84STATEMENT OF THE CASE
88On October 5, 2016, Petitioners, Jaya Krishna Sabbineni and
97Kavitha Nagalla, as parents and natural guardians of Sathvik C.
107Sabbineni (Sa t hvik), a minor , filed a Petition for Benefits
118Pursu ant to Florida Statu t e Section 766.301 et seq. (Petition)
130with the Division of Administrative Hearings (DOAH) for the
139determination of compensability under the Florida Birth - Related
148Neurological Injury Compensation Plan (Plan). The Petition named
156Jeannine V. Mauney, M.D. , and Nat a sha Eliz, M.D., as the
168physicians who provided obstetric services for the birth of
177Sa t hvi k on October 21, 2014, at St. VincentÓs Medical Center in
191Jacksonville, Florida.
193DOAH served NICA and St. VincentÓs Medical Center with a
203copy of the Petition on October 17, 2016. Jeannine V .
214M auney, M.D. , was served with a c opy of the Petition on
227December 2, 2016 .
231On February 12, 2018, NICA filed a Motion for Summary Final
242Order, requesting that a summary final order be entered finding
252that the claim was not compensable because Sathvik did not
262sustain a Ðbirth - related neurological injuryÑ as that term is
273defined in section 766.302(2), Florida Statutes.
279On February 20, 2018, the undersigned i ssued an Order to
290Show Cause, ordering Petitioners to show cause in writing, on or
301before February 27, 2018, why RespondentÓs motion should not be
311granted and an order entered determining that the instant claim
321is not compensable.
324On February 26, 2018, Pe titioner s filed a motion to extend
336the time to respond to the Order to Show Cause to March 14, 2018.
350Petitioners represented that they were working with medical
358experts to provide a report related to the subject minor. On
369February 27, 2018, Respondent fi led a response to Petitioner s Ó
381motion and represented it had no objection to the request;
391however, requested that the final hearing be continued to provide
401the parties sufficient time to conduct additional discovery, if
410necessary, based upon the anticipate d expert reports to be filed
421by Petitioner s .
425On February 28, 2018, the undersigned issued an Order
434Granting Continuance. Said Order granted Petitioner s Ó motion for
444extension of time to respond to the Order to Show Cause on or
457before March 14, 2018 . Said O rder further found good cause for
470continuance of the final hearing, and cancelled the final hearing
480previously scheduled for March 29, 2018. Petitioners did not
489file a response to the Order to Show Cause.
498F INDINGS OF FACT
5021. Sathvik was born on Octob er 21, 2014, at St. VincentÓs
514Medical Center in Jacksonville, Florida.
5192. Donal d Willis, M.D., a n obstetrician specializing in
529maternal - fetal medicine, was requested by NICA to review the
540medical records of Sathvik , to opine whether an injury occurred
550i n the course of labor, delivery or resuscitation in the
561immediate postdelivery period at St. VincentÓs due to oxygen
570deprivation or mechanical injury . In a report dated November 18,
5812016, Dr. Willis described his findings in pertinent part as
591follows:
592In summary, the baby was delivered at term
600and was not depressed at birth. Apgar scores
608were 8/9. Cord bloo d pH was normal at 7.37.
618The baby had a benign newborn hospital course
626and was discharged home on DOL (day of
634life) 2.
636There was no apparent obs tetrical event that
644resulted in loss of oxygen or mechanical
651trauma to the babyÓs brain during labor,
658delivery or the immediate post delivery
664period.
6653. Attached to RespondentÓs Motion for Summary Final Order
674is the affidavit of Dr. Willis, dated February 6, 2018. In his
686affidavit, Dr. Willis affirms his November 18, 2016, report and
696maintains that his opinions are within a reason able degree of
707medical probability.
7094. NICA also retained Laufey Y. Sigurdardottir, M.D., a
718pediatric neurologi st, to review SathvikÓs medical records and
727conduct an Independent Medical Examination and opine as to
736whether he suffers from a permanent and substantial mental and
746physical impairment as a result of a birth - related neurological
757injury. Dr. Sigurdardotti r reviewed the medical records,
765obtained a full historical account from SathvikÓs parents, and
774performed a full neurological evaluation on January 11, 2017.
7835. In a report authored after the neurologic evaluation,
792Dr. Sigurdardottir summarized her findings as follows:
799Summary: Here we have a 2 - year 3 - month old,
811ex full - term infant, born via vaginal
819delivery, with a single late deceleration
825approximately 2 hours prior to birth. He had
833no signs of perinatal encephalopathy but was
840diagnosed with a l eft hemiplegic CT at 6
849months of age. He was found to have
857evidence, on head ultrasound, of a remote
864stroke. At this time, it is difficult to
872establish the timing of his stroke. He has a
881mild language delay, but no signs of a more
890severe global cognitiv e delay. His motor
897impairment is substantial. He is in all
904therapy services at this time. He does have
912treated epilepsy.
9146. In response to whether Sathvik suffers from a permanent
924and substantial mental and physical impairment,
930Dr. Sigur dardot tir opined in h er report that, ÐSathvik is found
943to have a substantial physical impairment with a left spastic
953hemiplegia, but a nonsubstantial cognitive impairment, with a
961mild expressive language delay. Ñ
9667. In response to whether such an impairme nt is consistent
977with a neurologic injury to the brain or spinal cord acquired due
989to oxygen deprivation or mechanical injury, and, if so, whether
999the injury is felt to be labor and birth related,
1009Dr. Sigurdardottir opined in her report that, Ð[i]n review of
1019available documents, his injury is felt to be acquired due to
1030oxygen deprivation of the brain, but it is unclear that this
1041injury is birth related.Ñ
10458. Finally, in response to SathvikÓs prognosis and estimate
1054of life expectancy, Dr. Sigurdardot tir opined in h er report that,
1066Ð[t]he prognosis for full motor recovery is poor. The prognosis
1076for mental abilities is excellent. They estimate a life
1085expectancy is normal.Ñ Her report concluded that, Ð[i]n light of
1095his normal cognitive abilities, apart from a mild expressive
1104language delay, and the difficulty with timing of his ischemic
1114injury, I do not feel that Sathvik should be included in the NICA
1127Program.Ñ
11289. RespondentÓs Motion for Summary Final Order also relies
1137upon the attached affidavi t from Dr. Sigurdardottir, dated
1146February 8, 2018. In her affidavit, she affirms the findings
1156contained in her report and affirms that her opinions are within
1167a reasonable degree of medical probability.
117310. A review of the file reveals that no con trary evidence
1185was presented to dispute the findings and opinions of Dr. Willis
1196and Dr. Sigurdardottir. Their opinions are credited.
1203CONCLUSIONS OF LAW
120611 . DOAH has jurisdiction over the parties to and the
1217subject matter of these proceedings. §§ 766.3 01 - 766.316, Fla.
1228Stat.
12291 2 . The Plan was established by the Legislature "for the
1241purpose of providing compensation, irrespective of fault, for
1249birth - related neurological injury claims" relating to births
1258occurring on or after January 1, 1989. § 766.303(1 ), Fla. Stat.
12701 3 . The injured infant, her or his personal representative,
1281parents, dependents, and next of kin may seek compensation under
1291the Plan by filing a claim for compensation with DOAH.
1301§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
1309which administers the Plan, has "45 days from the date of service
1321of a complete claim . . . in which to file a response to the
1336petition and to submit relevant written information relating to
1345the issue of whether the injury is a birth - related neurological
1357injury." § 766.305(4), Fla. Stat.
13621 4 . NICA has determined that Petitioner does not have a
1374claim that is compensable under the Plan and has filed a Motion
1386for Summary Final Order, requesting that an order be entered
1396finding that the claim is not compens able.
14041 5 . In ruling on the motion, the administrative law judge
1416must make the following determination based upon the available
1425evidence:
1426(a) Whether the injury claimed is a birth -
1435related neurological injury. If the claimant
1441has demonstrated, to the sati sfaction of the
1449administrative law judge, that the infant has
1456sustained a brain or spinal cord injury
1463caused by oxygen deprivation or mechanical
1469injury and that the infant was thereby
1476rendered permanently and substantially
1480mentally and physically impaired, a
1485rebuttable presumption shall arise that the
1491injury is a birth - related neurological injury
1499as defined in s. 766.303(2).
1504§ 766.309(1), Fla. Stat.
15081 6 . The term "birth - related neurological injury" is defined
1520in section 766.302(2) as follows:
"1525Birth - re lated neurological injury" means
1532injury to the brain or spinal cord of a live
1542infant weighing at least 2,500 grams for a
1551single gestation or, in the case of a
1559multiple gestation, a live infant weighing at
1566least 2,000 grams at birth caused by oxygen
1575depriva tion or mechanical injury occurring in
1582the course of labor, delivery, or
1588resuscitation in the immediate postdelivery
1593period in a hospital, which renders the
1600infant permanently and substantially mentally
1605and physically impaired.
160817 . The evidence fails to establish that there was an
1619obstetrical event that resulted in loss of oxygen or mechanical
1629trauma to SathvikÓs brain or spinal cord during labor, delivery,
1639or the immediate post - delivery period. Even if the eviden ce had
1652established that Sathvik had sust ained a stroke in the course of
1664labor, delivery, or resuscitation in the immediate postdelivery
1672period, the unrefuted evidence established that Sathvik did not
1681sustain a permanent and substantial mental impairment. Thus,
1689Sathvik did not sustain a birth - re lated neurological injury as
1701defined in section 766.302(2), Florida Statutes, and, therefore,
1709is not eligible for benefits under the Plan.
1717CONCLUSION
1718Based upon the foregoing Findings of Fact and Conclusions of
1728Law, it is ORDERED that the Petition is dis missed with prejudice.
1740DONE AND ORDERED this 22nd day of March , 2018 , in
