43THIS CAUSE concerns both a request for an informal hearing (" Request") and a

58Petition for Formal Hearing Involving Disputed Issues of Material Fact (" Petition") that

72Respondent filed with the Agency Clerk' s Office in response to the Agency for Health

87Care Administration' s (" Agency") October 11, 2016 Final Audit Report ( Exhibit A).

102The case was referred first for an informal hearing in October of 2016, and then

117for a formal hearing in March of 2017 after Respondent raised disputed issues of material

132fact while the matter was pending before an administrative law judge.

143On September 27, 2017, Respondent filed a Notice of Voluntary Dismissal with

155Prejudice ( Exhibit B), dismissing both the Request and the Petition.

166Based on the foregoing,

170IT IS THEREFORE ORDERED AND ADJUDGED THAT:

177Respondent' s Request and Petition are hereby dismissed with prejudice, and the

189Agency' s October 11, 2016 Final Audit Report is hereby upheld as final. The parties

204shall govern themselves accordingly.

208Unless payment has already been made, payment in the amount of $674,044.89 is

222now due from Respondent as a result of the agency action. Such payment shall be made

238in full within 30 days of the rendition of this Final Order unless other payment
