143Intervenor responded to the Order to Show Cause.

151STATEMENT OF THE CASE

155On July 24, 2017, Petitioners, Gisell Quiroga and Nelson

164Quiroga, on behalf of and as parents and natural guardians of

175Paula Quiroga (Paula), a minor, filed a Petition for Benefits

185Pursuant to Florida Statute Section 776.301 et seq. (Petition)

194with the Division of Administrative Hearings (DOAH) for a

203determination of compensability under the Florida Birth - Related

212Neurological Injury Compensation Plan (Plan). The Petition named

220Pablo Delgado, M.D., as the physician who provided obstet ric

230services for the birth of Paula on July 27, 2012, at Baptist

242Hospital of Miami, Inc. (Baptist) , in Miami, Florida.

250DOAH served NICA with a copy of the Petition on August 2,

2622017. DOAH served a copy of the Petition on Baptist on August 4,

2752017, and P ablo Delgado, M.D., on August 7, 2017. On August 10,

2882017, Baptist filed a Petition for Leave to Intervene, which was

299granted the same date.

303RespondentÓs Motion was filed on September 27, 2017. Said

312motion requests that an order be entered finding that the claim

323was not compensable because Paula did not sustain a "birth -

334related neurological injury" as that term is defined in section

344766.302(2), Florida Statutes.

347FINDINGS OF FACT

3501. Paula was born on July 27, 2012, at Baptist in Miami,

362Florida.

3632. Donald Willis, M.D., an obstetrician specializing in

371maternal - fetal medicine, was retained by NICA to review the

382medical records of Paula, and her mother, Giselle Quiroga, to

392opine whether an injury occurred in the course of labor, delivery

403or res uscitation in the immediate postdelivery period at Baptist

413due to oxygen deprivation or mechanical injury. Dr. Willis

422reviewed the medical records and in a report dated September 29,

4332017, Dr. Willis described his findings, in pertinent part, as

443follows:

444In summary, primary Cesarean section was done

451for fetal macrosomia. There was no

457identifiable fetal distress prior to

462delivery. The baby was not depressed at

469birth with Apgar scores of 9/9. No

476resuscitation was required at birth. The

482newborn hospital course was uncomplicated.

487Developmental delay was suspected during

492childhood. MRI at about 2 - years of age was

502consistent with brain injury. Cerebral palsy

508was diagnosed.

510There was no obstetrical event that resulted

517in loss of oxygen or trauma to the b abyÓs

527brain during labor, delivery and the

533immediate post delivery period.

5373. Attached to RespondentÓs Motion is the affidavit of

546Dr. Willis, dated September 18, 2017. In his affidavit,

555Dr. Willis affirms his August 29, 2017, report and maintain s that

567there was no obstetrical event that resulted in loss of oxygen or

579trauma to PaulaÓs brain during labor, delivery or the immediate

589post delivery period.

5924. A review of the file reve a ls that no contrary evidence

605was presented to dispute Dr. Wil lisÓ findings and opinions.

615Dr. WillisÓ opinion is credited.

620CONCLUSIONS OF LAW

6235. DOAH has jurisdiction over the parties to and the

633subject matter of these proceedings. §§ 766.301 - 766.316, Fla.

643Stat.

6446. The Plan was established by the Legislature "for the

654purpose of providing compensation, irrespective of fault, for

662birth - rel ated neurological injury claims relating to births

672occurring on or after January 1, 1989. Ñ § 766.303(1), Fla. Stat.

6847. The injured infant, her or his personal representative,

693parents, dependents, and next of kin may seek compensation under

703the Plan by filing a claim for compensation with DOAH.

713§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

721which administers the Plan, has "45 days from the date of service

733of a co mplete claim . . . in which to file a response to the

749petition and to submit relevant written information relating to

758the issue of whether the injury is a birth - related neurological

770injury." § 766.305(4), Fla. Stat.

7758. NICA has determined that Petition ers do not have a claim

787that is compensable under the Plan and RespondentÓs Motion

796requests an order be entered finding that the claim is not

807compensable.

8089. In ruling on the motion, the administrative law judge

818must make the following determination based upon the available

827evidence:

828(a) Whether the injury claimed is a birth -

837related neurological injury. If the claimant

843has demonstrated, to the satisfaction of the

850administrative law judge, that the infant has

857sustained a brain or spinal cord injury

864caused by oxygen deprivation or mechanical

870injury and that the infant was thereby

877rendered permanently and substantially

881mentally and physically impaired, a

886rebuttable presumption shall arise that the

892injury is a birth - related neurological injury

900as defined in s . 766.303(2).

906§ 766.309(1), Fla. Stat.

91010. The term "birth - related neurological injury" is defined

920in section 766.302(2) as follows:

"925Birth - related neurological injury" means

931injury to the brain or spinal cord of a live

941infant weighing at least 2,500 grams for a

950single gestation or, in the case of a

958multiple gestation, a live infant weighing at

965least 2,000 grams at birth caused by oxygen

974deprivation or mechanical injury occurring in

980the course of labor, delivery, or

986resuscitation in the immediate post delivery

992period in a hospital, which renders the

999infant permanently and substantially mentally

1004and physically impaired.

100711. RespondentÓs Motion, which is not refuted, establishes

1015that Paula did not sustain an injury to the brain caused by

1027oxygen depriva tion or mechanical injury occurring in the course

1037of labor, delivery, or resuscitation in the immediate

1045postdelivery period in a hospital. No evidence has been

1054presented that Paula otherwise sustained a birth - related

1063neurological injury. Accordingly, Pau la is not eligible for

1072benefits under the Plan.

1076CONCLUSION

1077Based upon the foregoing Findings of Fact and Conclusions of

1087Law, it is ORDERED that the Petition is dismissed with prejudice.
