150PRELIMI NARY STATEMENT
153The Administrative Complaint of Petitioner, Department of
160Children and Families (Department) , alleged that on April 5,
1692017 , Family Learning did not have documentation that Armentha
178Edwards and Tamarra Morse had the required level 2 backgrou nd
189scre ening because there was a 90 - day break in their employment in
203childcare. This the Complaint alleged violated r ule 65C -
21322.006(4)(e) 1 . and 4. The Complaint further alleged that the
224violations were a second occurrence. The first violation
232allegedly was that on December 13, 2016, Family L earni ng did not
245have documentation that De Andria Harris had a valid level 2
256b ackground screening.
259Family Learning disputed the ComplaintÓs allegations and
266requested an administrative hearing. The Department referred the
274matter to the Division to conduct the hearing. The hearing was
285set for Sept ember 8, 2017. Pursuant to an E xecutive O rder of the
300Governor directing that all state offices be closed to allow
310preparation for Hurricane Irma, the hearing was canceled. Th e
320hearing was re - scheduled for January 4, 2018, and conducted as
332scheduled.
333Toinette Ash and Patricia Step testified on behalf of the
343Department. Department Exhibits A and B were entered into
352evidence. Deloris Franklin testified on behalf of Family
360Le arning. Family Learning entered Exhibits 1, 3, and 4 into
371evidence.
372The day after proposed recommended orders were due Family
381Learning filed a document titled ÐStatement to the Honorable John
391D. C. Newton, II,Ñ stating that it wished to obtain a transcri pt
405of the hearing. This was treated as a motion and granted by
417Order Extending Proposed Recommended Order Deadline. The O rder
426extended the deadline for filing proposed recommend ed orders to
43610 days after filing of the transcript. Because the Department
446had already filed its Proposed Recommended Order, the Order
455granted the Department leave to file a rebuttal to Family
465Learni ngÓs Proposed Recommended Order.
470Subsequently , the Department asked for clarification of the
478O rder because Family Learning had no t ordered the transcript.
489The motion was granted by order imposing a deadline for filing a
501transcript or a proposed recommended order. Family L earn ing did
512not file a transcript. It filed a Proposed Recommended O rder.
523The Department did not file a rebut tal. The proposed recommended
534orders have been considered in preparation of this Recommended
543Order.
544FINDING S OF FACT
5481. Family L earn ing is a childcare facility licensed by the
560Department. Ms. Franklin owns and operates Family L earn ing.
5702. On Octob er 2 , 2015, Patricia Ste p , a Department
581childcare licensing speciali st, visited the Family Learning
589facility before it opened for business. She inspected the
598facility and provided education and training for the owner and
608operator, Ms. Franklin. The training included education about
616file organization, record keeping, and background screening
623requirements for employees and volunteers working at a child day
633care facility.
6353. Ms. Step performed her first post - opening review of the
647Family L earn ing facility on De cember 13, 2016. The review
659included a review of the file of employee De A ndria Harris.
671Ms. Harris lived in Georgia before working with Family L earn ing.
6834. When a person has been out - of - state, performing a
696background check takes longer. For this reas on at that time, the
708Department issued provisional letters to permit people to work in
718a childcare facility while their background screening was being
727completed. Ms. HarrisÓ s file included a 45 - day provisional
738letter dated October 18, 2016. It expired De cember 2, 2016. The
750October 18 letter plainly advised Family Learning of the 45 - day
762limit upon provisional status. The file did not include proof of
773a successful background check of Ms. Harris from Georgia.
7825. Nothing in Ms. HarrisÓs file indicated t hat she was no
794longer employed at Family L earn ing. Ms. Franklin testified that
805at the time of the December inspection Ms. Harris had given
816notice. If that is accurate, it does not mean that she was no
829longer employed.
8316. On December 13, 2016, Ms. Step again told Ms. Franklin
842about the background screening requirements. Their conversation
849included reminding Ms. Franklin that if a person with a
859successful background screening had a break of 90 days or more in
871childcare employment the person had to be re - screened if she
883returned to childcare employment. Ms. Step also reminded
891Ms. Franklin that provisional letters only permitted employment
899for 45 days while an out - of - state check is being conducted.
9137. Ms. Step gave Ms. Franklin a copy of the inspection form
925that indicated the Family L earn ing personnel records did not
936comply with the Department requirements. Ms. Franklin received
944and signed the form. Ms. Franklin also signed a Supplemental
954Inspection Sheet that described the background screening process
962and the 45 day limit on provisional hiring status. Finally,
972Ms. Franklin received and signed a Notice of Administrative
981Warning for Ms. Harris not having a documented, completed
990background check.
9928. Ms. Step conducted another routine inspection of Fa mily
1002Learning on April 5, 2017. She reviewed the employee files of
1013Armentha Edwards and Tamarra Morse. Their files contained
1021documentation of background screening clearance, work histories,
1028and applications for employment , among other documents.
10359. Ms. EdwardsÓ background clearance document, also called
1043an eligibility letter, was dated August 30, 2016. Her employment
1053with Family L earn ing started March 6, 2017. Because more than 90
1066days separated those dates, Ms. Step reviewed Ms. EdwardsÓ work
1076history in the file to see if Ms. Edwards had been employed in
1089other positions that required a background check and the dates of
1100that employment. She had not been.
110610. Ms. Step also reviewed the employee file for
1115Tamarra Morse. The Background Screening Resul t printout for
1124Ms. Morse indicated that she cleared screening on November 2,
11342015. Ms. M orseÓs employment with Family Learn ing started on
1145November 3, 2016. Because more than 90 days separated those
1155dates, Ms. Step reviewed Ms. MorseÓs file to see if it
1166established that she had been employed in other positions that
1176required a background check and if the dates of that employment
1187were during the 90 - day period.
119411. T he ÐDate of Employment, Start Date Ñ field, of
1205Ms. MorseÓs application identified period o f employment at a
1215facility named Journey to Excellence as Ð4 to 5 years.Ñ Notes of
1227an employment verification check with Journey to Excellence
1235indicated employment from Ð8/09 Î present.Ñ November 2, 2016 ,
1244was the date of the employment verification. Ms. Step sought
1254additional information from Journey to Excellence.
126012. The information Journey to Excellence provided included
1268an Affidavit of Good Moral Character dated May 6, 2016; a Child
1280Abuse & Neglect Reporting Requirements acknowledgement signed by
1288Ms. Morse on November 5, 2015; and a Journey to Excellence
1299volunteer sign - in sheet indicating that Ms. Morse had last signed
1311in on July 29, 2016.
1316CONCLUSIONS OF LAW
131913. Section 402.305, Florida Statutes (2017) 1/ , directs the
1328Department to establish lic ensing standards for childcare
1336facilities. Section 402.310(1), authorizes the department to
1343impose a fine not to exceed $100 per violation per day for a
1356violation of sections 402.301 through 402.319 or rules adopted by
1366authority of those statutes.
137014. In December of 2016 and April of 2017, r ule 65C -
138322.06(4)(d)1 . required a childcare facility to maintain re cords
1393that included proof of a l evel 2 background screening as defined
1405in section 435.04, Florida Statutes, including at a minimum
1414Federal Bureau of Inv estigation, Florida Department of Law
1423Enforcement, and local law enforcement records checks. Rule 65C -
143322.06(4)(e)1 . provided that a screening was valid for five years
1444and required a state - wide re - screen after five years for all
1458child care personnel.
146115. Rule 65C - 22.06(4)(e) required that the Ð[r]e - screening
1472information for all child care personnel must be documented on
1482CF - FSP Form 5131 March 2009, Background screening and Personnel
1493File Requirements.Ñ
149516. The re - screening req uirements of r ule 65C - 22.0 6(4)(e)6 .
1510provided that Ð[c]hild care personnel must be re - screened as
1521outlined in paragraph (4)(d) above following a break in
1530employment in the child care industry that exceeds 90 days.Ñ
1540Section 435.04 establishes the l evel 2 screening standards.
154917. As the Department acknowledges, it must prove its
1558charges by clear and convincing evidence. Coke v. DepÓt of
1568Child. & Fam. Servs. , 704 So. 2d 726 (Fla. 5th DCA 1998).
158018. The clear and convincing evidence proved that Family
1589Learning Center did not maintai n the required background
1598screening documentation for Ms. Edwards. The clear and
1606convincing evidence also proved that this was a second violation.
161619. The Department did not prove by clear and convincing
1626evidence that Family L earn ing did not maintain th e required
1638background screening documentation for Ms. Morse.
164420. Rule 65C - 22.010(2)( e )2 .b. (as in effect at the time )
1659states the following: ÐFor the second violation of the same
1669Class II standard, the Department shall issue an administrative
1678complaint i mposing a fine of $50.00 for each violation.Ñ The
1689clear and convincing evidence established a second violation of
1698the background screening documentation requirement. For this
1705violation, the Department should impose a fine of $50.00 on
1715Family L earn ing.
1719RE COMMENDATION
1721Based on the foregoing Findings of Fact and Conclusions of
1731Law, it is RECOMMENDED that Petitioner, Department of Children
1740and Families, impose a fine of $50.00 on Respondent, Family
1750L earn ing Center.
