97STATEMENT OF THE ISSUE
101T he issue is whether Respondent has unlawfully
109discriminated against Petitioner on the basis of his national
118origin and in retaliation for his opposing discriminatory
126practices in connection with his rental of an apartment, in
136violation of the Florida Fair Housing Act, section 760.23(2),
145Florida Statutes .
148PRELIMINARY STATEMENT
150By a Housing Discrimination Complaint dated October 25,
1582016 (Complaint) , Petitioner claimed that he is Brazilian and
167resides at St. Monica Gardens, a n 84 - unit apartment complex in
180Miami Gardens owned by Respondent and managed by Catholic
189Housing Management. The Complaint alleges that the onsite
197property manager, Isabela Noriega, who is Cuban, treats Cuban
206residents preferentially over Petitioner on the basis of
214national origin. The Complaint alleges that Ms. Noriega
222dismisses Petitioner's complaints. In particular, the Complaint
229alleges that Ms. Noriega barred Petitioner from the building
238lunchroom and issued a notice of lease violation in
247September 2016 after Petitioner complained about the food
255handling and the presence of an unauthorized person in the
265lunchroom. The Complaint alleges without examples of
272retaliation for Petitioner's complaints about Ms. Noriega's
279allegedly discriminatory conduct.
282On March 31, 2017 , the Florida Commission on Human
291Relations (Commission) ente red a Notice of Determination ( No
301Cause ) .
304On May 1, 2017 , Petitioner filed a Petition for Relief
314asserting largely the same allegations contained in the Housing
323Disc rimination Complaint .
327At the hearing, Petitioner called one witness , him self,
336and offered into evidence 12 exhibits : Petitioner Exhibits 1 - 7
348and 9 - 13. Respondent called two witnes ses and offered into
360evidence five exhibits: Respondent Exhibits 1 - 3 and 5 - 6. All
373exhibits were admitted for all purposes except Respondent
381Exhibits 2 and 3, which were not admitted for the truth.
392The parties did not order a transcript. Respondent filed a
402proposed recommended order on July 13, 2017 .
410FINDINGS OF FACT
4131. Petitioner was born in Brazil. He resides in an
423apartment in St. Monica Gardens in Miami Gardens, Florida.
432St. Monica Gardens provides housing subsidized by the U.S.
441Department of Housing and Urban Development (HUD) for low -
451income, elderly residents .
4552. St . Monica Gardens is owned and operated by Respondent,
466which is a not - for - profit corporation, and managed by Catholic
479Housing Management , which is a management company owned by the
489Archdiocese of Miami, Inc. Catholic Housing Management manages
49717 bui ldings accommodating over 2500 persons from all over the
508world .
5103. Residents at St. Monica Gardens , including Petitioner,
518receive free lunches through the charitable offices of Catholic
527Charities of the Archdiocese of Miami, Inc. Petitioner has
536objecte d to the quality and operation of this free - food program.
549On one occasion, Petitioner complained that a food server used
559the s ame - colored gloves that are used to perform maintenance
571duties, and an unauthorized person was allowed to remain in the
582food - prep aration and - service areas. However, these complaints
593do not establish that Catholic Charities fails to serve
602St. Monica Gardens residents safe food , lawfully prepared.
6104. On September 16, 2016, Catholic Charities was
618conducting an annual verification a udit of residents at lunch
628that day. Petitioner angrily confronted a Catholic Charities
636food - service worker, demanding that he be given immediate access
647to his free lunch. Other residents, mostly Cuban, objected to
657Petitioner's behavior, although, on thi s record, their
665objections appear to be based on Petitioner's discourtesy, not
674national origin.
6765. Respondent conducted an informal investigation of the
684incident and issued a notice to Petitioner that this
693confrontational behavior was in violation of his lease. There
702is no evidence of any discrimination against Petitioner, nor is
712there any evidence that Respondent took any adverse action
721against Petitioner or his lease or occupancy of his apartment at
732St. Monica Gardens.
7356. Petitioner complained to HUD, but Respondent did not
744discriminate or take ad verse action against Petitioner for this
754complaint either.
756CONCLUSIONS OF LAW
7597 . DOAH has jurisdiction of the sub jec t matter.
770§§ 120.569 and 120.57(1) , Fl a. Stat. (2017 ).
7798 . Section 760.23 provides:
784(1) It is unlawful to refuse to . . . rent
795after the making of a bona fide offer, to
804refuse to negotiate for the . . . rental of,
814or otherwise to make unavailable or deny a
822dwelling to any person because of race,
829color, national origin, sex, handicap,
834familial status, or religion.
838(2) It is unlawful to discriminate against
845any person in the terms, conditions, or
852privileges of . . . rental of a dwelling, or
862in the provision of services or facilities
869in connection therewith, because of race,
875color, national ori gin, sex, handicap,
881familial status, or religion.
8859 . Petitioner bears the burden of proving the material
895allegations by a preponderance of the evidence. Herron v.
904Blackwell , 908 F.2d 864, 870 (11th Cir. 1990); § 120.57(1)(j).
91410. Section 760.23 is part of Florida's Fair Housing Act.
924§ 760.20. As the state counterpart to the Federal Fair Housing
935Act Amendments, the Florida act is construed consistently with
944federal law. Fair Hous. Ctr. of the Greater Palm Beaches, Inc.
955v. So noma Bay Cmty. Homeowners Ass'n , 141 F. Supp. 3d 1321, 1329
968n.1 (S.D. Fla. 2015) (citing Dornbach v. Holley , 854 So. 2d 211,
980213 (Fla. 2d DCA 2002)).
98511. On the present facts, a notice of a lease violation
996for a lunchroom disturbance created by a resident is not
1006discriminatory. Compare Soto v. City of West Chicago , 2010 U.S.
1016Dist. LEXIS 123195 (N.D. Ill. 2010) (enforcement of land - use
1027ordinances not discriminatory). Additionally, such a notice of
1035a lease violation appears to have had no consequence, so i t does
1048not constitute a denial of a dwelling within the meaning of
1059section 760.23(1) or alteration in the terms, conditions, or
1068privileges of the rental of a dwelling , or alteration of the
1079provision of services or facilities in connection with the
1088rental o f a dwelling, within the meaning of section 760.23(2).
1099RECOMMENDATION
1100It is
1102RECOMMENDED that the Florida Commission on Human Relations
1110enter a final order dismissing the Petitio n for Relief filed on
1122May 1, 2017 .
