95STATEMENT OF THE CASE
99On February 23, 2017, Petitioners filed a Petition for
108B enefits Pursuant to Florida Statute Section 766.301 et seq.
118(Petition) with the Division of Administrative Hearings (DOAH)
126for a determination of compensability under the Florida Birth -
136Related Neurological Injury Compensation Plan (Plan). The
143Petition nam ed Natalie Leibensperger, D.O., as the physician
152providing obstetric services for the birth of James Breiner
161(James) on February 25, 2012, at Bayfront Health Spring Hill
171(Bayfront), in Spring Hill, Florida. 1 /
178DOAH served NICA with a copy of the Petition o n March 3,
1912017. Dr. Leibensperger and Bayfront were served with a copy of
202the Petition on or before March 8, 2017. On March 9, 2017,
214Hernando HMA, LLC , d/b/a Bayfront Health Spring Hill filed a
224Petition for Limited Intervention. Said petition was grant ed on
234March 16, 2017.
237On June 30, 2017, NICA filed its Response to Petition for
248Benefits, suggesting that the subject claim was not compensable
257and requesting a final hearing to address said issue. On July 3,
2692017, the undersigned issued an O rder direct ing the parties to
281confer and advise the undersigned, on or before July 18, 2017, as
293to the need for a hearing. Thereafter, Petitioners requested an
303extension of time to respond, and the extension was granted. On
314August 21, 2017, Petitioners filed a resp onse to the prior O rder
327indicating that a hearing would be needed to determine the issue
338of compensability.
340On October 10, 2017, Petitioners Ó counsel filed a motion for
351leave to withdraw as counsel, and an O rder granting the same and
364placing the case in abeyance was issued on October 24, 2017. On
376December 15, 2017, at PetitionersÓ request, the matter was
385continued in abeyance. The matter remained in abeyance, without
394opposition to allow Petitioners the opportunity to obtain new
403counsel.
404Following a tel ephonic status conference on February 23,
4132018, the undersigned issued an O rder whereby the matter was no
425longer in abeyance and ordering the parties to provide hearing
435dates on or before March 2, 2018. Ultimately, the matter was
446scheduled for final heari ng on June 6, 2018.
455On May 4, 2018, NICA filed its Motion for Summary Final
466Order, requesting that a summary final order be entered finding
476that the claim is not compensable because James did not sustain a
488Ðbirth - related neurological injuryÑ as that term is defined in
499section 766.302(2), Florida Statutes, and dismissing the
506Petition. Petitioners did not timely respond to said motion. On
516May 18, 2018, the undersigned issued an Order to Show Cause.
527Said order directed Petitioners to show cause, in writin g, on or
539before May 30, 2018, why NICAÓs Motion for Summary Final Order
550should not be granted. Petitioner s did not respond to the Order
562to Show Cause. As noted above, Intervenor did not file a
573response to NICAÓs motion.
577FINDINGS OF FACT
5801. James w as born on February 25, 2012, at Bayfront in
592Spring Hill, Florida.
5952. NICA retained Donald Willis, M.D., who is b oard -
606c ertified in obstetrics, gynecology, and maternal - fetal medicine,
616to review the medical records of Wendy Ramirez - Mendoza and James ,
628and opine as to whether there was an injury to his brain or
641spinal cord that occurred in the course of labor, delivery, or
652resuscitation in the immediate post - delivery period due to oxygen
663deprivation or mechanical injury.
6673. In Dr. WillisÓs fina l report, dated June 12, 2017, he
679concluded the following:
682In summary, the baby was delivered at term
690and was not depressed at birth. Apgar scores
698were 8/8. The baby was transferred to the
706newborn nursery with the mother. Episodes of
713cyanosis occurred in the nursery, followed
719intermittent twitching. Head Ultrasound was
724normal. CT and MRI did not suggest hypoxic
732brain injury. EEG was normal.
737There was no apparent obstetrical event that
744resulted in oxygen deprivation or mechanical
750injury to the brain or spinal cord .
7584. Attached to NICAÓs Motion for Summary Final Order is the
769affidavit of Dr. Willis, dated May 2, 2018. In his affidavit
780Dr. Willis affirms his prior reports and opines within a
790reasonable degree of medical probability that there was no
799obstetrical event that resulted in oxygen deprivation or
807mechanical injury to JamesÓs brain or spinal cord.
8155. NICA also retained Laufey Y. Sigurdardottir, M.D., who
824is board - c ertified in pediatrics, psychiatry, and neurology, to
835review the pertinent medical records, conduct and Independent
843Medical Examination (IME), and opine as to whether he suffers
853from a permanent and substantial mental and physical impairment
862as a result of a birth - related neurological injury.
872Dr. Sigurdardottir revie wed the available medical records,
880obtained a historical account from Petitioners, and conducted an
889IME of James on April 19, 2017.
8966. Dr. SiguradottirÓs affidavit, dated May 1, 2018,
904attached to NICAÓs Motion for Summary Final Order, provides, in
914part, as follows:
917Summary: James is a 5 yr old boy with motor
927and speech delay from birth. There is no
935documented fetal depression at birth, and FHR
942tracings from the onset of induction of labor
950fails to show heart rate decelerations.
956Respiratory distr ess after birth and ensuing
963hypotonia and feeding difficulties point to
969patientÓs difficulties to have apparent from
975birth but timing of insult is not found to
984correlate with active labor or delivery. His
991current status suggests moderate to severe
997neurolo gical deficits that are likely to be
1005lifelong. It is of note that limited records
1013were available for my review after patientÓs
1020transfer to ACH. If there are forwarded to
1028NICA I would be able to review them and make
1038appropriate adjustments to this IME.
1043James is found to have a permanent and
1051substantial physical impairment at this time.
1057He is found to have a permanent and
1065substantial language/cognitive impairment at
1069this time.
1071In review of available documents, although
1077having respiratory distress short ly after
1083birth, there is no clear acute hypoxic event
1091during labor and/or delivery, and fetal
1097hearth [sic] rate strips were benign. MRI
1104performed in the neonatal period, EEG
1110performed in the neonatal period did not
1117support an acute encephalopathy (per rep ort).
1124No laboratory evidence of multisystem hypoxic
1130changes were noted in post natal period.
1137The prognosis for full motor and mental
1144recovery is poor but his life expectancy is
1152full.
1153Due to absence of evidence of hypoxic event
1161during active labor, ab sence of secondary
1168findings supportive of a hypoxic
1173encephalopathy (MRI, laboratory or EEG), I do
1180not feel James should be included in the NICA
1189program.
11907. Dr. SigurdardottirÓs opinions contained in her affidavit
1198are within a reasonable degree of m edical probability.
12078. A review of the file reveals that no contrary evidence
1218was presented to refute the findings and opinions of Dr. Willis
1229and Dr. Sigurdardottir. Their unrefuted opinions are credited.
1237CONCLUSIONS OF LAW
12409. DOAH has jurisdict ion over the parties to and the
1251subject matter of these proceedings. §§ 766.301 - 766.316,
1260Fla. Stat.
126210. The Plan was established by the Legislature "for the
1272purpose of providing compensation, irrespective of fault, for
1280birth - related neurological injury claims" relating to births
1289occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
13001 1 . The injured infant, her or his personal representative,
1311parents, dependents, and next of kin may seek compensation under
1321the Plan by filing a claim for compen sation with DOAH.
1332§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
1340which administers the Plan, has "45 days from the date of service
1352of a complete claim . . . in which to file a response to the
1367petition and to submit relevant written informati on relating to
1377the issue of whether the injury is a birth - related neurological
1389injury." § 766.305(4), Fla. Stat.
139412. NICA has determined that Petitioners do not have a
1404claim that is compensable under the Plan and has filed an
1415unopposed Motion for Summa ry Final Order, requesting that an
1425order be entered finding that the claim is not compensable.
143513. In ruling on the motion, the administrative law judge
1445must make the following threshold determination based upon the
1454available evidence:
1456(a) Whether the in jury claimed is a birth -
1466related neurological injury. If the claimant
1472has demonstrated, to the satisfaction of the
1479administrative law judge, that the infant has
1486sustained a brain or spinal cord injury
1493caused by oxygen deprivation or mechanical
1499injury and t hat the infant was thereby
1507rendered permanently and substantially
1511mentally and physically impaired, a
1516rebuttable presumption shall arise that the
1522injury is a birth - related neurological injury
1530as defined in s. 766.303(2).
1535§ 766.309(1), Fla. Stat.
153914. T he term "birth - related neurological injury" is defined
1550in section 766.302(2) as follows:
"1555Birth - related neurological injury" means
1561injury to the brain or spinal cord of a live
1571infant weighing at least 2,500 grams for a
1580single gestation or, in the case of a
1588multiple gestation, a live infant weighing at
1595least 2,000 grams at birth caused by oxygen
1604deprivation or mechanical injury occurring in
1610the course of labor, delivery, or
1616resuscitation in the immediate postdelivery
1621period in a hospital, which renders the
1628infant permanently and substantially mentally
1633and physically impaired.
163615. The evidence establishes that James sustained an injury
1645that rendered him permanently and substantially mentally and
1653physically impaired. The unrefuted evidence, however,
1659establ ishes that there was not an injury to the brain or spinal
1672cord caused by oxygen deprivation or mechanical injury occurring
1681in the course of labor, delivery, or resuscitation in the
1691immediate post - delivery period. Thus, James did not sustain a
1702birth - relate d neurological injury a s defined in section
1713766.302(2) and, therefore, is not eligible for benefits under the
1723Plan.
1724CONCLUSION
1725Based on the foregoing Findings of Fact and Conclusions of
1735Law, it is ORDERED that the Petition is dismissed with prejudice.
