88STATEMENT OF THE ISSUE

92The issue is whether , pursuant to section 112.3173, Florida

101Statutes, Respondent has forfeited his rights and benefits under

110the City of Tampa General Employees Retirement Plan (Fund).

119PRELIMINARY STATEMENT

121By letter dated October 21, 2013, the Fund notified

130Respondent , a former emplo yee of the City of Tampa (City) and a

143vested participant in the Fund , that he had forfeited his rights

154and benefits under the Fund by reason of his admitted violation

165of the City's Personnel Manual in 201 1 . On April 24, 2017, t he

180matter was referred by th e Fund to DOAH to conduct a formal

193hearing.

194At the final hearing, t he Fund presented the testimony of

205two witness es . Fund Exhibits 8 through 1 4 were accepted in

218evidence. Respondent did not appear at the hearing.

226A one - volume T ra nscript of the hearing has been prepared .

240Proposed Findings of Fact and Conclusions of Law were filed by

251the Fund and have been considered in the preparation of this

262Recommended Order.

264FINDINGS OF FACT

2671. The Fund is a public retirement system as defined by

278Florida law and is charged with administering and managing a

288pension fund for employees of the City.

2952. Respondent was employed by the City from February 2,

3052000, until April 18, 2012 , when he was terminated . He worked

317in various positions, most recently as Acting Lead Sp ecialty

327Equipment Op erator i n the Solid Waste and Environmental Program

338Management/Quality Control program .

3423. By reason of his employment with the City, Respondent

352was enrolled in the pension plan administered by the F und and

364was a vested participant .

3694. On April 1 8 , 2012, the City terminated Respondent based

380on a violation of three items in the City's Personnel Manual :

392neglect of duty by using a City vehicle for an unauthorized

403purpose ; moral turpitude involving the violation of the City

412Code relat ing to use of public property; and moral turpitude by

424engaging in an illegal enterprise. The events leading to his

434termination are described below.

4385. On July 11, 2011, City of Tampa Detective DeGagne was

449investigating environmental crimes (illegal dumpi ng) in the East

458Tampa area. After being alerted that illegal dumping had

467occurred on a vacant lot in the Highland Pines neighborhood, and

478the debris was immediately picked up by a City vehicle,

488Detective DeGagne located the City truck involved. Because t he

498truck was under the supervision of Respondent, Detective DeGagne

507spoke to Respondent who initially explained that code

515enforcement had told him to pick up the debris. Because

525Respondent could not identify anyone in code enforcement who

534gave him that in struction , he was arrested .

5436. During a recorded interview with Detective DeGagne

551later that day , Respondent admitted that on at least two

561occasions, he was paid $40.00 to pick up the illegally - dumped

573debris as a favor to a friend. This conduct is a v iol ation of

588section 838.016(1), which makes it unlawful for a public

597employee to receive compensation for performing an illicit act.

6067. Based on his admission of guilt , the City terminated

616Respondent effective April 18, 2012.

621CONCLUSIONS OF LAW

6248 . By contr act with Respondent, DOAH has agreed, on

635request of the Fund, to assign Administrative Law Judges to

645conduct hearings and issue recommended orders in cases of this

655type.

6569 . In this proceeding, Petitioner asserts that Respondent

665has forfeited his rights an d benefits under the Fund pursuant to

677section 112.3173 by reason of his admission to accepting money

687for performing an illegal act. The City bears the burden of

698proving by a preponderance of the evidence that this allegation

708is true. Wilson v. Dep't of A dmin., Div. of Ret. , 538 So. 2d

722139, 142 (Fla. 4th DCA 1989) ; .

7291 0 . Respondent is a "public employee" within the meaning

740of the law. § 112.3173(2)(c), Fla. Stat. He is also a member

752of the City's retirement system . As such , Respondent is subject

763to the pension forfeiture provisions in s ection 112.3173( 3) .

774That provision provides as follows:

779(3) FORFEITURE. Î Any public officer or

786employee who is convicted of a specified

793offense committed prior to retirement, or

799whose office or employment is terminated by

806reason of his or her admitted commission ,

813aid, or abetment of a specified offense ,

820shall forfeit all rights and benefits under

827any public retirement system of which he is

835member, except for the return of his or her

844accumulated contributions as of the d ate of

852termination. (emphasis added) .

85611. The forfeiture statute defines a "specified offense"

864to include any felony under chapter 838, except two provisions

874not relevant here. See § 112.3173(2)(e)4., Fla. Stat.

88212. Unlawful compensation or reward for official behavior ,

890also known as bribery, is a felony covered by chapter 838.

901Section 838.016(1) makes it unlawful for a public employee to

911accept any money not authorized by law for the performance of an

923act that violates his public duty.

92913. The evi dence clearly establishes that Respondent

937violated section 838.016(1) by accepting money from a third

946party in exchange for using his position as the Acting Lead

957Specialty Equipment Operator for the City to transport and

966dispose of illegally - dumped debris. Therefore, Respondent has

975forfeited his retirement rights and benefits. § 112.3173(3),

983Fla. Stat .

986RECOMMENDATION

987Based on the foregoing Findings of Fact and Conclusions of

997Law, it is

1000RECOMMENDED that the City of Tampa General Employees

1008Retirement Fun d enter a final order determining that Respondent

1018has forfeited his rights and benefits in the pension fund.
