98STATEMENT OF THE ISSUE S
103The issues are whether attorneyÓs fees and costs should be
113awarded to the Petitioner (Petitioner or Dr. Aranda) under
122section 57.105, Florida Statutes (2016), 1 / and, if so, the amount
134of the fees and costs.
139PRELIMINARY STATEMENT
141The petition for attorneyÓs fees and costs in this case was
152filed on November 21, 2016. On January 26, 2017, the petition
163was amended to delete a claim under section 57.111, leaving a
174claim under section 57.105. A Joint Pre - hearing Stipulation was
185filed on February 13.
189At the final hearing, counsel for the Petitioner and an
199expert witness, Edwin Bayo, Esquire, testified for the Petitioner
208and her Exhibits 1 through 7 were received in evidence. Irene
219Lake and expert witness, Daniel Russell, Esquire, testified for
228the Department of Health , Board of Den t istry (Respondent or DOH),
240and RespondentÓs Exhibits 1 through 4 were received in evidence.
250The Transcript of the fi nal hearing was filed, and the parties
262filed proposed final orders that have been considered.
270FINDING S OF FACT
2741. In 2010, DOH received a sworn complaint from the Collier
285County Health Department (CCHD) alleging essentially: that
292Dr. Aranda was mis representing the nature of dental work she was
304providing to Medicaid patients to make it appear that she was
315prescribing and delivering non - orthodontic, ÐpassiveÑ appliances,
323which w as covered by Medicaid, when she actually was prescribing
334and delivering o rthodontic, ÐactiveÑ appliances, which w as not
344covered by Medicaid, after being warned by her supervisor not to
355do so; and that she was delegating irremediable tasks, such as
366permanently cementing dental appliances and hand - scaling, to
375unqualified dental a ssistants. DOH investigated, and a panel of
385the Board of Dentistry found probable cause based on the
395investigative report.
3972. In May 2015, DOH filed an Amended Administrative
406Complaint charging Dr. Aranda as follows: in Count I, with
416making decepti ve, untrue, or fraudulent representations in or
425related to the practice of dentistry in violation of section
435466.028(1)(l), Florida Statutes (2009) 2/ ; and, in Count II, with
445delegating irremediable tasks (hand - scaling and permanently
453cementing dental appli ances) to a dental assistant not qualified
463to perform those tasks, in violation of sections 466.028(1)(z)
472and 466.024(1), and Florida Administrative Code Chapter 64B5 - 16. 3/
483Dr. Aranda disputed the allegations and asked for a disputed - fact
495hearing under se ction 120.57(1), Florida Statutes (2015) 4/ . The
506case was referred to DOAH, designated case 15 - 6268PL, and
517scheduled for a final hearing on March 2, 2016.
5263. On February 11, 2016, Dr. Aranda served (but did not
537file) a motion for sanctions pursuant to section 57.105, Florida
547Statutes (2015). The motion asserted that DOH knew or should
557have known that several paragraphs in the Amended Administrative
566Complaint referred to the billing of Medicaid for ÐpassiveÑ space
576maintainers and other similar appli ances and related dental
585services, and that those allegations were not supported by the
595material facts necessary to establish them.
6014. The motion for sanctions served by Dr. Aranda in DOAH
612case 15 - 6268PL was based on discovery she had obtained thro ugh a
626deposition of the CCHDÓs records custodian. The deposition
634revealed that the documents DOH had been calling Medicaid billing
644records actually were Ðdental treatment plans.Ñ There were other
653documents called Ðbill service listsÑ that were the actual bills
663sent to Medicaid for payment. The Ðbill service listsÑ reflected
673flat fee bills to Medicaid for ÐMedicaid billing encounters.Ñ
682The Ðdental treatment plansÑ consisted of patient demographics,
690personal information, insurance and billing information, and
697services provided. The Ðdental treatment plansÑ contained
704references to space maintainers and similar non - orthodontic
713appliances that were covered by Medicaid, and there were
722references to events labeled Ðbill initiated.Ñ Both the Ðbill
731service list sÑ and the Ðdental treatment plansÑ were generated by
742the CCHDÓs so - called HMS computer system.
7505. The motion for sanctions served by Dr. Aranda in DOAH
761case 15 - 6268PL concluded with a warning that it would be filed if
775DOH did not withdraw the alle gations in the Amended
785Administrative Complaint referring to the billing of Medicaid for
794ÐpassiveÑ space maintainers and other similar appliances and
802related dental services. DOH did not withdraw the allegations.
8116. At the final hearing in DOAH ca se 15 - 6268PL, there was
825considerable confusion about the billing process and the various
834documents. Eventually, the Ðdental treatment plansÑ were
841received in evidence with the understanding that they were not
851the actual bills sent to Medicaid for payment. The Ðbill service
862listsÑ were not moved in evidence by either party.
8717. The billing information in the HMS system was entered by
882the CCHDÓs clerical staff from Ðsuper billsÑ that were created by
893dental practitioners, including Dr. Aranda, based on their care
902and treatment of patients. Besides submitting her Ðsuper bills,Ñ
912Dr. Aranda played no part in the generation of HMS billing
923information or the actual billing of Medicaid by the CCHD.
9338. The Ðsuper billsÑ were not available to be used in the
945final hearing because they were discarded shortly after the entry
955of the information they contained into the HMS system. No member
966of the CCHDÓs clerical staff testified, and there was no evidence
977about the RespondentÓs actual entries on her super bills. 5/
987Meanwhile, some of the patient records and appliance
995prescriptions written by Dr. Aranda for her Medicaid patients
1004accurately reflected the kinds of orthodontic - type ÐactiveÑ
1013appliances she was using for her Medicaid patients. Dr. Aranda
1023testifi ed that she was openly using orthodontic - type appliances
1034for non - orthodontic purposes for these Medicaid patients.
10439. The Recommended Order in DOAH case 15 - 6268PL was entered
1055on May 24, 2016. It found that DOH did not prove, by clear and
1069convincing evidence, the charge in the Amended Administrative
1077Complaint that Dr. Aranda was making deceptive, untrue, or
1086fraudulent representations in or related to the practice of
1095dentistry in violation of section 466.028(1)(l), Florida Statutes
1103(2009). It recommen ded dismissal of the charges. The Final
1113Order was entered on September 23, 2016; it adopted the
1123Recommended Order, despite exceptions filed by DOH.
113010. On November 21, 2016, the Petitioner filed a petition
1140for attorneyÓs fees and costs under both se ction 57.111 and
1151section 57.105. The petition was designated DOAH case 16 - 6924F.
1162It was amended to drop the claim under section 57.111.
117211. It was clear, and DOH knew or should have known within
118421 days of service of Dr. ArandaÓs section 57.105 mot ion for
1196sanctions in case 15 - 6268PL, that the HMS Ðdental treatment
1207plansÑ were not the actual bills sent to Medicaid for payment.
1218The HMS Ðbill service listsÑ were the actual bills sent to
1229Medicaid. However, the services billed to Medicaid via the HMS
1239Ð bill service listsÑ were the same services described in the HMS
1251Ðdental treatment plansÑ (even if the Ðbill service listsÑ
1260themselves did not specify the services). Dr. Aranda did not
1270prove by a preponderance of the evidence that DOH knew or should
1282have k nown that the charge in the Amended Administrative
1292Complaint, that Dr. Aranda was making deceptive, untrue, or
1301fraudulent representations in or related to the practice of
1310dentistry in violation of section 466.028(1)(l), Florida Statutes
1318(2009), was not sup ported by the material facts necessary to
1329establish it.
1331CONCLUSIONS OF LAW
133412. Under section 57.105(5), Florida Statutes, an
1341administrative law judge shall award a reasonable attorneyÓs fee
1350and damages to the prevailing party on the same basis as p rovided
1363in subsections (1) and (4). Subsection (1)(a) provides for an
1373award to the prevailing party on any claim or defense at any time
1386during a proceeding or action in which the losing party or its
1398attorney knew or should have known that a claim or defen se when
1411initially presented, or at any time before the final hearing, was
1422not supported by the material facts necessary to establish the
1432claim or defense.
143513. The Petitioner bases her section 57.105 petition for
1444sanctions on the allegations in DOHÓs Amended Administrative
1452Complaint referring to the billing of Medicaid for ÐpassiveÑ
1461space maintainers and other similar appliances and related dental
1470services. Those allegations did not constitute the ÐclaimÑ in
1479DOHÓs Amended Administrative Complaint. DO HÓs claim was that
1488Dr. Aranda made deceptive, untrue, or fraudulent representations
1496in or related to the practice of dentistry in violation of
1507section 466.028(1)(l), Florida Statutes (2009), by
1513misrepresenting the nature of dental work she was providing to
1523Medicaid patients to make it appear that she was prescribing and
1534delivering non - orthodontic, passive appliances, which w as covered
1544by Medicaid, when she actually was prescribing and delivering
1553orthodontic, active appliances, which w as not covered by
1562Medic aid, after being warned by her supervisor not to do so.
1574Dr. Aranda did not prove that DOH knew or should have known that
1587its claim was not supported by the material facts necessary to
1598establish it.
160014. Subsection (4) provides a Ðsafe harborÑ for a party who
1611withdraws an unsupported claim or defense within 21 of service of
1622a motion for sanctions under section 57.105. The 21 - day safe
1634harbor is strictly enforced. See Dunkin' Donuts Franchised
1642Rests., LLC v. 330545 Donuts, Inc. , 27 So. 3d 711, 713 - 1 4 (Fla.
16574th DCA 2010); Montgomery v. Larmoyeux , 14 So. 3d 1067, 1072
1668(Fla. 4th DCA 2009); Anchor Towing, Inc. v. Fla. Dep't of
1679Transp. , 10 So. 3d 670, 672 (Fla. 3d DCA 2009). Dr. Aranda
1691cannot now change the focus of her section 57.105 motion for
1702sanction s from the allegations in DOHÓs Amended Administrative
1711Complaint referring to the billing of Medicaid for ÐpassiveÑ
1720space maintainers and other similar appliances and related dental
1729services, to the Amended Administrative ComplaintÓs actual claim
1737against h er.
174015. Even if the motion for sanctions served by Dr. Aranda
1751on February 11, 2016, addressed the actual claim in the Amended
1762Administrative Complaint, Dr. Aranda did not prove that DOH knew
1772or should have known that the actual claim was not suppor ted by
1785the material facts necessary to establish it. The actual claim
1795did not require proof that Medicaid was sent bills that specified
1806ÐpassiveÑ space maintainers and other similar non - orthodontic
1815appliances and services.
181816. Even if the actual claim w as that Medicaid was sent
1830fraudulent bills for ÐpassiveÑ space maintainers and other
1838similar non - orthodontic appliances and services, Dr. Aranda did
1848not prove that DOH knew or should have known that such a claim
1861would not have been supported by the materia l facts necessary to
1873establish it. The ÐencountersÑ billed via the Ðbill service
1882listsÑ were for the services identified in the Ðdental treatment
1892plans,Ñ which included references to space maintainers and
1901similar non - orthodontic appliances that were cover ed by Medicaid.
1912DISPOSITION
1913Based on the foregoing Findings of Fact and Conclusions of
1923Law, the petition for attorneyÓs fees and costs under section
193357.105 is dismissed.
