97STATEMENT OF THE ISSUE S
102Whether Petitioner, Rusty Santangelo, was subject to an
110unlawful employment practice by Respondent, Owens Facility
117Services (Owens), based on his disability , in violation of the
127Florida Civil Rights Act; and , if so, what remedy is appropriate.
138PRELIMINARY STATEMENT
140On May 25, 2016, Mr. Santangelo filed an employment charge
150of discrimination with the Florida Commission on Human Relations
159(FCHR), alleging that he has a disability , and that he began
170working as a custodian for Owens on January 1, 2011 ; and that in
1832013 Owens failed to report his work hours to Ace Staffing, and
195he was Ðterminated on 10/2/2015, for no reason.Ñ
203By letter dated June 30, 2017, FCHR notified Mr. Santangelo
213that Owens was not Mr. S antangeloÓs employer, and no reasonable
224cause existed to believe that an unlawful practice occurred.
233On July 6, 2017, Mr. Santangelo filed his Petition for Relief
244with FCHR, and FCHR referred the matter to the Division to
255resolve the dispute.
258At the hea ring, Mr. Santangelo testified on his own behalf
269and presented the testimony of Gregory Lichtarski, the current
278general manager of Owens. Mr. Santangelo offered Exhibits 1
287through 31 into evidence, and all were admitted. 2/ To the limited
299extent that any document is reasonably authentic and is relevant,
309and the hearsay statements therein were corroborated by other
318competent testimony, the document has been considered.
325Respondent was granted wide latitude in cross - examin ing
335Mr. Lichtarski as he was listed on it s witness list; however ,
347Respondent did not present any other witnesses. Respondent
355offered Exhibits 1 through 12 into evidence, and all were
365admitted.
366Both parties timely filed proposed r ecommended o rders (PRO) .
377To the extent that either PRO has information that was not
388subjected to cross - examination during the hearing, that
397information has not been considered in the preparation of this
407Recommended Order.
409FINDING S OF FACT
4131. Owens provides maintenance and custodial services to
421multiple public fa cilities in Orange County, Florida. Owens does
431not own any of the facilities, but oversees the conversions of
442the facilities from one event to the next. Owens secures
452services from various staffing companies to fulfill its
460obligations.
4612. In order to accommodate its staffing requirements, Owens
470will contact a subcontractor, discuss the event specifics,
478determine how many laborers are necessary, and how many laborers
488the subcontractor can provide. Once a verbal agreement is
497reached, Owens issues an ini tial purchase order to the
507subcontractor requesting the necessary staff for an event.
515Thereafter , the subcontractor notifies Owens of the specific
523laborers, their shift schedules and where those laborers will
532report. Once the event is completed, the labo rers complete a
543timekeeping report, and the hours are reviewed. The
551subcontractor generates an invoice and Owens then pays the
560subcontractor. The subcontractor then pays the laborers. The
568entire process may take 90 days for payment to be issued to the
581l aborers.
5833. Ace Staffing (Ace) was one of the subcontracting
592companies that provided day laborers to Owens. Mr. Santangelo
601was an employee of Ace. Ace could send Mr. Santangelo to various
613locations to work. Mr. Santangelo preferred to work for Owens,
623a nd specifically wanted to work during the basketball season at
634the Amway Center. It is undisputed that Ace set the pay scale
646for Mr. Santangelo, and that Mr. Santangelo received his
655paychecks from Ace.
6584. Owens does not have any ownership interest in Ace .
669Owens is not responsible for any hiring decisions by Ace. Owens
680has the ability to review the background checks performed on Ace
691employees who are sent to work for Owens, but Owens does not hire
704or evaluate those workers. Owens has the ability to ask that
715certain Ace employees not return to work for Owens, but does not
727have the ability to fire or terminate an Ace employee .
7385. Mr. Santangelo attempted to resolve a perceived
746discrepancy in his pay. Mr. Santangelo brought the pay issue to
757the attention of Mr. Lichtarski, who in turn brought the pay
768issue to an Ace employee. Communication between Owens, Ace and
778Mr. Santangelo deteriorated . Mr. Santangelo was paid, but his
788employment by Ace ended .
7936. Mr. Santangelo was not employed by Owens. He was, at
804all times, employed by Ace. Mr. Santangelo failed to present any
815credible evidence that Respondent discriminated against him.
822CONCLUSIONS OF LAW
8257. The Division has jurisdiction over the parties to and
835the subject matter of this proceeding pursuant to sections
844120.569, 120.57(1), and 760.11(7) , Florida Statutes.
8508. This case involves an alleged violation of the Florida
860Civil Rights Act of 1992 (the "Act") , s ections 760.01 through 10 .
8749. Section 760.02(7) provides the following definition:
881ÐEmployer Ñ means any person employing 15 or
889more employees for each working day in each
897of 20 or more calendar weeks in the current
906or preceding calendar year, and any agent of
914such a person.
91710. Section 760.10(1)(a) provides that it is an unlawful
926employment pra ctice for an employer:
932To discharge or to fail or refuse to hire any
942individual, or otherwise to discriminate
947against any individual with respect to
953compensation, terms, conditions, or
957privileges of employment, because of such
963individualÓs race, color, rel igion, sex,
969pregnancy, national origin, age, handicap, or
975marital status.
97711. Mr. Santangelo has the burden of proving by a
987preponderance of the evidence that Owens committed an unlawful
996employment practice. See § 120.57(1)(j), Fla . Stat.
100412. The pre ponderance of evidence standard requires proof
1013by "the greater weight of the evidence," Black's Law Dictionary ,
10231201 (7th ed. 1999), or evidence that "more likely than not"
1034tends to prove a certain proposition. See Gross v. Lyons , 763 So.
10462d 276, 28 0 n.1 ( Fla. 2000).
105413. The facts presented establish that Mr. Santangelo was
1063not employed by Owens, and therefore, within the meaning of the
1074Florida Civil Rights Act of 1992, could not have been
1084discriminated against by Owens.
1088RECOMMENDATION
1089Based on the forego ing Findings of Fact and Conclusions of
1100Law , it is RECOMMENDED that the Florida Commission on Human
1110Relations enter a final order dismissing the Petition for Relief
1120filed by Mr. Santangelo in its entirety.
