48This cause came on for consideration upon an Unopposed

74(NICA), on August 13, 2018.

79STATEMENT OF THE CASE

83On May 3, 2017, Petitioner filed a Petition for Benefits

93Pursuant to Florida Statute Section 766.301 et seq. (Petition)

102with the Division of Administrative Hearings (DOAH) for a

111determination o f compensability under the Florida Birth - Related

121Neurological Injury Compensation Plan (Plan). The Petition named

129Ghulam Khan, M.D. , as the physician who provided obstetric

138services for the birth of Mariah Dixon (Mariah) on September 13,

1492013, at Baptist Medical Center South (Baptist) in Jacksonville,

158Florida.

159DOAH served Respondent with a copy of the Petition (via

169certified mail) on May 24, 2017. Baptist and Dr. Khan were

180served with a copy of the Petition (via certified mail) on

191May 24, 2017, and Jun e 11, 2017, respectively.

200On November 6, 2017, Respondent filed its Response to

209Petition for Benefits, suggesting that the subject claim was not

219compensable and requesting a hearing to address said issue. On

229November 17, 2017, the undersigned issued an Order requiring the

239parties to confer and advise whether a final hearing would be

250required. After receiving the partiesÓ responses, a hearing was

259scheduled for February 5, 2018. On January 17, 2018, Petitioner,

269now represented by counsel, filed a motion to continue the

279hearing. On January 22, 2018, the motion was granted and the

290hearing was rescheduled to May 8, 2018. On April 24, 2018,

301Petitioner filed an Unopposed Motion for Continuance of the Final

311Hearing. Said motion was granted.

316On June 21, 201 8, the parties filed a Joint Response to

328Order Granting Continuance, wherein the parties represented that

336ÐPetitioners have indicated that they do not intend to challenge

346NICAÓs position on compensability,Ñ and further represented that

355a hearing was not re quired. Following the undersignedÓs Order

365Requiring Response, issued August 3, 2018, Respondent filed the

374instant Unopposed Motion for Summary Final Order. Said motion

383requests that a summary final order be entered finding that the

394claim is not compensab le because Mariah did not sustain a Ðbirth -

407related neurological injuryÑ as that term is defined in

416section 766.302(2), Florida Statutes, and dismissing the

423Petition.

424FINDINGS OF FACT

4271. Mariah was born on September 13, 2013, at Baptist in

438Jacksonville, Florida.

4402. Respondent retained Donald Willis, M.D., an obstetrician

448specializing in maternal - fetal medicine, to review Mariah and her

459motherÓs medical records and opine as to whether there was an

470injury to MariahÓs brain or spinal cord that occurred i n the

482course of labor, delivery, or resuscitation in the immediate

491post - delivery period due to oxygen deprivation or mechanical

501injury.

5023. Attached to RespondentÓs Unopposed Motion for Summary

510Final Order is the affidavit of Dr. Willis, dated November 22 ,

5212017. In his affidavit, Dr. Willis opines, to a reasonable

531degree of medical probability, Ðthat there was no apparent

540obstetrical event that resulted in loss of oxygen or mechanical

550trauma to [MariahÓs] brain or spinal cord occurring in the course

561of la bor, delivery, or resuscitation in the postdelivery period.Ñ

5714. Respondent also retained Laufey Y. Sigurdardottir, M.D.,

579a pediatric neurologist, to review MariahÓs medical records,

587conduct an Independent Medical Examination (IME), and opine as to

597whether she suffers from a permanent and substantial mental and

607physical impairment as a result of a birth - related neurological

618injury. Dr. Sigurdardottir reviewed the available medical

625records, obtained a full historical account from MariahÓs

633parents, an d conducted an IME of Mariah on September 27, 2017.

6455. Dr. SigurdardottirÓs IME report provides, in part, as

654follows:

655Summary: Patient is a 4 - year - old girl with

666history of NICU admission after birth via

673C section. No clear evidence of neonatal

680e ncephalopathy, normal cord blood gas and

687Apgars. She has congenital ocular deformity

693with colobomas and a global developmental

699delay to include autistic features. Her

705pattern of delays in not typical for that

713seen after a hypoxic ischemic injury and MRI

721brain was normal.

724Result as to question 1: Mariah is found to

733have substantial delays in mental abilities

739but mild delays in motor abilities.

745Result as to question 2: In review of

753available documents, her impairment is not

759typical of a neurologic inj ury to the brain

768or spinal cord acquired due to oxygen

775deprivation or mechanical injury? [sic] No

781clear evidence is reviewed that suggests a

788hypoxic ischemic even during labor or

794delivery.

795Result as to question 3: The prognosis for

803full motor and mental recovery is poor and

811the life expectancy is normal.

816In light of evidence presented I believe

823Mariah does not fulfill criteria of a

830substantial mental and physical impairment at

836this time. I do not feel that Mariah should

845be included in the NICA program. . . .

8546. RespondentÓs Unopposed Motion for Summary Final Order

862also relies upon the attached affidavit of Dr. Sigurdardottir.

871In her affidavit, Dr. Sigurdardottir affirms the statements and

880opinions contained in her IME report, and opines, to a re asonable

892degree of medical probability, that Mariah did not suffer a

902birth - related neurological injury.

9077. A review of the file reveals no contrary evidence was

918presented to refute the findings and opinions of Dr. Willis and

929Dr. Sigurdardottir. Th eir unrefuted opinions are credited.

937CONCLUSIONS OF LAW

9408. DOAH has jurisdiction over the parties to and the

950subject matter of these proceedings. §§ 766.301 - 766.316,

959Fla. Stat.

9619. The Plan was established by the Legislature "for the

971purpose of provid ing compensation, irrespective of fault, for

980birth - related neurological injury claims" relating to births

989occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

100010. The injured infant, her or his personal representative,

1009parents, dependents, and next of kin may seek compensation under

1019the Plan by filing a claim for compensation with DOAH.

1029§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat.

1036Respondent, which administers the Plan, has "45 days from the

1046date of service of a complete claim . . . in which to file a

1061response to the petition and to submit relevant written

1070information relating to the issue of whether the injury is a

1081birth - related neurological injury." § 766.305(4), Fla. Stat.

109011. Respondent has determined that Petitioner does not have

1099a claim that is compensable under the Plan and has filed an

1111Unopposed Motion for Summary Final Order, requesting that an

1120order be entered finding that the claim is not compensable.

113012. In ruling on the motion, the administrative law judge

1140must make t he following determination based upon the available

1150evidence:

1151(a) Whether the injury claimed is a birth -

1160related neurological injury. If the claimant

1166has demonstrated, to the satisfaction of the

1173administrative law judge, that the infant has

1180sustained a br ain or spinal cord injury

1188caused by oxygen deprivation or mechanical

1194injury and that the infant was thereby

1201rendered permanently and substantially

1205mentally and physically impaired, a

1210rebuttable presumption shall arise that the

1216injury is a birth - related neu rological injury

1225as defined in s. 766.303(2).

1230(b) Whether obstetrical services were

1235delivered by a participating physician in the

1242course of labor, delivery, or resuscitation

1248in the immediate postdelivery period in a

1255hospital; . . . .

1260§ 766.309(1)(a), ( b), Fla. Stat.

126613. The term "birth - related neurological injury" is defined

1276in section 766.302(2) as follows:

"1281Birth - related neurological injury" means

1287injury to the brain or spinal cord of a live

1297infant weighing at least 2,500 grams for a

1306single gestat ion or, in the case of a

1315multiple gestation, a live infant weighing at

1322least 2,000 grams at birth caused by oxygen

1331deprivation or mechanical injury occurring in

1337the course of labor, delivery, or

1343resuscitation in the immediate postdelivery

1348period in a hospi tal, which renders the

1356infant permanently and substantially mentally

1361and physically impaired.

136414. The undisputed evidence establishes that there was not

1373an injury to MariahÓs brain or spinal cord caused by oxygen

1384deprivation or mechanical injury occurri ng in the course of

1394labor, delivery, or resuscitation in the immediate post - delivery

1404period in a hospital. The undisputed evidence further

1412establishes that she did not sustain a permanent and substantial

1422physical impairment as a result thereof.

142815. Hav ing concluded this threshold issue, the undersigned

1437need not determine whether Dr. Khan was a NICA participating

1447physician at the time of MariahÓs birth.

145416. The unrefuted evidence establishes that Mariah did not

1463sustain a birth - related neurological inj ury as defined in section

1475766.302(2) , and, therefore, is not eligible for benefits under

1484the Plan.

1486CONCLUSION

1487Based on the foregoing Findings of Fact and Conclusions of

1497Law, it is ORDERED that the Petition is dismissed with prejudice.
