47This came on for consideration upon a Notice of Voluntary

72STATEMENT OF THE CASE

76On July 24 , 201 7, Petitioner filed a Petition for Benefits

87Filed P ursuant to Florida Statute Section 766.301 , Florida

96Statutes, et seq. The cited statutory provision is otherwise

105known as the Florida Birth - Related Neurological Injury

114Compensa tion Plan (the Plan).

119On January 4, 2018 , Respondent filed a Response to Petition ,

129determining that Addyson Hagan (Addyson) did not suffer an injury

139that is compensable under the Plan.

145On August 22, 2017, Flagler Hospital, Inc. , filed a petition

155to inter vene, which was granted by Order dated September 6, 2017.

167On February 14, 2018 , the parties jointly requested that a

177hearing be scheduled to address the issues of compensability and

187notice.

188By Order dated March 5, 2018 , the final hearing was

198scheduled for July 25, 2018 , in St. Augustine, Florida. However,

208at the request of the parties the hearing was continued to

219October 5, 2018.

222On September 6, 2018 , Flagler Hospital filed a Notice of

232Withdrawal of the Motion to Intervene, and by Order dated

242Septembe r 17, 2018 , Flagler Hospital was permitted to withdraw

252its intervention in this matter. On that same day, Petitioner

262filed a Notice of Voluntary Dismissal with Prejudice of Petition

272for Benefits.

274CONCLUSION

275Based on the foregoing, it is ORDERED that the P etition

286filed by Petitioner Alayna Hagan, on behalf of and as parent and

298natural guardian of Addyson Hagan, a minor , is dismissed with
