68STATEMENT OF THE CASE
72On November 2, 2016, Petitioners, Valentin Mares and
80Yudiria Chavez, on behalf of and as parents and natural guardians
91of Eileen Mares (Eileen), a minor, filed a Petition for Benefits
102Pursuant to Florida Statute Section 766.301 et seq. (Petition)
111with the Div ision of Administrative Hearings (DOAH) for
120determination of compensability under the Florida Birth - Related
129Neurological Injury Compensation Plan (Plan). The Petition named
137Joanna B. Davis, M.D., as the physician who provided obstetric
147services at the bir th of Eileen at Jackson South Community
158Hospital on August 30, 2014.
163DOAH served the Florida Birth - Related Neurological Injury
172Compensation Association (NICA) with a copy of the Petition on
182November 9, 2016. DOAH served Joanna B. Davis, M.D., on
192November 10, 2016. The docket reflects that DOAH received a
202Certified Return Receipt from the United States Postal Service on
212January 13, 2017, showing that Jackson South Community Hospital
221had been served with a copy of the Petition.
230On January 12, 2017, Petitio ners filed a Motion for Leave to
242File an Amended Petition for Benefits. The Motion was granted,
252and the Amended Petition corrected the name of the physician who
263provided obstetric services at EileenÓs birth to be Mol r ine
274Andrea Tracey, M.D. DOAH served a copy of the Amended Petition
285on Mol r ine Andrea Tracey, M.D., on January 20, 2017. DOAHÓs
297docket reflects that NICA was served with a copy of the Amended
309Petition on January 21, 2017, and Jackson Community Hospital was
319served a copy of the Amended Petitio n on January 24, 2017.
331As of the date of this Summary Final Order of Dismissal,
342neither Jackson South Community Hospital nor Dracey has
350petitioned to intervene in this proceeding.
356On January 31, 2017, NICA filed a Motion for Summary Final
367Order, sta ting that, at the time of EileenÓs birth, Dr. Tracey
379was not a Ðparticipating physicianÑ as that term is defined by
390section 766.302(7), Florida Statutes (2015). Petitioners filed a
398Motion in Partial Support to RespondentÓs Motion for Summary
407Final Order, on February 10, 2017.
413FINDINGS OF FACT
4161. The Amended Petition named Dracey Molrine as the
425physician providing obstetric services at EileenÓs birth on
433August 30, 2014.
4362. Attached to the Motion for Summary Final Order is an
447affidavit of NICA's custod ian of records, Tim Daughtry, attesting
457to the following, which has not been refuted:
465One of my official duties as Custodian of
473Records is to maintain NICAÓs official
479records relative to the status of physicians
486as participating physicians in the Florida
492B irth - Related Neurological Compensation Plan
499who have timely paid the Five Thousand Dollar
507($5,000.00) assessment prescribed in Section
513766.314(4)(c), Florida Statutes, and the
518status of physicians who may be exempt from
526payment of the Five Thousand Dollar
532($5,000.00) assessment pursuant to Section
538766.314(4)(c), Florida Statutes. Further, I
543maintain NICA's official records with respect
549to the payment of the Two Hundred Fifty
557Dollar ($250.00) assessment required by
562Section 766.314(4)(b)1., Florida Statutes, by
567all non - participating, non - exempt physicians.
575* * *
578As payments of the requisite assessments are
585received, NICA compiles data in the ÐNICA
592CARESÑ database for each physician. The
598ÐNICA CARES physician payment history/reportÑ
603attached hereto for Dracey Molrine [ sic ]
611indicates that in the year 2014, the year in
620which Dr. Molrine [ sic ] participated in the
629delivery of Eileen Mares, as indicated in the
637PetitionersÓ Petition for Benefits,
641Dr. Morline [ sic ] did not pay the Five
651Thousand Dollar ( $5,000) assessment required
658for participation in the Florida Birth -
665Related Neurological Injury Compensation
669Plan.
670Further, it is NICAÓs policy that if a
678physician falls within the exemption from
684payment of the Five Thousand Dollar ($5,000)
692assessment due to their status as a resident
700physician, assistant resident physician or
705intern as provided in Section 766.314(4)(c),
711Florida Statutes, annual documentation as to
717such exempt status is required to be provided
725to NICA. NICA has no records with respect to
734D r. Molrine [ sic ] in relation to an exempt
745status for the year 2014. To the contrary,
753the attached "NICA CARES physician payment
759history/report shows that in 2013 [ sic ] ,
767Dr. Molrine [ sic ] paid the Two Hundred and
777Fifty Dollar ($250) assessment required by
783Section 766.314(4)(b)1., Florida Statutes,
787for non - participating, non - exempt licensed
795physicians.
7963. The physician payment history/report for Dracey
803supports Mr. DaughtryÓs affidavit.
8074. Petitioners acknowledge in their Motion in Partial
815Support of RespondentÓs Motion for Final Summary Order that the
825requirement of section 766.309(1)(b), that obstetric services be
833provided by a participating physician, has not been satisfied.
8425. At the time of the birth of Eileen, Dracey was not a
855participatin g physician in the Plan.
861CONCLUSIONS OF LAW
8646. The Division of Administrative Hearings has jurisdiction
872over the parties to, and the subject matter of, these
882proceedings. §§ 766.301 - 766.316, Fla. Stat.
8897. The Plan was established by the Legislature Ðfor the
899purpose of providing compensation, irrespective of fault, for
907birth - related neurological injury claimsÑ relating to births
916occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
9278. The injured infant, her or his personal representativ e,
937parents, dependents, and next of kin may seek compensation under
947the Plan by filing a claim for compensation with DOAH .
958§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
966which administers the Plan, has Ð45 days from the date of service
978of a complete claim . . . in which to file a response to the
993petition and to submit relevant written information relating to
1002the issue of whether the injury is a birth - related neurological
1014injury.Ñ £ 766.305(4), Fla. Stat.
10199. If NICA determines that the injur y alleged in a claim is
1032a compensable birth - related neurological injury, it may award
1042compensation to the claimant, provided that the award is approved
1052by the administrative law judge to whom the claim has been
1063assigned. § 766.305(7), Fla. Stat. If, on t he other hand, NICA
1075disputes the claim, as it has in the instant case, the dispute
1087must be resolved by the assigned administrative law judge in
1097accordance with the provisions of chapter 120, Florida Statutes.
1106§§ 766.304, 766.309, and 766.31, Fla. Stat.
11131 0. In discharging this responsibility, the administrative
1121law judge must make the following determination based upon the
1131available evidence:
1133(a) Whether the injury claimed is a birth -
1142related neurological injury. If the claimant
1148has demonstrated, to the satisfaction of the
1155administrative law judge, that the infant has
1162sustained a brain or spinal cord injury
1169caused by oxygen deprivation or mechanical
1175injury and that the infant was thereby
1182rendered permanently and substantially
1186mentally and physically impa ired, a
1192rebuttable presumption shall arise that the
1198injury is a birth - related neurological injury
1206as defined in s. 766.303(2).
1211(b) Whether obstetrical services were
1216delivered by a participating physician in the
1223course of labor, delivery, or resuscitatio n
1230in the immediate postdelivery period in a
1237hospital; or by a certified nurse midwife in
1245a teaching hospital supervised by a
1251participating physician in the course of
1257labor, delivery, or resuscitation in the
1263immediate postdelivery period in a hospital.
1269§ 766.309(1), Fla. Stat. An award may be sustained only if the
1281administrative law judge concludes that the Ðinfant has sustained
1290a birth - related neurological injury and that obstetrical services
1300were delivered by a participating physician at birth.Ñ
1308§ 766. 31(1), Fla. Stat.
131311. Pertinent to this case, "participating physician" is
1321defined by section 766.302(7) to mean:
1327[A] physician licensed in Florida to practice
1334medicine who practices obstetrics or performs
1340obstetrical services either full - time or
1347part - ti me and who had paid or was exempted
1358from payment at the time of the injury the
1367assessment required for participation in the
1373birth - related neurological injury
1378compensation plan for the year in which the
1386injury occurred.
138812. Dracey had not paid her as sessment of $5,000 at
1400the time Eileen was born; therefore, she was not a participating
1411physician at the time of EileenÓs birth. No evidence was
1421submitted that, at the time of EileenÓs birth, Dr. Tracey was
1432excluded from paying the $5,000 assessment requir ed for
1442participating physicians. To the contrary, the physician payment
1450history/report shows that in 2014, Dracey paid the $250
1459assessment required by section 766.314(4)(6)1., for non -
1467participating, non - exempt licensed physicians.
147313. The obstetrical services provided during Eileen's birth
1481were not provided by a participating physician. Thus, the claim
1491on behalf of Eileen is not compensable under the Plan.
1501CONCLUSION
1502Based on the Findings of Fact and Conclusions of Law, it is
1514ORDERED that Respondent' s Motion for Summary Final Order is
1524granted, and the Amended Petition filed by Valentin Mares and
1534Yudiria Chavez, on behalf of and as parents and natural guardians
1545of Eileen Mares, a minor, is dismissed with prejudice.
