with a copy of the Petition on
188September 30, 2016. DOAH served South Miami Hospital and
197Julio E. Arronte, M.D., with a copy of the Petition on October 3,
2102016. As of the date of this Summary Final Order of Dismissal,
222neither Dr. Arronte nor South Miami Hospital has petitioned to
232intervene into this procee ding.
237On December 13, 2016, NICA filed a Motion for Summary Final
248Order, requesting that a summary final order be entered finding
258that the claim was not compensable because Aydrian did not
268sustain a Ðbirth - related neurological injuryÑ as that term is
279defi ned in section 766.302(2), Florida Statutes. Petitioners did
288not file a response to the Motion.
295On December 29, 2016, an Order to Show Cause was entered
306which allowed Petitioners until January 13, 2017, to inform the
316undersigned in writing as to why the m otion should not be granted
329and a summary final order be entered finding PetitionersÓ claim
339is not compensable. To date, no response has been filed by
350Petitioners to the Motion or to the Order to Show Cause.
361FINDINGS OF FACT
3641. Aydrian Portuondo was born on October 16, 2014, at South
375Miami Hospital in Coral Gables, Florida.
3812. Donald Willis, M.D. (Dr. Willis), was requested by NICA
391to review the medical records for Aydrian . In a report dated
403November 7, 2016, Dr. Willis described his findings in pertinent
413part as follows:
416Delivery was by spontaneous vaginal birth.
422Birth weight was 3,000 grams. Apgar scores
430were 4/8. The newborn was pale and Jaundice.
438After intubation for suctioning meconium, bag
444and mask ventilation was required for poor
451respi ratory effort. Initial oxygen
456saturation was low at 70% and the baby was
465re - intubated and taken to the NICU.
473Generalized petechiae were noted on NICU
479evaluation. The liver and spleen were felt
486to be enlarged. Platelet count was only
49314,000. TORCH infe ction was suspected.
500Urine culture for CMV was positive and CMV
508IgM antibody was also positive.
513Liver function studies were elevated. The
519newborn hearing test was failed.
524MRI on DOL 3 had findings consistent with
532congenital CMV infection with dilated lateral
538ventricles and multiple periventricular
542calcifications. Follow - up MRIÓs continued to
549show similar findings with diffuse volume
555loss and findings consistent with congenital
561CMV.
562The baby was followed on an out - patient basis
572by Infectious Disease f or congenital CMV
579infection.
580In summary, the pregnancy was complicated by
587fetal congenital CMV infection. Physical
592exam of the baby, laboratory testing and head
600imaging studies were consistent with this
606diagnosis.
607There was no apparent obstetrical eve nt that
615resulted in loss of oxygen or mechanical
622trauma to the babyÓs brain during labor,
629delivery or the immediate post delivery
635period. The childÓs brain injury would be
642consistent with congenital CMV infection and
648not a birth related hypoxic event.
6543. Dr. Willis reaffirmed his opinion in an affidavit dated
664November 17, 2016.
6674. A review of the file reveals that no contrary evidence
678was presented to dispute Dr. WillisÓ finding that there was no
689apparent obstetrical event that resulted in loss of oxy gen or
700mechanical trauma to the babyÓs brain during labor, delivery, or
710the immediate post - delivery period. Dr. WillisÓ opinion is
720credited.
721CONCLUSIONS OF LAW
7245. The Division of Administrative Hearings has jurisdiction
732over the parties to and the subjec t matter of these proceedings.
744§§ 766.301 - 766.316, Fla. Stat.
7506. The Plan was established by the Legislature Ð for the
761purpose of providing compensation, irrespective of fault, for
769birth - related neurological injury claims Ñ relating to births
779occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
7907. The injured infant, her or his personal representative,
799parents, dependents, and next of kin may seek compensation under
809the Plan by filing a claim for compensation with DOAH.
819§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
827which administers the Plan, has Ð 45 days from the date of service
840of a complete claim . . . in which to file a response to the
855petition and to submit relevant written information relating to
864the issue of whethe r the injury is a birth - related neurological
877injury. Ñ § 766.305(4), Fla. Stat.
8838. NICA has determined that Petitioners do not have a claim
894that is compensable under the Plan and has filed a Motion for
906Summary Final Order, requesting that an order be en tered finding
917that the claim is not compensable.
9239. In ruling on the motion, the administrative law judge
933must make the following determination based upon the available
942evidence:
943(a) Whether the injury claimed is a birth -
952related neurological injury. If the claimant
958has demonstrated, to the satisfaction of the
965administrative law judge, that the infant has
972sustained a brain or spinal cord injury
979caused by oxygen deprivation or mechanical
985injury and that the infant was thereby
992rendered permanently and subst antially
997mentally and physically impaired, a
1002rebuttable presumption shall arise that the
1008injury is a birth - related neurological injury
1016as defined in s. 766.303(2).
1021§ 766.309(1), Fla. Stat.
102510. The term Ð birth - related neurological injury Ñ is defined
1037in section 766.302(2) as follows:
1042Ð Birth - related neurological injury Ñ means
1050injury to the brain or spinal cord of a live
1060infant weighing at least 2,500 grams for a
1069single gestation or, in the case of a
1077multiple gestation, a live infant weighing at
1084least 2,0 00 grams at birth caused by oxygen
1094deprivation or mechanical injury occurring in
1100the course of labor, delivery, or
1106resuscitation in the immediate postdelivery
1111period in a hospital, which renders the
1118infant permanently and substantially mentally
1123and physica lly impaired.
112711. The evidence, which is not refuted, established that
1136there was no apparent obstetrical event that resulted in loss of
1147oxygen or mechanical trauma to AydrianÓs brain during labor,
1156delivery or the immediate post - delivery period. Thus, A ydrian is
1168not eligible for benefits under the Plan.
1175CONCLUSION
1176Based upon the foregoing Findings of Fact and Conclusions of
1186Law, it is ORDERED that the Petition filed by Ada Fernandez and
1198Anthony Portuondo, on behalf of and as parents and natural
1208guardia ns of Aydrian Portuondo, a minor, is dismissed with
1218prejudice.
