100STATEMENT OF THE ISSUES
104The issue in this case is whether Ailani Sanchez suffe red a
116birth - related injury as defined by section 766.302(2) , Florida
126Statute s, for which compensation should be awarded under the
136Florida Birth - Related Neurological Injury Compensation Plan (the
145Plan).
146PRELIMINARY STATEMENT
148On June 14, 2017, Michele Sanche z and Fidel Sanchez
158(Petitioners), on behalf of and as natural guardians of Ailani
168Sanchez (Ailani), filed a Petition for Benefits (claim) with the
178Division of Administrative Hearings (DOAH) alleging that Ailani
186suffered brain damage as a result of a birth - related
197neurological injury and requesting relief available under the
205Plan.
206The Petition na med Carl Zollicoffer, M.D.
213(Dr. Zollicoffer) , as the physician who provided obstetrical
221services for the birth of Ailani on October 29, 2015, at
232Lakeland Regional M edical Center (Lakeland Regional) in
240Lakeland, Florida.
242On June 27, 2017, DOAH mailed a copy of the Petition to the
255Florida Birth - Related Neurological Injury Compensation
262Association ( NICA ) , with copies to Dr. Zollicoffer and Lakeland
273Regional , by certifie d mail. The certified receipts indicate
282that the same was received by NICA on June 30, 2017; by Dr.
295Zollicoffer on June 29, 2017; and by Lakeland Regional on July
30612, 2017. On July 24, 2017, the undersigned granted Lakeland
316Regional's Petition to Interve ne. On October 11, 2017, the
326undersigned granted Dr. Zollicoffer's Petit ion to Intervene. On
335September 17, 2018, the undersigned granted Lakeland Regional's
343Motion to Withdraw its Petition to Intervene.
350On November 13, 2017, NICA responded to the Petitio n for
361Benefits, suggesting that the subject claim was not compensable
370because Ailani had not suffered a birth - related neurological
380injury and requesting a final hearing to address said issue.
390NICA filed a Motion for Summary Final Order on December 29,
4012017 , which was denied by Order dated June 25, 2018 , because
412Petitioners asserted both in their Petition and in their
421Response to the undersigned's Order to Show Cause (as to why the
433Motion for Summary Final Order should not be granted) that
443Ailani suffered a birth - related neurological injury.
451By Order dated September 21, 2018, this tribu nal granted
461the parties' Joint Motion to Submit Stipulated Factual Record in
471Lieu of a Contested Hearing. Dr. Zollicoffer takes no position
481on the issue of compensability. Th e undersigned's Order of
491September 21, 2018 , directed the parties to submit their
500stipulated record no later than September 28, 2018 , and any
510written arguments and/or proposed final orders no later than
519October 5, 2018.
522NICA and Dr. Zollicoffer filed a Joi nt Stipulation on
532September 17, 2018 , establishing their agreement that at the
541time of the birth of Ailani, Dr. Zollicoffer was a NICA
552participating physician. The parties' Joint Stipulation
558regarding Stipulated Record was filed on September 27, 2018.
567Th e parties' Stipulated Record, consisting of Joint Exhibits A
577through H, and NICA Ós Exhibits A through D, w ere timely filed on
591September 28, 2018. The stipulated evidence includes, inter
599alia , AilaniÓs medical records and the written reports of
608two NICA co nsulting physician s, Dr. Donald G. Willis and
619Dr. Laufey Sigurdardottir.
622Each party timely filed written argument and/or a proposed
631final order, which have been carefully considered in the
640preparation of this Final Order.
645FINDINGS OF FACT
6481 . Ailani Sanche z was born a live infant at 5:46 a.m. , on
662October 29, 2015 , at Lakeland Regional Medical Center.
6702 . Ailani was a single gestation, weighing 2,950 grams at
682birth.
6833 . Ailani was delivered via cesarean section for suspected
693abruption/velamentous insertion o f cord by Dr. Zollicoffer who
702was a NICA participating physician on October 29, 2015.
7114 . Ailani's Apgar scores were 2/4/4. Upon delivery , she
721was floppy and pale and had no respiratory effort. Pulse
731oximetry was within target saturations for age and her heart
741rate remained 100 or greater. She was intubated at seven
751minutes of age and transferred to the Neonatal Intensive Care
761Unit ( NICU ) . No seizures were noted. Ailani had increasing
773spontaneous respiratory effort and whole body cooling was
781started pr ior to her transfer to St. Joseph's Hospital NICU on
793October 29, 2015.
7965 . Upon admission to St. Joseph's Hospital on October 29,
8072015, Ailani was lethargic with decreased reactions to stimuli ,
816but appeared pink and well perfused. Neurologically, she was
825noted to be improving; she was breathing spontaneously and
834moving all extremities to stimuli.
8396 . After a complicated newborn hospital course , Ailani was
849ultimately discharged from St. Joseph's Hospital on January 6,
8582016. At the time of her discharge, sh e was noted to be feeding
872by mouth and was overall gaining weight. Prior to her
882discharge, an EEG on October 30, 2015 , showed seizures
891predominantly on the right side of her brain and generalized
901brain dysfunction. A brain MRI obtained on November 5, 201 5 ,
912revealed restricted diffusion related to acute infarction in the
921right temporal occipital region with laminar necrosis.
928Additional laminar necrosis in the frontal lobes and insular
937cortex bilaterally was noted. An EEG on November 16, 2015 , was
948consist ent with nonspecific cerebral dysfunction with occasional
956sharp waves in the temporal parietal regions bilaterally with no
966evidence of seizures and irregular slow waves with slightly more
976predominance to the right.
9807 . Ailani was seen for a newborn visit b y her
992pediatrician, Dr. Bou Salvador , on January 7, 2016.
1000Nutritionally, she was noted to be breast feeding adequately ,
1009with supplements with formula. Developmentally, she was noted
1017to have equal movements of all extremities and follow midline.
1027She resp onded to a bell and was able to lift her head while
1041lying on her stomach. Examination of her spine, extremities ,
1050and peripheral pulses were all normal. Neurologically, she was
1059reportedly normal , with normal strength, tone , and reflexes
1067reported.
10688 . On J anuary 19, 2016, Ailani was evaluated at All
1080Children's Outpatient Care upon referral by St. Joseph's
1088Hospital secondary to hypoxic ischemia. The occupational
1095therapist's impression included decreased bilateral
1100coordination, decreased developmental milest ones, decreased
1106gross motor skills, decreased play skills, decreased strength,
1114and fine motor deficits. Skilled therapy was identified to have
1124the potential to improve her functional level in the areas of
1135manipulation. It was recommended that Ailani unde rgo 30 minutes
1145of occupational therapy once a week for six months. Her
1155prognosis for achieving goals established by her therapist was
1164noted to be excellent. On February 4, 2016, Ailani was
1174evaluated for participation in , and deemed eligible for , the
1183Earl y Steps Program.
11879 . On February 18, 20 16, Ailani was evaluated by
1198Dr. Qureshi at Kids Neurology. Developmentally, she was noted
1207to smile and coo and focus. It was noted that Ailani had three
1220seizures at the age of one day old , b ut none since. At this
1234t ime, she was taking Keppra and Phenobarbital , from which she
1245was being weaned. A sleep deprived EEG , obtained since the last
1256visit , was normal. She was noted to be doing very well
1267neurologically. Her physical examination revealed she was
1274lifting her che st and head with her arms extended. Early head
1286control with bobbing motion was noted. She was noted to say
"1297aah , " smile, and follow pass midline. The plan noted at this
1308time was to continue to wean and discontinue Keppra and
1318Phenobarbital.
131910 . Ailani w as again seen by Dr. Bou Salvador on March 4,
13332016 , for her four - month well visit. Nutritionally, she was
1344noted to be feeding with formula adequately. She had been
1354started on solids for one to two feeds. Developmentally , she
1364was noted to squeal and lau g h. She was able to follow
1377180 degrees. She turned to void and was able to hold her head
1390up 90 degrees while lying on her stomach. She was able to sit
1403with support with her head up. She was able to pull to sit with
1417no head lag. She could bring her hand s together and had no
1430persistent fist clenching. Her physical examination was normal.
1438Her neurological examination was also normal , with normal
1446strength, tone , and reflexes reported.
145111 . Ailani was again seen by Dr. Bou Salvador on May 4,
14642016 , for her six - month well visit. Nutritionally, she was
1475noted to be breast feeding adequately. Developmentally , she was
1484noted to be social and smiling responsively. Adaptive equal
1493movements of all extremities and the ability to follow midline
1503were noted. She coul d respond to a bell and was able to lift
1517her head while lying on her stomach. A physical examination was
1528normal. A neurological examination was also normal , with normal
1537strength, tone , and reflexes reported.
154212 . On May 24, 2016, Ailani returned to Dr. Qureshi at
1554Kids Neurology. It was noted that Ailani had been weaned from
1565her seizure medication and had had no seizures for the last
1576three month s . She was noted to be doing very well
1588neurologically. Physically and developmentally, she was noted
1595to have no head lag, to be rolling over, to have her chest up in
1610a prone position, to be trying to crawl, to be lifting her head ,
1623and to be sitting briefly unsupported. She was also noted to be
1635leaning forward on her hands, engaging in bounce activity,
1644supporting most of her weight, reaching out and grasping large
1654objects, transferring from hand to hand, babbling, enjoying
1662mirror, and using polysyllable sounds. She was noted to be
1672feeding herself. Dr. Qureshi reported that Ailani was in
1681occupation therapy but th at it was on hold since her evaluation
1693was "pretty unremarkable . " Ailani was noted to be progressing
1703well for her age and was receiving Early Steps intervention once
1714a week at home. She was given a prescription of Phenobarbital
1725for use only if a seizure occurred.
173213 . On June 18, 2016, Ailani was seen by Dr. Frances
1744Arrillaga at Pediatric Cardiology Associates for a cardiology
1752consultation secondary to a history of pulmonary hypertension ,
1760and an echocardiogram that showed a patent foramen ova le ( PFO ) .
1774Ai lani's mother reported th at since her discharge from
1784St. Joseph's , she was doing well. Cyanosis, difficulty
1792breathing and unexplained diaphoresis and feeding problems , were
1800denied. An echocardiogram on this date showed a PFO , with
1810otherwise normal anatom y. There were normal right ventricular
1819( RV ) pressures, normal left ventricular ( LV ) size and function.
1832No cardiovascular restrictions were given and she was told to
1842return in one year for further follow up.
185014 . Ailani was again seen by Dr. Bou Salvador on August 4,
18632016 , for her nine - month well visit. Nutritionally, she was
1874reported to be feeding adequately. She was feeding 2 to 3
1885varieties of solid foods with no problems and was starting with
1896a cup for water and juice. Developmentally, she was report ed to
1908be playing pat - a - cake and looking for fallen objects. She could
1922bang two cubes in her hand with thumb - finger grasp. She could
1935say "dada" and "mama" and walk while holding on. She was also
1947noted to be crawling and standing momentarily. Her physica l and
1958neurological examinations were noted to be normal , with normal
1967strength, tone , and reflexes noted.
197215 . An August 22, 2016 , a progress note from Early
1983Intervention reflects that Ailani was babbling two syllables
1991together, was happy, pulling to a stan d and cruising along
2002furniture , and was responding to her name. Attendance at Early
2012Intervention was noted to be consistent and once a week.
202216 . Ailani was again seen by Dr. Bou Salvador on
2033November 3, 2016 , for her 12 - month well visit. Nutritionally,
2044s he was noted to be eating two to three varieties of solid foods
2058with no problems and was feeding herself finger foods.
2067Developmentally, she was reported to be playing pat - a - cake and
2080drinking from a cup. She was able to bang two cubes held in her
2094hands wi th thumb - finger grasp. She was saying "mama" and
"2106dada , " imitated speech sounds, could say three words other than
"2116mama" and "dada , " and understood "no . " She was able to walk
2128while holding on , and was reported to stand alone and walk well.
2140A physical ex amination revealed normal extremities. A
2148neurologic examination was also normal , with normal strength,
2156tone , and reflexes reported.
216017 . On November 21, 2016, Ailani returned to Dr. Qureshi
2171at Kids Neurology. It was noted that Ailani had been weaned off
2183medications six months earlier and had no seizure activity
2192since. She was noted to be doing very well. It was noted that
2205no therapy was being provided at this time , although she was
2216evaluated for occupational therapy but did not qualify for it.
2226Develop mentally, she was noted to be walking with one hand held,
2238rising independently, taking several steps, getting to sitting,
2246pulling to stand, standing for two seconds, saying a few words
2257besides "mama" and "dada , " playing ball game, making postural
2266adjustmen t to dressing, waiving "bye bye , " and indicating what
2276she wants. She was noted to have pincer grasp, releasing
2286objects to others when grabbed , and banging two things.
2295Dr. Qureshi noted "she is doing amazing right now."
230418 . A December 24, 2016 , emergency room record (for a
2315cough/choking episode after eating a piece of Dorito) from
2324Florida Hospital Tampa reflects that Ailani had not had seizures
2334since birth , and had been off Keppra and Phenobarbital for
2344almost a year. A physical examination revealed an ac tive, well -
2356developed , and well - nourished child. Neurologically, she was
2365noted to be awake, alert , and interacting with family and staff.
2376She was also noted to be active and playful.
238519 . An Early Intervention progress note from February 15,
23952017 , reflect s Ailani had age - level play skills, could
2406communicate using vocalizations and some single words, could
2414follow routine directions , and was independent with walking and
2423floor transfers. Good progress was noted to be made, many goals
2434were reported met , and t he parents decided to reduce services to
2446one time per month.
245020 . On January 30, 2017 , Ailani was reevaluated for
2460participation in Early Steps. It was noted that Ailani's mother
2470had no concerns at this time. The report notes that Ailani
2481liked the slide, liked to kick the ball, liked to play with her
2494siblings and cousins , and that she is very curious. No hearing
2505or vision concerns were noted. It was reported that many of her
2517goals had been met , and that Ailani was using a variety of
2529vowels and consonants , identifying at least three family members
2538when named, that she was saying a variety of words , and was
2550using a sign for "more food . " Ailani was noted to still be
2563eligible for Early Steps secondary to her diagnosis of hypoxic
2573ischemic encephalopathy.
257521 . Ailani was seen by Dr. Bou Salvador on March 28, 2017 ,
2588for her 16 - month well visit. She was noted to have good eating
2602habits and a good appetite. No mealtime problems were reported ,
2612and she was noted to be eating solid foods with no problems.
2624She was n oted to have socially appropriate behavior for her age.
2636She was talking well and was able to balance on one foot for
2649five second s , could throw a ball overhead , and pedal a tricycle.
2661Her orthopedic and neurologic examinations were normal , with
2669normal stre ngth, tone , and reflexes reported.
267622 . At the request of NICA, Donald C. Willis, M.D. , who
2688specializes in obstetrics and gynecology and maternal - fetal
2697medicine, reviewed the medical records included in the
2705Stipulated Record as Joint Exhibits A through G. In his report
2716dated August 2, 2017, which was admitted into evidence without
2726objection, Dr. Willis noted in pertinent part that Ailani's
2735mother was cramping when she presented to the hospital , and was
2746three centimeters dilated with suspected amniotic memb ranes
2754ruptured. Contractions were noted to be occurring occasionally.
2762Medical records indicated the presence of late decelerations on
2771admission , which progressed to bradycardia , for which an
2779immediate Cesarean section was recommended. Dr. Willis observe d
2788that Ailani was depressed at birth with Apgar scores of 2/4/4,
2799and that cord blood gas was abnormal with a pH of only 6.97. He
2813further noted that Ailani was floppy, pale , and had poor
2823perfusion; that bag and mask ventilation was initiated , followed
2832by i ntubation for continued respiratory distress; that
2840hypotension was present and required IV fluids; that the initial
2850blood count was low; and that Ailani remained acidotic after
2860birth with a pH of 6.7 and a base excess of - 27 at 90 minutes
2876after birth. Dr. Willis further noted Ailani's hospital course
2885consistent with her medical records and ultimately opined that
2894Ðthere was an obstetrical event that resulted in loss of oxygen
2905to the baby's brain during labor, delivery and continuing into
2915the immediate post delivery period. The oxygen deprivation
2923resulted in brain injury.Ñ Dr. Willis was unable to comment
2933about the severity of the injury, however.
294023. At the request of NICA, Laufey Y. Sigurdardottir,
2949M.D. , who is b oard c ertified in neurology and specializ ing in
2962pediatric neurology, reviewed the medical records included in
2970the Stipulated Record as Joint Exhibits A through G, and
2980performed a thorough examination of Ailani on October 18, 2017.
2990Dr. Sigurdardottir's summary of Ailani's medical history , along
2998w ith her findings upon a full physical and neurological
3008examination , is documented within her written report, which was
3017admitted into evidence without objection. Dr. Sigurdardottir
3024noted that Ailani was a non - dysmorphic, interactive toddler with
3035normal fac ial features and apparently intact vision. No
3044abnormalities in Ailani's extremities were noted other than
3052occasional toe walking. Neurologically, Ailani was noted to be
3061interactive, curious , and exhibiting normal joint attention.
3068Ailani exhibited preten d play with a stethoscope, said the word
"3079mom" a few times, pointed to her mouth when asked to do so,
3092enjoyed playing with a tablet computer, shook her head for "no , "
3103exhibited understandable words, and exhibited no autistic
3110features. Cranial nerves were intact, facial grimacing was
3118symmetric and normal , and hearing seemed intact. No drooling
3127was noted. Muscle tone was noted to be normal, strength was
3138full and symmetric and deep tendon reflexes were symmetric and
3148within normal limits. Gross and fine mot or skills were noted to
3160be within normal limits for age.
316624 . Overall, Dr. Sigurdardottir determined that despite
3174her initial abnormal neurological examination , and delays in
3182early development, Ailani's current neurologic and developmental
3189functioning is a ge - appropriate. She went on to opine in
3201relevant part that,
3204Ailani is not found to have substantial
3211delays in motor and mental abilities at this
3219time . . . . In review of available
3228documents, there is evidence of impairment
3234consistent with a neurologic i njury to the
3242brain or spinal cord acquired due to oxygen
3250deprivation . . . . The prognosis for full
3259motor and mental recovery is excellent and
3266the life expectancy is full . . . . In
3276light of evidence presented I believe Ailani
3283does not fulfill criteria o f a substantial
3291mental and physical impairment at this time.
3298I do not feel that Ailani should be included
3307in the NICA program.
331125 . Neither Petitioner nor Intervenor submitted or
3319introduced into evidence any expert reports rebutting the
3327opinions of Dr. W illis and/or Dr. Sigurdardottir.
3335CONCLUSIONS OF LAW
333826 . The Division of Administrative Hearings has
3346jurisdiction over the parties to and the subject matter of these
3357proceedings. §§ 766.301 - 766.316, Fla. Stat.
336427 . The Plan was established by the Legislat ure "for the
3376purpose of providing compensation, irrespective of fault, for
3384birth - related neurological injury claims" relating to births
3393occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
340428 . The injured infant, her or his personal
3413representa tive, parents, dependents, and next of kin may seek
3423compensation under the Plan by filing a claim for compensation
3433with DOAH. §§ 766.302(3), 766.303(2), and 766.305(1), Fla.
3441Stat. NICA, which administers the Plan, has "45 days from the
3452date of service of a complete claim . . . in which to file a
3467response to the petition and to submit relevant written
3476information relating to the issue of whether the injury is a
3487birth - related neurological injury." § 766.305(4), Fla. Stat.
349629 . If NICA determines that the i njury alleged in a claim
3509is a compensable birth - related neurological injury, it may award
3520compensation to the claimant, provided that the award is
3529approved by the administrative law judge to whom the claim has
3540been assigned. § 766.305(7), Fla. Stat. If, on the other hand,
3551NICA disputes the claim, as it has in the instant case, the
3563dispute must be resolved by the assigned administrative law
3572judge in accordance with the provisions of chapter 120, Florida
3582Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat .
359130 . In discharging this responsibility, the administrative
3599law judge must make the following determination based upon the
3609available evidence:
3611(a) Whether the injury claimed is a birth -
3620related neurological injury. If the
3625claimant has demonstrated, to t he
3631satisfaction of the administrative law
3636judge, that the infant has sustained a brain
3644or spinal cord injury caused by oxygen
3651deprivation or mechanical injury and that
3657the infant was thereby rendered permanently
3663and substantially mentally and physically
3668im paired, a rebuttable presumption shall
3674arise that the injury is a birth - related
3683neuro logical injury as defined in
3689s. 766.303(2).
3691(b) Whether obstetrical services were
3696delivered by a participating physician in
3702the course of labor, delivery, or
3708resuscitat ion in the immediate postdelivery
3714period in a hospital; or by a certified
3722nurse midwife in a teaching hospital
3728supervised by a participating physician in
3734the course of labor, delivery, or
3740resuscitation in the immediate postdelivery
3745period in a hospital.
3749§ 766.309(1), Fla. Stat. An award may be sustained only if the
3761administrative law judge concludes that the "infant has
3769sustained a birth - related neurological injury and that
3778obstetrical services were delivered by a participating physician
3786at birth." § 76 6.31(1), Fla. Stat.
379331 . The term "birth - related neurological injury" is
3803defined in section 766.302(2) as follows:
"3809Birth - related neurological injury" means
3815injury to the brain or spinal cord of a live
3825infant weighing at least 2,500 grams for a
3834single ges tation or, in the case of a
3843multiple gestation, a live infant weighing
3849at least 2,000 grams at birth caused by
3858oxygen deprivation or mechanical injury
3863occurring in the course of labor, delivery,
3870or resuscitation in the immediate
3875postdelivery period in a ho spital, which
3882renders the infant permanently and
3887substantially mentally and physically
3891impaired.
389232 . To be compensable under the NICA Plan, there must have
3904been an obstetrical event which resulted in loss of oxygen to
3915the babyÓs brain during labor, deli very, or resuscitation in the
3926immediate post - delivery period resulting in a permanent and
3936substantial mental impairment and a permanent and substantial
3944physical impairment, inasmuch as both are required to establish
3953compensability. Fla. Birth - Related Neur ological Injury Comp.
3962AssÓn v. Div. of Admin. Hearings , 686 So. 2d 1349 (Fla. 1997).
397433 . Dr. Willis' s unrebutted opinion that "there was an
3985apparent obstetrical event that resulted in loss of oxygen to
3995the baby's brain during labor, delivery and continuin g into the
4006immediate post - delivery period" is credited.
401334 . Likewise, Dr. Sigurdardottir's unrebutted opinions
4020that "Ailani is not found to have substantial delays in motor
4031and mental abilities at this time" and that "the prognosis for
4042full motor and ment al recovery is excellent and the life
4053expectancy is full" are also credited.
405935 . In his Order to Show Cause of February 5, 2018, the
4072undersigned included the following endnote:
40772 / The undersigned notes that he is not
4086qualified to determine whether Ailani
4091Sanchez suffered a Ðbirth related
4096neurological injuryÑ based solely upon a
4102review of the medical records submitted to
4109NICA.
411036 . Thereafter, on February 14, 2018, Petitioners filed a
4120response to the Order to Show Cause. In their response ,
4130Petitioners r eiterated their position that Ailani did suffer a
4140compensable neurological injury, and stating further
4146ÐPetitioners continue to rely upon the medical records submitted
4155to NICA with PetitionersÓ claim to support their position in
4165this case.Ñ Petitioners fu rther stated that Florida Statutes do
4175not require that Petitioners retain a medical expert in order to
4186obtain NICA benefits.
418937 . While Petitioners are correct that nothing in the
4199statutes governing NICA requires them to retain a medical expert
4209to substan tiate their claim, they do bear the burden of proving,
4221by competent substantial evidence, that Ailani suffered a birth -
4231related neurological injury as defined by section 766.302(2).
423938 . As noted in the cited endnote above, the undersigned
4250is not qualified to determine whether Ailani Sanchez suffered a
4260Ðbirth related neurological injuryÑ based solely upon a review
4269of the medical records submitted to NICA. See Worzalla v.
4279Barnhart , 311 F. Supp. 2d 782 (E.D. Wis. 2004) ( ÐALJs must not
4292succumb to the temptati on to play doctor and make their own
4304independent medical findings.Ñ ). As the party bearing the
4313burden of proof, it was incumbent upon Petitioners to present
4323expert medical opinion to rebut the expert medical opinions
4332expressed by NICAÓs retained experts. This, Petitioners failed
4340to do.
434239 . The competent substantial evidence in this case
4351reveals that Ailani does not have a permanent and substantial
4361mental or physical impairment. Thus, Ailani has not suffered a
4371birth - related neurological injury as defined by section
4380766.302(2) and is not entitled to benefits under the Plan.
4390ORDER
4391Based on the foregoing Findings of Fact and Conclusions of
4401Law, it is ORDERED that the Petition filed by Michele Sanchez
4412and Fidel Sanchez , on behalf of and as parents and natural
4423guardians of Ailani Sanchez , is dismissed with prejudice.
