40Intervenor moved to dismiss the rule challenge petition,
48arguing that Petitioner cannot challenge a proposed rule for
57what is not in the rule. The Administrative Law Judge denied
68the motion, rea soning that all agency action is subject to
79review by substantially affected persons, and Petitioner alleged
87it was substantially affected by the determination of the
96Florida Fish and Wildlife Conservation Commission not to
104establish a slow speed zone in t he Clam Bay system. A ruling
117was also made that PetitionerÓs claims w ere reviewable in a rule
129challenge proceeding. After further consideration, it is
136concluded that IntervenorÓs motion to dismiss was meritorious.
144Section 379.2431 (2) (n) , Florida Statute s, authorizes the
153Commission to designate by rule portions of state waters which
163manatees inhabit periodically . The statute also authorizes the
172Commission to adopt rules to regulate motorboat speed within
181such waters to protect manatees from collisions wi th motorboats.
191The statutory wording suggests a two - part process where, first,
202the Commission designates the waters and , second, the Commission
211adopts boating restrictions for these waters if determined to be
221necessary. However, the record shows that the Commission does
230not follow a two - step process. There is only one step: the
243Commission considers a waterbodyÓs use by manatees and
251motorboats and establishes boat restrictions in the waterbody by
260rule when the Commission determines the restrictions are
268n ecessary.
270Pursuant to the statute , the Commission adopted Florida
278Administrative Code Rule 68C - 22.001(2), which sets forth
287ÐstandardsÑ that the Commission shall use in Ðdetermining
295whether restrictions are necessary to protect manatees or
303manatee habitats Ñ in waterbodies that manatees inhabit
311periodically.
312Petitioner contends that, in excluding Clam Pass and Outer
321Clam Bay from proposed rule 68C - 22.023(2)(c), which identifies
331the waterbodies in Collier County in which a slow speed
341restriction will apply, the Commission did not use the best
351available information as mandated by s ection 379.2431 (2) .
361Petitioner also contends the Commission contravened this statute
369bec ause the Commission based its decision not to impose a slow
381speed restriction for the Clam Ba y system on factors that are
393not listed in the statute or in the CommissionÓs rules.
403Petitioner does not seek to remove any of the waterbodies that
414are included in the proposed rule where slow speed zones will be
426established to protect manatees.
430An admin istrative law judge Ðmay declare the proposed rule
440wholly or partly invalid.Ñ £ 120.56(2)(b), Fla. Stat. (2017).
449Here, there is no part of the proposed rule to declare invalid.
461It is not a proper remedy, and the Administrative Law Judge
472lacks legal auth ority, to undo the protection for manatees that
483the Commission established for several waterbodies in Collier
491County, when no objection has been raised regarding these
500waterbodies.
501The two grounds raised by Petitioner for invalidating the
510proposed rule -- t hat it is arbitrary and contravenes the law
522implemented Î - are not directed to anything appearing in the
533proposed rule. Nothing in the proposed rule is arbitrary and
543nothing contravenes the law implemented.
548Petitioner is challenging the validity of a decis ion made
558by the Commission in the rulemaking process, which is not
568mentioned, described, or materially shown in the proposed rule.
577This situation differs from one where a party requests that
587something be added to a proposed rule, the addition is not
598adopt ed by the agency, and the party seeks to demonstrate that
610the adopted provisions are invalid without the requested
618addition. Here, there is nothing in the proposed rule that is
629invalid due to the Clam Bay system not being included.
639No reported decisional law was found involving a similar
648scenario. If PetitionerÓs challenge is in the nature of a
658challenge to Commission action that determin ed the substantial
667interest of Petitioner, reviewable under section 120.569, or, as
676seems more likely, a matter that c an only be raised in a
689petition for rulemaking pursuant to section 120.54(7), it cannot
698be transformed into either by the Administrative Law Judge
707because the Commission would have original jurisdiction of such
716matters.
717Accordingly, it is
720ORDERED that th e rule challenge petition is DISMISSED.
