49This cause came on for consideration upon a Notice of
59Voluntary Dismissal Without Prejudice filed by Petitioners on
67April 10, 2018.
70STATEMENT OF THE CASE
74On May 12, 2017 , Petitioners filed a Petition for Benefits
84P ursuant to Florida Statute Section 766.301 et seq. , otherwise
94known as the Florida Birth - Related Neurological Injury
103Compensation Plan (the Plan).
107On January 3, 2018, Respondent file d a Notice of Non -
119Compensability and Request for Evidentiary Hearing on
126Compensability, asserting that Lucas Paula did not suffer an
135injury that is compensable under the Plan.
142By Notice dated March 22, 2018, this matter was set for
153final hearing on Octobe r 24, 2018.
160On April 2, 2018, Petitioners filed a Motion to Withdraw
170Hearing on the Issue of Compensability. In addition to the
180request that the scheduled hearing be cancelled, the motion
189included the statement that Ð[U]nder the principle of judicial
198eco nomy, Petitioners understand that once compensability is
206established, the items of expense to be awarded can often be
217determined by agreement of the parties without the necessity of
227an evidentiary hearing.Ñ This statement was confusing to both
236the undersi gned and to Respondent. On April 2, 2018, Respondent
247filed a Response to PetitionersÓ Motion to Withdraw Hearing on
257the Issue of Compensability, stating, inter alia:
2641. The Respondent is confused by the
271PetitionersÓ Motion to Withdraw Hearing on
277the Issu e of Compensability, and requests
284that the Petitioners either clarify their
290position, or the ALJ conduct a telephonic
297hearing to determine the intent of the
304Petitioners.
3052. Specifically, NICA has asserted that the
312Claim is not Compensable. The Petitione rs
319have previously contested this
323determination. If the Petitioners are
328intending to withdraw or dismiss their
334Petition, it is their right to do so. If
343the Petitioners do not dispute NICAÓs Motion
350for Summary Final Order determining that the
357Claim is not Compensable, then the
363Petitioners can so assert that position.
369However, if the Petitioners do want the
376Claim to be determined to be Compensable,
383then there must be a hearing on the issue of
393Compensability.
394As suggested by Respondent, a telephonic p re - hearing
404c onference was held on April 9, 2018 , in order to clarify the
417relief that Petitioners were seeking. During that p re - hearing
428c onference , Petitioner, Daniel Paula, unequivocally stated that
436it was PetitionersÓ intent to withdraw their Petition for
445B enefits and to abandon all claims against Respondent. The
455undersigned stated to Mr. Paula that, given the ambiguous nature
465of the Motion to Withdraw Hearing on the Issue of
475Compensability, it would be necessary for Petitioners to file a
485Notice of Voluntar y Dismissal in order for the file of the
497Division of Administrative Hearings to be closed.
504On April 10, 2018 , Petitioners filed a Notice of Voluntary
514Dismissal Without Prejudice, stating that Petitioners Ðhereby
521file this notice of voluntary dismissal of the above - styled
532cause without prejudice as to Defendant, Florida Birth - Related
542Neurological Injury Compensation Association.Ñ
546CONCLUSION
547Based on the foregoing, it is ORDERED that the Petition
557filed by Petitioners, Daniel Paula and Drausia Paula, on behal f
568of and as parent and natural guardian s of Lucas Paula, is
