84STATEMENT OF THE CASE

88On November 16, 2016, Petitioners, Jeffrey Antunes and Kesia

97Antunes, individually and as pare nts of Melina Antunes (Melina),

107a minor, filed a Petition for Determination of Compensability

116Pursuant to Florida Statute Section 766.301 et seq. (Petition)

125with the Division of Administrative Hearings (DOAH) for a

134determination of compensability under the Florida Birth - Related

143Neurological Injury Compensation Plan (Plan).

148The Petition named Pedro Cruz - Torres, M.D., as the physician

159who provided obstetric services at the birth of Melina on

169August 27, 2015, at Florida Hospital located in Orlando, Florida.

179DOAH served NICA and Pedro Cruz - Torres, M.D., with a copy of

192the Petition on November 28, 2016. On November 23, 2016,

202Adventist Health System/Sunbelt, Inc., d/b/a Florida Hospital

209Altamonte, filed a Petition to Intervene, which was granted.

218As of the da te of this Summary Final Order of Dismissal,

230Pedro Cruz - Torres, M.D., has not petitioned to intervene into

241this proceeding.

243On March 1, 2017, NICA filed a Response to Petition for

254Benefits, asserting that Melina did not sustain a "birth - related

265neurologica l injury" as that term is defined in section

275766.302(2), Florida Statutes, and requested that a hearing be

284scheduled to determine compensability.

288On March 16, 2017, the parties filed a Status Report stating

299that the parties were in agreement that a fin al hearing was not

312necessary. On the same day, Respondent filed an Unopposed Motion

322for Summary Final Order.

326FINDINGS OF FACT

3291. Melina Antunes was born on August 27, 2015, at Florida

340Hospital, located in Orlando, Florida. Melina weighed in excess

349of 2,500 grams at birth.

3552. Donald Willis, M.D. (Dr. Willis), was requested by NICA

365to review the medical records for Melina. In a medical report

376dated December 12, 2016, Dr. Willis summarized his findings and

386opined in pertinent part as follows:

392In summ ary, induction of labor was

399complicated by a spontaneous uterine rupture.

405The baby and placenta were expelled into the

413maternal abdomen. The baby was depressed at

420birth with low Apgar scores and a cord blood

429gas consistent with acidosis (pH 6.65). MRI

436w as consistent with HIE.

441There was an apparent obstetrical event

447(uterine rupture) that resulted in loss of

454oxygen to the babyÓs brain during labor,

461delivery, and continuing into the immediate

467post delivery period. The oxygen deprivation

473resulted in brai n injury.

4783. NICA retained Laufey Y. Sigurdardottir, M.D.

485(Dr. Sigurdardottir), a pediatric neurologist, to examine Melina

493and to review her medical records. Dr. Sigurdardottir examined

502Melina on February 15, 2017. In a medical report dated

512February 1 5, 2017, Dr. Sigurdardottir summarized her examination

521of Melina and opined in pertinent part as follows:

530Summary: Here we have a 17 - month - old born

541after a sudden uterine rupture during active

548labor. The patient had neurologic depression

554at birth, signif icant acidosis with a pH of

5636.6 and required active cooling as well as

571supportive medication for seizures in the

577neonatal period. She did have well

583documented injury on MRI but has made a

591remarkable recovery. Neurologic exam today,

596has mild abnormalities , but no standardized

602developmental testing is available for our

608review.

609Result as to question 1: Melina is not found

618to have substantial physical or mental

624impairment at this time.

628Results as to question 2: In review of

636available documents, Melina do es have the

643clinical picture of an acute birth related

650hypoxic injury with both the clinical

656features of hypoxic encephalopathy and

661electrographic and MRI evidence to suggest

667hypoxic injury.

669Result as to question 3: The prognosis for

677full motor and menta l recovery currently is

685excellent and her life expectancy is full.

692In light of her normal cognitive abilities

699and near normal neurologic exam, I do not

707feel that Melina should be included in the

715NICA program. If needed, I will be happy to

724answer additi onal questions or review further

731documentation of her developmental status.

7364. A review of the file in this case reveals that there

748have been no expert opinions filed that are contrary to the

759opinion of Dr. Willis that there was an apparent obstetrical

769e vent that resulted in loss of oxygen to the baby's brain during

782labor, delivery and the post - delivery period which resulted in

793brain injury. Dr. WillisÓ opinion is credited. There are no

803expert opinions filed that are contrary to Dr. SigurdardottirÓs

812opi nion that Melina does not have a substantial physical or

823mental impairment. Dr. SigurdardottirÓs opinion is credited.

830CONCLUSIONS OF LAW

8335. The Division of Administrative Hearings has jurisdiction

841over the parties to and the subject matter of these proc eedings.

853§§ 766.301 - 766.316, Fla. Stat.

8596. The Plan was established by the Legislature "for the

869purpose of providing compensation, irrespective of fault, for

877birth - related neurological injury claims" relating to births

886occurring on or after January 1, 1 989. § 766.303(1), Fla. Stat.

8987. The injured infant, her or his personal representative,

907parents, dependents, and next of kin may seek compensation under

917the Plan by filing a claim for compensation with DOAH.

927§§ 766.302(3), 766.303(2), and 766.30 5(1), Fla. Stat. NICA,

936which administers the Plan, has "45 days from the date of service

948of a complete claim . . . in which to file a response to the

963petition and to submit relevant written information relating to

972the issue of whether the injury is a birt h - related neurological

985injury." § 766.305(4), Fla. Stat.

9908. If NICA determines that the injury alleged in a claim is

1002a compensable birth - related neurological injury, it may award

1012compensation to the claimant, provided that the award is approved

1022by the a dministrative law judge to whom the claim has been

1034assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1045disputes the claim, as it has in the instant case, the dispute

1057must be resolved by the assigned administrative law judge in

1067accordance with the provisions of chapter 120, Florida Statutes.

1076§§ 766.304, 766.309, and 766.31, Fla. Stat.

10839. In discharging this responsibility, the administrative

1090law judge must make the following determination based upon the

1100available evidence:

1102(a) Whether the in jury claimed is a birth -

1112related neurological injury. If the claimant

1118has demonstrated, to the satisfaction of the

1125administrative law judge, that the infant has

1132sustained a brain or spinal cord injury

1139caused by oxygen deprivation or mechanical

1145injury and t hat the infant was thereby

1153rendered permanently and substantially

1157mentally and physically impaired, a

1162rebuttable presumption shall arise that the

1168injury is a birth - related neurological injury

1176as defined in s. 766.303(2).

1181(b) Whether obstetrical services were

1186delivered by a participating physician in the

1193course of labor, delivery, or resuscitation

1199in the immediate postdelivery period in a

1206hospital; or by a certified nurse midwife in

1214a teaching hospital supervised by a

1220participating physician in the course of

1226labor, delivery, or resuscitation in the

1232immediate postdelivery period in a hospital.

1238§ 766.309(1), Fla. Stat. An award may be sustained only if the

1250administrative law judge concludes that the "infant has sustained

1259a birth - related neurological injur y and that obstetrical services

1270were delivered by a participating physician at birth."

1278§ 766.31(1), Fla. Stat.

128210. The term "birth - related neurological injury" is defined

1292in section 766.302(2) as follows:

"1297Birth - related neurological injury" means

1303injur y to the brain or spinal cord of a live

1314infant weighing at least 2,500 grams for a

1323single gestation or, in the case of a

1331multiple gestation, a live infant weighing at

1338least 2,000 grams at birth caused by oxygen

1347deprivation or mechanical injury occurring in

1353the course of labor, delivery, or

1359resuscitation in the immediate postdelivery

1364period in a hospital, which renders the

1371infant permanently and substantially mentally

1376and physically impaired.

137911. To be compensable under the NICA Plan, there must have

1390been an obstetrical event which resulted in loss of oxygen to the

1402babyÓs brain during labor, delivery, or resuscitation in the

1411immediate post - delivery period resulting in a permanent and

1421substantial mental impairment and a permanent and substantial

1429physical im pairment, inasmuch as both are required to establish

1439compensability. Fla. Birth - Related Neurological Injury Comp.

1447AssÓn v. Div. of Admin. Hearings , 686 So. 2d 1349 (Fla. 1997).

145912. The evidence, which is not refuted, established that

1468Melina does not have a permanent and substantial mental or

1478physical impairment. Therefore, Melina is not eligible for

1486benefits under the Plan.

1490CONCLUSION

1491Based on the Findings of Fact and the Conclusions of Law, it

1503is ORDERED that :

1507T he Petition filed by Jeffrey Antunes and Kesia Antunes,

1517individually and as parents of Melina Antunes, is dismissed with

1527prejudice.
