62This cause comes before the Agency for Persons with Disabilities for entry of a Final

77Order of Dismissal following the receipt of an Order Closing File and Relinquishing Juri s diction ,

93a copy of which is attached to this Final Order.

103Petitioner had requested a hearing as a re s ult of an Agency decision notice denying the

120r e quest for exemption from disqualification. The hearing request was forwarded to the Division

135of Administrati v e Hearings for assignment of an Administrative Law Judge to conduct the

150hearing. Prior to the hearing , Petitioner filed a withdrawal of the request for an exemption ,

165which resulted in the issuance of the Order Closing File and Relinquishing Jurisdiction.

178Therefore , based on th e foregoing, the petition requesting an administrative hearing i s

192DENIED. The Agency action denying Petitioner ' s request for an exemption from

205disqualification is effective and final according to its terms.

246RIGHT TO APPEAL 

250A party who is adversely affected by this final order is entitled to judicial review. To initiate

267judicial review , the party seeking it must file one copy of a " Notice of Appeal" with the Agency

285Clerk . The party seeking judicial review must also file another copy of the " Notice of Appeal,"

302accompanied by the filing fee required by law, with the First District Court of Appeal in

318Tallahassee, Florida , or with the District Court of Appeal in the district where the party resides .

335Review proceedings shall be conducted in accordance with Florida Rules of Appellate Procedure.
