186PRELIMINARY STATEMENT

188Respondent , Access Mental Solutions , LLC ( " Access " ) , is a

198provider of mental health targeted case management services

206( " TCM services" ) reimbursed under the Florida Medicaid program .

217The purpose of TCM services , as described in the Florida Medicaid

228Mental Health Targeted Case Management Handbook (the " Handbook " ) ,

237is to assist individuals (recipients) in gaining access to needed

247medical , social , educationa l , and other services . The primary

257goal of TCM services is to optimize the functioning of recipients

268who have complex needs by coordinating the provision of quality

278treatment and support services in the most efficient and

287effective manner . Significant to this appeal , the Handbook

296specifies that TCM services do not include " direct therapeutic ,

305medical or clinical services . " In order to be cert ified as a TCM

319for the adult mental health target group , an individual must have

330a bachelor ' s degree from an accre dited university and have a

" 343minimum of one year of full time or equivalent experience

353working with adults experiencing serious mental illness . " It is

363this work experience requirement which is the focus of this

373appeal .

375On January 4 , 2017 , Petitioner, Agen cy for Health Care

385Administration (the " Agency " or " AHCA " ) , issued a Final Audit

395Report ( " FAR " ) to Access reflecting that AHCA completed a review

407of claims for Medicaid reimbursement for dates of service during

417the period of January 1 , 2013 , through Decemb er 31 , 2014 .

429Pursuant to the FAR , MPI Case ID No . 2016 - 0006148 , AHCA sought

443repayment from Access in the amount of $738 , 890 . 52 as an alleged

457Medicaid overpayment for claims AHCA alleges in whole or in part

468are not covered by Medicaid , together with a fine and the costs

480of the audit . A post - FAR review of the claims has reduced the

495overpayment alleged by AHCA to $526 , 500 . 11 .

505The overpayment is based upon two types of allegedly non -

516covered claims: (1) claims for services provided by the d isputed

527e mployees whom AHCA determined did not have the requisite work

538experience; and (2) claims provided to specific recipients that

547AHCA determined were not covered for various reasons . Again , for

558purposes of this hearing , only the issue of employee eligibility

568was liti gated .

572AHCA analyzed a total of 24 of Access ' TCMs and determined

584that 11 had the requisite wo rk experience and 13 did not . Of

598the 13 , two employees were conceded by Access to be ineligible ,

609and another two employees deemed ineligible by AHCA had no claim s

621in the audit and , therefore , are not relevant to this proceeding .

633Th e nine remaining TCMs are the d isputed e mployees .

645On June 9 , 2017 , AHCA forwarded the request to DOAH . On

657September 14 , 2017 , Respondent filed its Agreed Motion to

666Bifurcate Final Hear ing , reciting that the parties were in

676agreement that the best use of judicial and the parties ' own

688resources was to first litigate the issue of whether certain

698employees of Respondent met the prior work experience requirement

707of the Florida Medicaid progr am necessary for one to provide TCM

719services . An Order Granting Motion to Bifurcate Hearing was

729entered on September 19 , 2017 , and an Amended Notice of Hearing

740set ting the matter for December 11 and 12 , 2017 , was filed the

753same date .

756On December 1 , 2017 , the parties submitted a Joint

765Prehearing Stipulation , including a statement of undisputed

772facts . To the extent that the stipulated facts are relevant , the

784facts are adopted and incorporated herein as necessary .

793The hearing commenced as scheduled on Decemb er 11 , 2017 .

804AHCA presented the testimony of: AHCA Administrator Robi

812Olmstead; Stephanie Gregie ; and the deposition testimony of

820Demian Laudisio . AHCA ' s E xhibits 1 through 16 , including

832subparts , were admitted . Access presented the testimony of:

841Marie ta Garcia de Porto and Denia Lazo - Santalla . Access '

854Exhibits 1 through 5 , 7 , and 8 , including subparts , were

864admitted .

866The four - volume Transcript was filed on January 29 and 31 ,

8782018 . Both parties timely submitted their proposed recommended

887orders , and e ach has been considered in the preparation of this

899Recommended Order .

902Except as otherwise indicated , citations to Florida Statutes

910or rules of the Florida Administrative Code refer to the versions

921in effect during the time in which the alleged overpayment s were

933made .

935FINDING S OF FACT

9391 . This case involves a Medicaid audit by AHCA of Access ,

951which relates to dates of service from January 1 , 2013 , through

962December 31 , 2014 ( " audit period " ) .

9702 . During the audit period , Access was an enrolled Medicaid

981provid er and had a valid Medicaid provider agreement with AHCA ,

992Medicaid Provider No . 004073400 .

9983 . As an enrolled Medicaid provider , Access was subject to

1009the duly - enacted federal and state statutes , regulations , rules ,

1019policy guidelines , and Medicaid handbook s incorporated by

1027reference into rule , which were in effect during the audit

1037period .

10394 . The AHCA Bureau of Medicaid Program Integrity ( " MPI " ) ,

1051pursuant to its statutory authority , conducted an audit of

1060Medicaid claims paid to Access for services to Medica id

1070recipients .

10725 . AHCA issued a n F AR dated January 4 , 2017 , MPI Case ID

1087No . 2016 - 0006148 , alleging that Access was overpaid $738 , 890 . 52

1101for certain services that in whole or in part are not covered by

1114Medicaid . In addition , the FAR informed Access that A HCA was

1126seeking to impose a fine of $147 , 778 . 11 as a sanction for

1140violation of Fl orida Admin istrative Code R ule 59G - 9 . 0 70(7)(e) and

1156costs pursuant to section 409 . 913(23) , Florida Statutes. The

1166overpayment and sanction amounts sought by AHCA were amended

1175p ost - FAR to $526 , 500 . 11 and $105 , 300 . 02 .

11906 . AHCA is designated as the single state agency authorized

1201to make payments for medical assistance and related services

1210under Title XIX of the Social Security Act . This program of

1222medical assistance is designated the " Medicaid Program . " See

1231§ 409 . 902 , Fla . Stat . AHCA has the responsibility for overseeing

1245and administering the Medicaid p rogram for the State of Florida ,

1256pursuant to section 409 . 913 .

12637 . The Handbook requires that , in order to be cert ified as

1276a TCM , an applicant must " have a minimum of one year of full time

1290or equivalent experience working with adults experiencing serious

1298mental illness . " The Handbook also requires , via the completion

1308and retention of Appendix H , that the provider certify that all

1319of the requirements to be a TCM have been met . Appendix H must

1333be signed by the p rovider a dministrator , the c ase m anager , and

1347the c ase m anager ' s s upervisor . There are no AHCA rules or any

1364agency guidance as to exactly what type of work experience with

1375thes e individuals is required .

13818 . TCM service s include things like coordinating

1390transportation services , obtaining medical records to give to a

1399provider or locating a new provider that may be closer to a

1411recipient ' s home , things that are not clinical in natur e , but

1424which are beyond a recipient ' s ability to do or his family ' s

1439ability to assist them with . In fact , Medicaid will not

1450reimburse mental health TCM services for the provision of direct

1460therapeutic , medical , or clinical services .

14669 . Significantly , the Handbook does not require a provider

1476to secure or maintain an applicant ' s resume , reference letters ,

1487or any particular documentation reflecting work history , nor does

1496it specify who must be contacted to verify prior employment or

1507indicate references need to be contacted at all . The one year of

1520experience does not have to come from an applicant ' s most recent

1533employer , or even one individual employer . AHCA provides no

1543webinars or training for providers on how to check the work

1554history of an applicant .

155910 . However , AHCA contends that a provider can not , in good

1571faith , certify a case manager without verifying that the employee

1581possessed the necessary experie nce with the target population .

1591AHCA ' s Audit Procedure

15961 1 . Robi Olmstead , an Agency Administrator ove r the

1607Practitioner Unit at the Bureau of MPI , testified regarding her

1617experience and her supervisory role in the audit of Access .

162812 . Ms . Olmstead explained that the instant case against

1639Access was opened based on " an analysis . . . f rom our data

1653detectio n unit identifying a high number of services billed and

1664high utilization by this provider of targeted mental health . . .

1676ca se management services . "

168113 . Ms . Olmstead opened the audit , and assigned the matter

1693to Stephanie Gregie , a Medicaid p rogram h ealth c are a nalyst , who

1707obtained a list of claims for 35 random recipients from AHCA ' s

1720cluster sample program . After the sample was obtained , AHCA then

1731requested the records of the sample recipients from Access .

174114 . Ms . Gregie requested detailed documentation from

1750Respondent via a Request for Records . The Request for Records

1761included Document Organizational Guidelines . The guidelines

1768requested that Access provide , inter alia , employment

1775applications and/or resumes and evidence of employment background

1783checks .

178515 . Ms . Gregie determined that the employees at issue all

1797met the regulatory educational requirement . However , she was

1806concerned that the TCMs in dispute lack ed the prerequisite

1816experience working with the target population .

182316 . Upon review of the r ecords provided by Access ,

1834Ms . Gregie was disturbed that some job titles listed on the

1846application s or resume s seemed inconsistent with listed job

1856duties . According to Ms . Gregie , the p rior work history of the

1870TCMs was not thoroughly " certified " because t he reference forms

1880completed by Access ' owner , Marieta Garcia de Porto , did not

1891identify the date s of employment , the name of the employer which

1903she contacted , the job title of the individual who verified past

1914employment , or additional details of the conve rsation . Further ,

1924t he reference checks generally seemed insufficient t o Ms . Gregie

1936because of her bel i e f that the best reference check is through a

1951former employers ' h uman r esources department rather than from

1962past supervisors or co - workers .

196917 . Ms . Greg ie was also suspicious of the veracity of the

1983reported work histories because several employees had reference

1991letters signed by different people but which were notarized by

2001the same individual . Some of the reference letters had similar ,

2012if not identical , language . Also , many of the employees

2022purportedly had their references checked the day before or the

2032day of hiring .

203618 . Due to her concerns regarding the certification s

2046provided by Access , Ms . Gr egie " did something we typically

2057wouldn ' t normally do , and that is I developed a verification

2069process in [an] attempt to determine whether the employees were ,

2079in fact -- did , in fact , have the re q uired experience , and I began

2094to document my own verifications of the employees ' work

2104experience with their prior employe rs . " Tr . 48/5 - 13 . Ms . Gregie

2120created a work sheet to document her attempts at employment

2130verification for the TCMs . Ms . Gregie requested additional

2140documentation from Access , which was provided , and she attempted

2149to verify those documents as well .

2156Access ' Response

215919 . Ms . Garcia , as the owner of Access , is also the

2172clinical director and the supervisor of its TCMs . Ms . Garcia ,

2184who is a Cuban immigrant , obtained her degree in psychology in

2195Cuba a nd her m aster ' s degree in the United States . She is a

2212licen sed mental health counselor . Ms . Garcia had a five - year

2226course of study in Cuba , which included a practicum every

2236semester working with a target ed mental health population and

2246required a thesis . However , her degree was equated to a

2257bachelor ' s degree in t he United States . In Cuba , to begin

2271working as a psychologist , a new graduate does not provide a

2282resume . They only provide a transcript and complete an

2292interview .

229420 . Ms . Garcia hired the TCMs for Access , whose work

2306histories are in di s pute . Ms . Garcia explained that the Handbook

2320does not provide any direction as to how to verify or document

2332the ve ri fi cation of prior work experience for TCMs . She used the

2347process used when she was first hired as a TCM in 2005 . She

2361asked each applicant for a resume or job application and three

2372letters of reference , which she maintained in their employment

2381files . Although the Handbook does not require reference letters

2391or notarization , she chose to ask that these letters be notarized

2402because when she immigrated to the U nited States , all of her

2414documents were required to be notarized . Ms . Ga r cia then

2427contacted the individuals who signed the letters to verify

2436employment .

243821 . The TCMs hired by Ms . Garcia were primarily doctors and

2451nurses from Cuba . It did not surprise he r that their resumes

2464looked similar because these people worked together in Cuba and

2474likely worked on crafting their resumes together because the use

2484of resumes is not common in the medical profession in Cuba .

2496Further , Ms . Garcia is not a lawyer or a nota ry , and it did not

2512cause her any concern that the same notary was used for reference

2524letters from different employers .

252922 . Additionally , three of the TCMs (A r ain Melgarejo ,

2540Sadaiky Morejon , and Andres Gutierrez) were referred to

2548Ms . Garcia by Yoandes Fuen tes , a medical doctor who was employed

2561by Access as a TCM . Dr . Fuentes previously supervised these TCMs

2574at a medical mission in Ven e zuela as part of a Cuban/Venezu e lan

2589program that exchanged the services of Cuban medical

2597professionals for Venezuelan oil . Dr . Fuentes , who was a trusted

2609Access employee , personally verified the one year or more

2618employment of these three TCMS with the adult mental health

2628population in Venezu e la . Both Ms . Morejon and Mr . Gutierrez were

2643medical doctors in Cuba . Ms . Morejon is also married to

2655Dr . Fuentes .

265923 . Based upon the applications/resumes and reference

2667letters submitted and verified by Ms . Garcia , she believed the

2678TCMs all had the requisite work experience and both the TCMs and

2690she certified this on Appendix H for each o f the nine TCMs in

2704dispute .

2706The Experience of the Disputed TCMs

2712a . Arian Melgarejo

271624 . As discussed above , Arian Melgarejo was referred to

2726Ms . Garcia by Dr . Fuentes . Mr . Melgarejo obtained a doctoral

2740degree in dental surgery in Cuba in 2007 . He is not licensed in

2754the United States as a dentist . This makes him subject to the

2767three - year work requirement applicable to TCM applicants without

2777a degree in a " human services " field .

278525 . Dr . Fuentes sup ervised Mr . Mel g arejo at the Vene zue l a n

2804medical m ission , C omprehensive Diagnostic Center

2811( " Comprehensive " ) , from October 2009 through May 2011 .

2821Comprehensive provided medical and mental health services to poor

2830people in rural areas of Venezuela .

283726 . Denia Lazo - Santalla , who is employed by Access as a TCM

2851superv isor , a lso testified regarding the work at Comprehensive .

2862As a medical doctor from Cuba , Ms . Lazo - Santalla also worked at

2876the mission and is familiar with its workload . Comprehensive has

2887locations in rural areas all over Venezuela . They are generally

2898th e sole providers of health care in these areas , so any of the

2912physicians or , in Mr . Melgarejo ' s case , a dentist , working there

2925would see a significant population of adults with serious mental

2935illnesses .

293727 . Mr . Me lgarejo ' s employment records include a ref erence

2951letter from Katia Avila Garcia , who acknowledged working with

2960Mr . Melgarejo at the mission . Mr . Melgarejo ' s resume also lists

2975two employment stints at Isidro de Armas Psychiatric Hospital

2984in Cuba from January 2000 through September 2002 , and from

2994S eptember 2007 through September 2009 . A printout of Isidro de

3006Armas Psychiatric Hospital on the InfoMED website shows that its

3016mission is providing specialized medical care (treatment and

3024rehabilitation) to chronic psychotic patients . Ms . Lazo - Santalla

3035t estified that , as a medical doctor in Havana , Cuba , she was

3047familiar with Isidro de Armas Psychiatric Hospital and that it is

3058a huge facility that provides all kinds of services , including

3068dental care , to psychiatric patients .

307428 . Ms . Gregie disputes that Mr . Melgarejo meets the three -

3088year experience requirement based upon her own " verification "

3096process . According to Ms . Gregie , dentists do not typically

3107provide mental health services . She contacted the practice

3116administrator at SOMA Medical Center ("SOM A") , which was

3127identified on Mr . M el garejo ' s resume as his last place of

3142employment . Mr . Melgarejo claims to have worked there as a

3154social worker , " [a]ssisting chronic patients who were diagnosed

3162with psychiatric illnesses to receive the proper treatment and

3171link them with outside recommended services . "

317829 . According to Ms . Gregie , she was told that SOMA does

3191not employ social workers and that Mr . Melgarej o never worked

3203there . However , even discounting the time alleged worked at

3213SOMA , Mr . Melgarejo's exp erience with adult mental health

3223patients was verified by Dr . Fuentes . Further , Ms . Gregie made

3236no effort to independently verify his employment at Comprehensive

3245or Isidro de Armas Psychiatric Hospital .

3252b . Sadaiky Morejon

325630 . Sadaiky Morejon was a medic al doctor in Cuba .

3268Ms. Morejon and Dr . Fuentes are husband and wife , and they worked

3281together in almost every place . This accounts for the similarity

3292in resumes . According to her resume , Ms . Morejon worked at the

3305mission in Venezuela , Comprehensive , fro m August 2007 through

3314May 2011 . As discussed herein , she worked with and was

3325supervised during part of this time by Dr . Fuentes , who referred

3337her to Ms . Garcia for employment . A reference letter from

3349Dr . Fuentes , dated February 22 , 2017 , provides extensi ve detail

3360of Ms . Morejon ' s work during her time at the mission in

3374Venezuela .

337631 . A ccording to her resume , Ms . Morejon also worked at

3389Psychiatric Clinic of Cinefuegos in Cuba from April 2007 to

3399August 2007 . A printout of the profile for Psychiatric Clinic of

3411Cienfuegos from the InfoMED website states that the hospital has

3421a mission of providing specialized medical care (treatment and

3430rehabilitation) for chronic psychotic patients .

343632 . Ms . More jon ' s resume lists her most recent employment

3450at Miami Communit y Health Center . Ms . Gregie was unable to

3463locate a business by that name . In case Ms . Morejon confused the

3477name with Miami Behavioral Health Center , now known as Banyan

3487Health Center ( " Banyan " ) , Ms . Gregie contacted Banyan but was

3499told that Ms . Morejon w as not employed there . However ,

3511Ms . Morejon ' s file includes a 2013 reference letter from her

3524former supervisor , Dr . Ernesto Fernandez , which reflects that she

3534worked for him at the address she listed as " Miami Community

3545Health Center . " Ms . Gregie discoun ted this reference because it

3557did not include the specific dates of employment or a detailed

3568description of job duties .

357333 . Further , Ms . Gregie noted that Ms . Morejon ' s resume is

" 3588highly similar " to that of Dr . Fuentes . She found it improbable

3601that they would have the same career path with the same

3612employers . Apparently , she did not account for the fact that

3623they are husband and wife . Nor did Ms . G r e gie attempt to verify

3640Ms . Morejon ' s employment in C uba or Venezuela .

3652c . Berto Mirabal Lope z

365834 . Berto M irabal Lopez obtained a bachelor ' s degree in

3671nursing from the University of Havana , Cuba , in 2009 . Mr . Lopez

3684worked as a charge nurse in the crisis stabilization unit at

3695Hospital Miguel Enriquez in Havana , Cuba , from December 2009

3704through April 2011 . One of his reference letters was from

3715Marleny Almeida dated October 12 , 2013 . After the FAR was

3726issued , Ms . Garcia contacted Ms . Almeida and told her that

3738Mr . Lopez was not approved in the Medicaid audit . Ms . Almeida

3752authored a second reference letter dated February 14 , 2017 , that

3762provided more specific detail of the work that Mr . Lopez did as a

3776nurse in the crisis stabilization unit at Miguel Enriquez

3785Hospital with the mentally ill .

379135 . Miguel Enriquez Hospital is a large hospital in Havana

3802with multi - spec ialties , including psychiatric and mental health

3812services . Mr . Lopez ' employment there satisfies th e one - year

3826work requirement .

38293 6 . Mr . Lopez ' resume also state s that he worked as a

3845me n tal health technician at Citrus Health Network from 2011 until

3857the ti me of his app lication . However , the Citrus H uman R esources

3872Department told Ms . Gregie they had no record of him working

3884there . She also found the three reference letters provided not

3895credible because they do not specify where these individuals

3904worked wit h Mr . Lo p ez , are similar in format , and , although

3918written on different dates , were all signed by the same notary on

3930the s ame date . Ms . Gregie did not attempt to verify Mr . Lopez '

3947employment in Cuba .

3951d . Isis Lopez

395537 . Isis Lopez was personally known to M s . Garcia prior to

3969Ms . Lopez ' hiring because they studied psychology together in

3980Cuba . They are also family friends . Ms . Lopez ' application

3993reflects that she worked at Cent ro de Orientacion y Atencion

4004Ps i cologica ( " COAP " ) at the University of Hav ana , Cub a from 2000

4020to 2008 . COAP is a center for psychological counseling .

4031Ms . Garcia was personally familiar with Ms . Lopez ' work

4043expe rience at COAP .

404838 . One of the reference letters is from Alain Abreau ,

4059verifying that Ms . Lopez worked as a c ounselor under h is

4072supervision at COAP from January 200 0 through March 2001 . Her

4084resume indicates she worked there from 2000 to 2008 , and

4094Mr . Abreau acknowledged that she continued to work there , but no

4106longer under his supervision .

411139 . Ms . Gregie attempted to speak wit h Mr . Abreau but

4125Mr . Abre a u hung up on her after she announced herself , and

4139despite immediately calling back , she was only able to leave a

4150voicemail requesting a return call , which did not occur .

416040 . Ms . Garcia knows Mr . Abreau personally because she

4172used to work with him at Miami Behavioral Health Center (now

4183called " Banyan " ) when she was employed as a TCM in 2005 . In

4197February 2017 , Ms . Garcia called Mr . Abreau and told him that

4210Ms . Lopez was not approved by Medicaid , and that i s why

4223Mr . Abre a u wrote the detailed reference letter .

423441 . Mr . Abreau was told b y Ms . Garcia that he would receive

4250a call from AHCA to verify , and he did . Mr . Abreau told

4264Ms . Garcia that the call broke off and , when Mr . Abreau called

4278the same number back , i t was a general line for AHCA and he did

4293not know who to ask for . Mr . Abreau did not get a voicemail from

4309Ms . Gregie .

431342 . According to Ms . Lopez ' resume , she worked from

4325August 2011 until August 2012 as a TCM at Miami Behavioral Health

4337Center . Ms . Gregie contacted Ana Marie Ro driguez in the Human

4350Resources Department at Banyan and was told that Ms . Lopez

4361actually only worked there for two months . Ms . Rodriguez signed

4373and returned a form confirming this . Ms . Gregie questions why

4385Ms . Lopez would make a misrepresentation about h er employment at

4397Banyan if she in fact already had the requisite experience from

4408her employment in Cuba .

441343 . Although it is understandable that these interaction s

4423with Mr . Abreau and Banyan would raise Ms . Gregie ' s suspicion , it

4438does not invalidate either Ms . Garcia ' s personal knowledge of

4450Ms . Lopez ' course of study and her work at COAP , or the letter

4465provided by Mr . Abreau , verifying more than a year of experience

4477working with the target population .

4483e . Elisa Alonso Knapp

448844 . Elisa Alonso Knapp has a bac helor ' s degree in

4501psychology and a master ' s degree in human resource management .

4513Her course of study in Cuba to obtain her psychology degree would

4525have included work experience with the target population .

453445 . Ms . Knapp ' s resume listed her most recent pla ce of

4560work there as including " case management assistance to adults and

4570elderly with chronic mental disorders . " Staffing agencies

4578generally do not provide direct mental health services . The

4588ot her positions on her resume are all human resource positions .

460046 . A c cess ' Employment Reference Check dated May 12 , 2014 ,

4613listed only three names , three telephone numbers , and three

4622different years of experience . Ms. Knapp listed Oscar Villegas

4632Flores as a reference . When Ms . Gregie spoke with Mr . Villegas

4646Flores , he admitted that Ms. Knapp was not a case manager and did

4659not provide TCM services .

466447 . Post - FAR , Access also offered a letter from Reinaldo

4676Carnota in support of Ms . Knapp ' s experience . The l etter stated

4691that Ms. Knapp worked as a psychotherapist at Sanatorio Los

4701Cocos , Santiago de las Vegas , Cuba , from July 1995 to

4711December 1997 . When Ms . Gregie spoke with Mr . Carnota , he was

4725unable to remember the name of the place of employment where he

4737w orked with Ms . Knapp and was " evasive . "

474748 . Ms . Knapp also provided reference letters from Emeterio

4758Santovenia , Lissett Nardo , and Ana - Elvy Hernandez Cordero .

4768According to Ms . Cordero , Ms . Knapp worked as a volunteer

4780psychologist from 2009 to 2010 at Doc ent Polyclinic in Havana ,

4791Cuba , working with elderly patients suffering psychiatric

4798disorders . Ms . Nardo stated that Ms . Knapp worked as a volunteer

4812at the Psychology College of Havana University assisting elderly

4821mental health patients in accessing servi ces .

482949 . Ms . Gregie did not contact these three additional

4840references . Ms . Knapp attested to her one year of required

4852experience o n the Appendix H form . Although it is clear that

4865Ms . Knapp did not have recent psychology experience , her training

4876and lett ers of reference reflect that she had worked with the

4888target population for at least one year .

4896f . Karen Cuellar

490050 . Karen Cuellar obtained a bachelor ' s degree in

4911psychology in Cuba . Her resume states that she worked at

4922Community House in Havana as a men tal health counsel o r from June

49362006 throu gh September 2008 . This is supported by a notarized

4948reference letter from Lissette Gallardo which state s that

4957Ms . Cuellar worked with adult s with severe mental disorders .

496951 . Ms . Cuellar ' s resume lists her most re cent employment

4983as the Chrysalis Center as a " targeted case manager . " However

4994when Ms . Gregie contacted Chrysalis Center she was told that they

5006do not employ case managers , they do not provide mental health

5017services , and that Ms . Cuellar was never employe d by them .

5030Although this deception places the validity of Ms . Cuellar ' s

5042resume in doubt , Ms . Gregie di d no t attempt to verify

5055Ms . Cuellar ' s employment with Community House which , standing

5066alone , meets the experience requirement .

5072g . Ana Sarai Llanes

507752 . Ana Sarai Llanes holds a m aster ' s degree in psychology

5091from Cuba . According to Ms . Garcia , Ms . Llanes ' course of study

5106required a practicum that m e et s the requirements of working with

5119the target population . Ms . Garcia also indicated she personally

5130knew Ms . Llanes .

513553 . Ms . Llanes ' resume listed her last " Experience " as

5147volunteer community work for Sion Baptist Church . The resume

5157further cited this as case management work , including

" 5165[a]ssisting elderly and adults to access community resources . "

5174Ms . Gre gie determined Ms . Llanes was ineligible as she was unable

5188to locate the Sion Baptist Church in her research . She also

5200testified that in her experience , she never heard of voluntary

5210case management services or professional mental health services

5218being pro vided at a church . She further stated that the services

5231listed on the resume , such as " DCF , LIHEAP , Logisticare , and

5241housing applications " are the exact services Respondent provides

5249to all recipients which led her to conclude this experience was

5260fabricate d .

526354 . Post - FAR , Access offered a letter of reference from

5275Moriama Alfonso . Ms . Garcia personally knows Ms . Alfonso , who

5287was Ms. Llanes ' supervisor at COAP in Havana .

529755 . Ms . Gregie spoke with Ms . Alfonso via an interpreter

5310and determined the letter was non - credible because Ms . Alfonso

5322could not remember the name of the employer where she worked with

5334Ms . Llanes . Ms . Gregie also determined , based upon her own

5347experience in the mental health field , that Ms . Alfonso ' s

5359statement that Ms . Llanes provided eig ht hours per day of direct

5372mental health counseling was not plausible . Ms . Gregie also

5383assumed that COAP was a " cultural center " and did not provide

5394mental health services . However , Ms . Gregie did not attempt to

5406contact COAP or the other references provi ded by Ms . Llanes

5418regarding her volunteer work with the mentally ill for the

" 5428ZunZun " project in Cuba which would provide more than a year of

5440working with the targeted population .

5446h . Il ineis Gonz a lez Torres

545456 . Ilineis Gonzalez Torres has a d octor of m ed icine degree

5468from Cuba . In order to obtain her degree , Mr . Torres would have

5482completed a six - month work training program in psychiatry .

549357 . Ms . Garcia bel i e ved Ms . Torres was qualified based on

5509her work as a general doctor at Policlinic " Victoria de Giro n " in

5522Havana , Cuba , from 200 7 to 2010 . " Policlinics " in Cuba are

5534multidisciplinary facilities that include mental health services .

5542A web - profile of Policlinic Victoria de Giron from the InfoMed

5554confirms that mental health services are included .

556258 . Ms . Garcia also reached out to Dr . Soto for a letter of

5578reference . Dr . Soto verified that she worked with Ms . Gonzalez

5591part - time for a year on a clinical trial regarding patients

5603taking anti - depressants .

56085 9 . Ms . Torres also worked from 2004 to 2006 at the CO AP

5624center as evidenced by her resume and the reference letter from

5635Idania Garcia B arrios . This is the same facil ity that Ms. Lopez

5649worked at .

565260 . Ms . Gregie contacted Ms . Torres' most recently listed

5664employer , Med - Care . Ms . Gregie was told that Ms . T orres worked

5680there as a medical assistant rather than as a " social worker , "

5691which is listed on her resume . Ms . Gregie researched Med - Care

5705on - line and determined it provided medical services to the

5716general public , not mental health or TCM services . Ms . Gr egie

5729did not attempt to verify Ms . Torres ' work in Cuba .

5742i . Andres Gutierrez

57466 1 . Andres Gutierrez is a medical doctor from Cuba who was

5759referred to Access by Dr . Fuentes . His medical training would

5771have included a six - month work program in psychiatry wi th the

5784target population .

57876 2 . From 2006 through 2012 , Mr . Gutierrez worked at

5799Comprehensive . According to Ms . Gregie , there is nothing to

5810verify this employment or that it complies with the one year of

5822full - time or equivalent experience working with adul ts

5832experiencing serious mental illness . However , his employment in

5841Venezuela working with patients with mental illness was verified

5850by Dr . Fuentes .

58556 3 . Dr . DeLeon is listed as Mr . Gutierrez ' supervisor at

5870Miami Beach Medical Group . He provided a letter of reference for

5882Mr . Gutierrez . Ms. Gregie contacted the Human Resources

5892Department at Miami Beach Medical Group and was told that

5902Mr. Gutierrez was not a "case worker" but rather in Quality

5913Assurance where he reviewed medical records. Also , the date s of

5924employment were different than listed on the resume . On this

5935basis , Ms . Gregie decided Mr . Gutierrez ' resume was fraudulent .

59486 4 . Ms . Gregie did not contact Dr . DeL eon or the other

5964individuals who provided Mr . Gutierrez with a letter of

5974reference .

5976CONCLU SIONS OF LAW

59806 5 . The Division of Administrative Hearings has

5989jurisdiction over the parties to and the subject matter of this

6000proceeding . §§ 120 . 569 and 120 . 57 , Fla . Stat . (201 7 ) .

60186 6 . The burden of proof is on Petitioner to prove the

6031material allegations by a preponderance of the evidence . See

6041e . g . , S . Med . Servs ., Inc . v . Ag . for Health Care Admin . , 653 So .

60652d 440 , 441 (Fla . 3d DCA 1995); Southpointe Pharm . v . Dep ' t of

6082HRS , 596 So . 2d 106 , 109 (Fla . 1st DCA 1992) .

60956 7 . AHCA is authorized to impose sanct ions on a provider ,

6108including administrative fines . § 409 . 913(16) , Fla . Stat . To

6121impose an administrative fine , AHCA must establish by clear and

6131convincing evidence the factual grounds for doing so . Dep ' t of

6144Banking & Fin ., Div . of Sec . & Investor Prot . v . Osborne Stern &

6162Co . , 670 So . 2d 932 , 935 (Fla . 1996); Dep ' t of Child . & Fams . v .

6184Davis Fam . Day Care Home , 160 So . 3d 854 , 857 (Fla . 2015) .

62006 8 . Section 409 . 913(11) provides the following:

6210The agency shall deny payment or require

6217repayment for inappro priate , medically

6222unnecessary , or excessive goods or services

6228from the person furnishing them , the person

6235under whose supervision they were furnished ,

6241or the person causing them to be furnished .

62506 9 . AHCA contends that any services provided by these nine

6262TCMs in dispute are " inappropr i ate " because these individuals did

6273not meet the experience requirement to provide TCM services .

628370 . However , AHCA did not prove by a preponderance of the

6295evidence that these TCMs , who all certified they met the

6305experience re quirement , and provided back up documentation of the

6315same , were not qualified .

63207 1 . Ms . Gregie ' s inquiries were primarily of the most

6334recent employers listed in the U nited S tates by the TCMs . By her

6349own admission , h er " investigation " was out of the ordina ry and

6361not consistent with any guidelines . Ms . Gregie completely

6371discounted the personal knowledge that Ms . Garcia and Dr . Fuentes

6383had of these individuals and their experience . She did not make

6395any efforts to contact employers in Venezuela and Cuba and made

6406generalized assumptions that these workers did not work for a

6416year or its full - time equivalent with the target population ,

6427contrary to their certifications on Appendix H .

64357 2 . Ms . Gregie placed great weight on the fact that many of

6450the letters of refe rence were notarized by the same individual ,

6461even though they purported to be written by many different

6471supervisors . However , Access was not required by AHCA regulation

6481to obtain notarized letters . Ms . Gregie also found the reference

6493che c ks conducted by Ms . Garcia to be suspect because often they

6507were performed the day before , the day of , or the day after

6519hiring . As explained by Ms . Garcia , it is not unusual for a

6533small business such as Access to verify references at or near the

6545time of hiring .

65497 3 . Whil e certainly the discrepancies of the recent

6560employment histories discovered by Ms . Gregie are concerning and

6570suggest , at best , a pattern of cursory employment checks by

6580Access , they can also be explained by the passage of time since

6592the references were che cked by Ms . Garcia , the fact that

6604Ms . Gregie contacted h uman r esources departments rather than the

6616supervisors contacted by Ms . Garcia , some of the businesses are

6627no longer operating , there may have been a language barrier , and

6638she did not check the employ ment references in C uba or Venezu e la .

66547 4 . If AHCA published standards requiring notarized letters

6664of reference , or any other mandatory form of employment history

6674and experience verification , the issues identified by M s . Gregie

6685could serve as a basis to cl aim that payment s to Access for TCM

6700services were " inappropriate . " However , given the complete lack

6709of direction to healthcare providers regarding what documentation

6717is needed to verify the experience requirement for TCMs , there is

6728no basis here to claim over payments .

67367 5 . The Handbook only requires , via the completion and

6747retention of Appendix H , that the provider certify that all of

6758the requirements to be a TCM have been met . This was , in fact ,

6772done for each of the nine workers in dispute . Ms . Garcia ' s

6787testimony was credible that she verified the workers ' experience

6797with the target population prior to or at the time of hiring .

6810Further , their resumes and letters of reference support the

6819conclusion that at the time of application , each TCM had " a

6830minimum of one year of full time or equivalent experience working

6841with adults experiencing serious mental illness . "

6848RECOMMENDATION

6849Based on the foregoing Findings of Fact and Conclusions of

6859Law , it is RECOMMENDED that the Agency for Health Care

6869Administration ent er a final order incorporating the terms of

6879this Recommended Order as follows:

68841 . All of the d isputed e mployees shall be allowed , and no

6898Medicaid overpayments shall be based on their failure to have the

6909requisite work experience .

69132 . Petitioner will not apply an administrative sanction

6922against Respondent .

69253 . Because AHCA is not the prevailing party in this action ,

6937it shall not be entitled to recover any of its costs .
