4. On June 29 , 2017 , CenturyLink Public Communications, Inc., d / b / a Century Link, filed a

notice of appearance and intervention with the Department.

5. On July 7 , 2017 , Global Tel*Link Corporation filed a notice of intervention with the

Department.

6. On July 11 , 2017 , the Department referred the case to the Division of Administrative

Hearings ("DOAH'} FDC Case No. 17 - 193 was assigned DOAH Case No. 17 - 3893BID.

7. On July 20 , 2017 , Petitioner filed a notice of voluntary dismissal in DOAH Case No. 17-

3893BID.

8. On July 21 , 2017 , the Hon. Linzie F. Bogan , Administrative Law Judge , entered an Order

closing the file and relinquishingjurisdiction to the Department.

CONCLUSIONS OF LAW

9. The Department has jurisdiction over this matter pursuant to Section 120.57(3), Florida

Statutes.

10. U nder Rule 1.420(a)(l) , Fla. R. Civ . P . , a plaintiffmay dismiss an action or claim without

order of the court by filing a notice of voluntary dismissal.

11. The Petitioner dismissed its petition and all associated claims when it filed its notice of

voluntary dismissal. The ALJ subsequently closed the DOAH case tile and relinquished

jurisdiction back to the Department. There is no action or claim remaining for adjudication ,

and therefore this case is due to be dismissed.

WHEREFORE , it is hereby ordered and adjudged that the formal written protest filed in

the above - styled matter is dismissed , with prejudice, with each party to bear its own attorney's

fees and costs .
