43This cause came on for consideration upon the partiesÓ Joint

53Stipulation of Non - compensability and request for an entry of a

65summary final order of non - compensability filed on March 2, 2017.

77STATEMENT OF THE CASE

81On November 3, 2016, Petitioner, Radiah Nixon, individually

89and as parent of Calise L. Muniz (Calise), a minor, filed a

101Petition for Determination of Compensability Pursuant to Florida

109Statute Section 766.301 et seq. with th e Division of

119Administrative Hearings (DOAH) for a determination of

126compensability under the Florida Birth - Related Neurological

134Injury Compensation Plan (Plan).

138The Petition named Matthew H. Conrad, M.D., as the physician

148who provided obstetric services at the birth of Calise on May 2,

1602015, at Holmes Regional Medical Center located in Melbourne,

169Florida.

170DOAH served NICA with a copy of the Petition on November 14,

1822016. DOAH served Matthew H. Conrad, M.D., and Holmes Regional

192Medical Center with a copy of the Petition on November 16, 2016.

204As of the date of this Summary Final Order of Dismissal,

215neither Matthew H. Conrad, M.D., nor Holmes Regional Medical

224Center, has petitioned to intervene into this proceeding.

232On February 20, 2017, NICA filed a Respo nse to Petition for

244Benefits, asserting that Calise did not sustain a "birth - related

255neurological injury" as that term is defined in section

264766.302(2), Florida Statutes, and requested that a hearing be

273scheduled to determine compensability.

277On March 2 , 2017, the parties filed a Joint Stipulation of

288Non - compensability. The parties stipulated that Calise does not

298meet the statutory requirements for compensability and requested

306in the Joint Stipulation that a final summary order of non -

318compensability be entered.

321FINDINGS OF FACT

3241. Calise L. Muniz was born on May 2, 2015, at Holmes

336Regional Medical Center, located in Melbourne, Florida. Calise

344weighed in excess of 2,500 grams at birth.

3532. Donald Willis, M.D. (Dr. Willis), was requested by NICA

363to rev iew the medical records for Calise. In a medical report

375dated January 24, 2017, Dr. Willis opined in pertinent part as

386follows:

387In summary, the mother apparently became

393hypotensive after placement of epidural

398anesthesia with resulting fetal distress.

403The baby was depressed at birth. The initial

411ABG was consistent with metabolic acidosis.

417Cooling protocol was initiated for HIE. EEG

424was normal for age. No MRI or CT scan was

434done during the newborn hospital course.

440There was an apparent obstetrical eve nt that

448resulted in loss of oxygen during labor and

456delivery. However, there was no

461documentation of actual brain injury.

4663. NICA retained Laufey Y. Sigurdardottir, M.D.

473(Dr. Sigurdardottir), a pediatric neurologist, to examine Calise

481and to review her medical records. Dr. Sigurdardottir examined

490Calise on February 1, 2017. In a medical report dated

500February 1, 2017, Dr. Sigurdardottir summarized her examination

508of Calise and opined in pertinent part as follows:

517Summary: Calise is a 21 - month - old fema le who

529was born via emergency cesarean section after

536nonreassuring fetal heart rate tracings were

542noted after a high spinal anesthesia. She

549had poor Apgars of 2, 4 and 5 after 1, 5 and

56110 minutes, and was treated with cooling

568protocol. She did not have a ny neonatal

576seizures and the only neuroimaging available

582is a head ultrasound on day of life 1 that

592was normal. On neurologic exam today she is

600normal, both with her motor skills and

607cognition and language development. There

612are no signs of autistic feat ures.

619Results as to question 1: Calise is not

627found to have substantial physical or mental

634impairment at this time.

638Results as to question 2: In review of

646available documents, she does have the

652clinical picture of an acute birth - related

660hypoxic injury.

662Results as to question 3: The prognosis for

670full motor and mental recovery is excellent

677and her life expectancy is full.

683In light of the normal cognitive abilities

690and normal neurologic exam, I do not feel

698that Calise should be included in the NICA

706p rogram. If needed, I will be happy to

715answer additional questions.

7184. A review of the file in this case reveals that there

730have been no expert opinions filed that are contrary to the

741opinion of Dr. Willis that while there was an apparent

751obstetrical eve nt that resulted in loss of oxygen to the baby's

763brain during labor and delivery, there was no documentation of

773actual brain injury. Dr. WillisÓ opinion is credited. There are

783no expert opinions filed that are contrary to

791Dr. SigurdardottirÓs opinion tha t Calise does not have a

801substantial physical or mental impairment. Dr. SigurdardottirÓs

808opinion is credited.

811CONCLUSIONS OF LAW

8145. The Division of Administrative Hearings has jurisdiction

822over the parties to and the subject matter of these proceedings.

833§§ 766.301 - 766.316, Fla. Stat.

8396. The Plan was established by the Legislature "for the

849purpose of providing compensation, irrespective of fault, for

857birth - related neurological injury claims" relating to births

866occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

8777. The injured infant, her or his personal representative,

886parents, dependents, and next of kin may seek compensation under

896the Plan by filing a claim for compensation with DOAH.

906§§ 766.302(3), 766.303(2), and 766.305(1), Fl a. Stat. NICA,

915which administers the Plan, has "45 days from the date of service

927of a complete claim . . . in which to file a response to the

942petition and to submit relevant written information relating to

951the issue of whether the injury is a birth - relate d neurological

964injury." § 766.305(4), Fla. Stat.

9698. If NICA determines that the injury alleged in a claim is

981a compensable birth - related neurological injury, it may award

991compensation to the claimant, provided that the award is approved

1001by the administr ative law judge to whom the claim has been

1013assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1024disputes the claim, as it has in the instant case, the dispute

1036must be resolved by the assigned administrative law judge in

1046accordance with the prov isions of chapter 120, Florida Statutes.

1056§§ 766.304, 766.309, and 766.31, Fla. Stat.

10639. In discharging this responsibility, the administrative

1070law judge must make the following determination based upon the

1080available evidence:

1082(a) Whether the injury cla imed is a birth -

1092related neurological injury. If the claimant

1098has demonstrated, to the satisfaction of the

1105administrative law judge, that the infant has

1112sustained a brain or spinal cord injury

1119caused by oxygen deprivation or mechanical

1125injury and that the infant was thereby

1132rendered permanently and substantially

1136mentally and physically impaired, a

1141rebuttable presumption shall arise that the

1147injury is a birth - related neurological injury

1155as defined in s. 766.303(2).

1160(b) Whether obstetrical services were

1165de livered by a participating physician in the

1173course of labor, delivery, or resuscitation

1179in the immediate postdelivery period in a

1186hospital; or by a certified nurse midwife in

1194a teaching hospital supervised by a

1200participating physician in the course of

1206labo r, delivery, or resuscitation in the

1213immediate postdelivery period in a hospital.

1219§ 766.309(1), Fla. Stat. An award may be sustained only if the

1231administrative law judge concludes that the "infant has sustained

1240a birth - related neurological injury and th at obstetrical services

1251were delivered by a participating physician at birth."

1259§ 766.31(1), Fla. Stat.

126310. The term "birth - related neurological injury" is defined

1273in section 766.302(2) as follows:

"1278Birth - related neurological injury" means

1284injury to the brain or spinal cord of a live

1294infant weighing at least 2,500 grams for a

1303single gestation or, in the case of a

1311multiple gestation, a live infant weighing at

1318least 2,000 grams at birth caused by oxygen

1327deprivation or mechanical injury occurring in

1333the cou rse of labor, delivery, or

1340resuscitation in the immediate postdelivery

1345period in a hospital, which renders the

1352infant permanently and substantially mentally

1357and physically impaired.

136011. The evidence, which is not refuted, established that

1369Calise did not sustain an injury to the brain or spinal cord

1381caused by oxygen deprivation or mechanical injury in the course

1391of labor, delivery, or resuscitation in the immediate post -

1401delivery period in a hospital which rendered her permanently and

1411substantially mentall y and physically impaired. Therefore,

1418Calise is not eligible for benefits under the Plan.

1427CONCLUSION

1428Based upon the foregoing Findings of Fact and Conclusions of

1438Law, it is ORDERED that the Petition filed by Radiah Nixon,

1449individually and as parent of Ca lise L. Muniz, is dismissed with

1461prejudice.
