65THIS CAUSE came before the State of Florida, Agency for Health Care Administration

78the Agency") concerning the preliminary approval of Certificate of Need 10451 filed by Central

93Florida Health Services, LLC (" Central Florida") to establish a 100 bed general acute care hospital

110respectfully, with respect to District 7- 2

1171. On December 2, 2016, the Agency issued its decision regarding the preliminary

130approval of CON 10451.

1342. On December 23, 2016, Adventist Health System/ Sunbelt, Inc., d/ b/ a Florida

148Hospital (" Florida Hospital") filed a Petition for Formal Administrative Hearing challenging the

162Agency' s preliminary approval of Central Florida' s CON No. 10451.

1733. The Agency referred the Petition to the Division of Administrative Hearings and

186an Administrative Law Judge (" ALJ") was assigned.

1954. On July 12, 2017, Florida Hospital filed a Notice of Voluntary Dismissal

208voluntarily dismissing its Petition for Formal Hearing against Central Florida with prejudice.

2205. No other cases challenging are pending as to the approval of CON 10451 filed by

236Central Florida.

238It is therefore ORDERED:

242The approval of CON 10450 is UPHELD. The Agency shall issue CON 10451 to

256Central Florida.
