48This cause came on for consideration upon a Motion for

58Summary Final Order filed by Respondent, Florida Birth - Related

78STATEMENT OF THE CASE

82On February 24, 2016, Petitioners, Marion Haley Wilson and

91Leocadio Santiago Martinez, individually and as parents of

99Rosabella Grace Santiago Wilson (Rosabella), deceased , filed a

107Petition for Determination of Compensability of Injuries

114Pursuant to Florida Statute Section 766.301 et seq. (Petition)

123with the Division of Administrative Hearings (DOAH) for a

132determination of compensability under the Florida Birth - Related

141Neur ological Injury Compensation Plan (Plan). The Petition

149named Ricky Phillip Leff, M.D., as the physician providing

158obstetrical services at the delivery of Rosabella on April 29,

1682016, at Jackson Hospital (Jackson) in Marianna, Florida.

176Rosabella is deceas ed.

180DOAH served NICA with a copy of the Petition on March 3,

1922017. Ricky Phillip Leff, M.D., and Jackson were served with a

203copy of the Petition on March 7, 2017.

211On April 6, 2017, Respondent filed its Response to Petition

221for Benefits, suggesting tha t the subject claim is not

231compensable, and requesting that a hearing be scheduled to

240address such issue.

243On April 10, 2017, the undersigned entered an Order

252instructing the parties to confer and advise the undersigned in

262writing as to the need for a heari ng, if any, and if a hearing

277is needed, stating when they will be prepared to proceed to

288hearing, the issue(s) still in dispute, their estimate of the

298time required for hearing, and their choice of venue.

307On April 24, 2017, Respondent filed a Response to O rder

318entered on April 10, 2017, stating that both parties agreed that

329a hearing would not be necessary and that this claim may be

341resolved by a motion for summary final order. On May 3, 2017,

353NICA filed a Motion for Summary Final Order, asserting that

363Ros abella did not sustain a "birth - related neurological injury"

374as that term is defined in section 766.302(2), Florida Statutes.

384On that same date, Respondent filed several documents in support

394of its motion, including the Affidavit of Donald C.

403Willis, M.D. , and the autopsy report for Rosabella. The motion

413was served by email to Petitioners on May 3, 2017. As of the

426close of the applicable response period, Petitioners did not

435file a response to the motion. Accordingly, on May 16, 2017,

446the undersigned ente red an Order to Show Cause, giving

456Petitioners 10 days in which to show cause as to why the motion

469should not be granted. On May 26, 2017 , Petitioners filed a

480response to the Order to Show Cause, stating that ÐPetitioners

490have no objection to the Court gr anting the RespondentÓs Motion

501for Summary Final Judgment.Ñ

505FINDINGS OF FACT

5081 . On February 24, 2017, Petitioners filed a Petition for

519Benefits Pursuant to Florida Statute Section 766.301, et seq .

5292 . The child, Rosabella Wilson, was stillborn on April 29 ,

5402016, at Gulf Coast Medical Center after the mother was

550transferred there from Jackson in Marianna, Florida. The

558circumstances of RosabellaÓs labor and delivery are reflected in

567the medical records submitted by Petitioners along with the

576Petition.

5773 . I n order for a claim to be compensable under the Plan,

591the requisites set forth in s ection 766.309 must be met.

6024 . NICA retained Donald C. Willis, M.D. (Dr. Willis) , as

613its medical expert specializing in maternal - fetal medicine.

622Upon examination of the me dical records, Dr. Willis opined, in

633pertinent part:

635Autopsy stated this was a stillbirth.

641Neuropathologic diagnosis was Hypoxic

645Ischemic Encephalopathy (HIE). No birth

650defects were noted.

653* * *

656In summary, the mother was a poorly

663controlled Diabetic, admitted at 38 weeks

669gestational age for labor induction. An

675abnormal FHR tracing developed during labor

681and resulted in fetal demise.

686There was an obstetrical event that resulted

693in loss of oxygen to the baby's brain during

702labor which resulted in brain injury as

709diagnosed by Autopsy. Severity of the brain

716injury could not be determined. This was

723apparently not a live birth.

7285 . Further, in the Petition, Petitioners indicate that the

738child is deceased and that a birth certificate was never issued.

749Se e Petition, paras . 12 and 13. The autopsy report reviewed by

762Dr. Willis was included in the medical records provided by

772Petitioners with the Petition and indicates that the child was

782stillborn. Thus, the face of the Petition, the autopsy report ,

792and Dr. Willis' affidavit establish that the child was stillborn

802and was not a live birth.

808CONCLUSIONS OF LAW

8116 . The Division of Administrative Hearings has

819jurisdiction over the parties to and the subject matter of these

830proceedings. §§ 766.301 - 766.316, Fla. Stat.

8377 . The Plan was established by the Legislature "for the

848purpose of providing compensation, irrespective of fault, for

856birth - related neurological injury claims" relating to births

865occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

8768 . The injured infant, her or his personal representative,

886parents, dependents, and next of kin may seek compensation under

896the Plan by filing a claim for compensation with DOAH.

906§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

914which admin isters the Plan, has "45 days from the date of

926service of a complete claim . . . in which to file a response to

941the petition and to submit relevant written information relating

950to the issue of whether the injury is a birth - related

962neurological injury." § 766.305(4), Fla. Stat.

9689 . If NICA determines that the injury alleged in a claim

980is a compensable birth - related neurological injury, it may award

991compensation to the claimant, provided that the award is

1000approved by the administrative law judge to whom the claim has

1011been assigned. § 766.305(7), Fla. Stat. If, on the other hand,

1022NICA disputes the claim, as it has in the instant case, the

1034dispute must be resolved by the assigned administrative law

1043judge in accordance with the provisions of chapter 120, Flor ida

1054Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.

106210 . In discharging this responsibility, the administrative

1070law judge must make the following determination based upon the

1080available evidence:

1082(a) Whether the injury claimed is a birth -

1091related ne urological injury. If the

1097claimant has demonstrated, to the

1102satisfaction of the administrative law

1107judge, that the infant has sustained a brain

1115or spinal cord injury caused by oxygen

1122deprivation or mechanical injury and that

1128the infant was thereby rendere d permanently

1135and substantially mentally and physically

1140impaired, a rebuttable presumption shall

1145arise that the injury is a birth - related

1154neurological injury as defined in

1159s. 766.303(2).

1161(b) Whether obstetrical services were

1166delivered by a participating physician in

1172the course of labor, delivery, or

1178resuscitation in the immediate postdelivery

1183period in a hospital; or by a certified

1191nurse midwife in a teaching hospital

1197supervised by a participating physician in

1203the course of labor, delivery, or

1209resuscitat ion in the immediate postdelivery

1215period in a hospital.

1219§ 766.309(1), Fla. Stat. An award may be sustained only if the

1231administrative law judge concludes that the "infant has

1239sustained a birth - related neurological injury and that

1248obstetrical services we re delivered by a participating physician

1257at birth." § 766.31(1), Fla. Stat.

126311. The term "birth - related neurological injury" is

1272defined in section 766.302(2) as follows:

"1278Birth - related neurological injury" means

1284injury to the brain or spinal cord of a live

1294infant weighing at least 2,500 grams for a

1303single gestation or, in the case of a

1311multiple gestation, a live infant weighing

1317at least 2,000 grams at birth caused by

1326oxygen deprivation or mechanical injury

1331occurring in the course of labor, delivery,

1338or resuscitation in the immediate

1343postdelivery period in a hospital, which

1349renders the infant permanently and

1354substantially mentally and physically

1358impaired.

135912 . The evidence, which is not refuted by any contrary

1370expert opinions, established that Rosabell a was stillborn and

1379was not a live birth.

138413 . Pursuant to s ection 766.302(2), the definition of

"1394birth - related neurological injury" applies to live births only.

1404See also Univ . of Miami v. Klein , 603 So. 2d 651, 652 (Fla. 3d

1419DCA 1992) ("Under the first c lause of the above sentence it is

1433clear that the statute does not apply unless the infant is born

1445alive."). Thus, the instant claim does not meet the statutory

1456criteria, as a matter of law, for compensation under the NICA

1467Plan.

146814 . Therefore, Rosabella i s not eligible for benefits

1478under the Plan. §§ 766.302(2) and 766.309(1), Fla. Stat.

1487CONCLUSION

1488Based upon the foregoing Findings of Fact and Conclusions

1497of Law, it is ORDERED that the Petition filed by Petitioners,

1508Marion Haley Wilson and Leocadio Sa ntiago Martinez, individually

1517and as parents of Rosabella Grace Santiago Wilson, deceased, is

1527dismissed with prejudice.
