108STATEMENT OF THE ISSUE
112The issue for determination in these proceedings is w hether
122PetitionerÓs application for licensure of a n additional group
131home facility should be approved by Respondent , the Agency for
141Persons with Disabilities (ÐAPDÑ) .
146PRELIMINARY STATEMENT
148On February 7, 2017, Petitioner submitted an application to
157Respondent for licensure as a group home facility. Petitioner
166has other group h ome licenses issued by Respondent. The
176February 7, 2017, application is for an additional license. On
186March 29, 2017, Petitioner completed its application for
194licensure as a group home facility. By letter dated June 7,
2052017, APD notified Petitioner that PetitionerÓs application for
213licensure was denied. Petitioner timely filed a request for an
223administrative hearing involving disputed issues of material fact
231to contest the denial of its application for licensure. On
241August 2, 2017, this matter was refe rred to DOAH and was assigned
254DOAH C ase No. 17 - 4353FL.
261At the hearing, Petitioner presented the testimony of
269Marilou Burden, Joseph Burden, Rebecca Brown, Mary Hall, Daniel
278Godfrey; and A PD employees Nancy Honl, Myra Leitold, and Larry
289Collins . Petitioner offered five exhibits, all of which were
299admitted into evidence. Respondent presented the testimony of
307Myra Leitold, Larry Collins, Nancy Honl, Police Officer Michael
316Jenson , Police Officer Geoffrey Newton, and Police Detective
324El iad Glenn . Respondent o ffered eight exhibits, all of which
336were admitted into evidence.
340A two - volume Transcript of the final hearing was filed on
352December 18, 2017 . Both parties timely submitted Proposed
361Recommended Order s on or before January 17, 2018 , which have been
373duly con sidered in the preparation of this Recommended Order .

411FINDING S OF FACT
4151. Respondent , AP D, is the state agency charged with
425regulating the licensing and operation of foster care facilities,
434group home facilities, and residential habitation centers
441pursuant to section 20.197 and chapter 393, Florida Statutes.
450APD is charged with reviewing all applications and ensuring
459compliance with the requirements for licensure.
4652. Petitioner is an applicant for licensure of a group home
476facility. PetitionerÓs representative, Marilou Burden, submitted
482the completed application to APD on March 29, 2017.
4913. PetitionerÓs application requested licensure of an
498additional group home facility. The proposed name of the
507facility was Iyachel Group Home, to be located at 1625 Woodridge
518Drive, in Clearwater, Florida.
5224. Angel Child Home Care Corporation, Inc., is a Florida
532registered corporation. Marilou Burden is PetitionerÓs corporate
539officer.
5405. Respondent may deny an application for licensure if the
550applicant has Ð[f]ailed to comply with the applicable
558requirements of this chapter or rules applicable to the
567applicant.Ñ § 393.0673(2) (a) 3., Fla. Stat. Based upon its
577initial findings of such violations, Respondent denied
584PetitionerÓs application for licensure for an additional group
592home.
5936. At all times material to these proceedings , L.L. was a
604resident of PetitionerÓs facility.
608COUNT I
6107. Clearwater P olice O fficer Geoffrey Newton testified
619regarding the events of February 24, 2017. Officer Newton was
629dispatched to PetitionerÓs facility. Officer Newton testified
636that upon arrival at the Angel Child Home C are facility,
647everyone was in the front yard. Officer Newton testified that
657R esident L.L. was in obvious distress and appeared to be having
669an emotional breakdown. Officer Newton was able to immediately
678calm L.L. down and speak to L.L. Officer Newton st ated that
690after speaking to L.L., L.L . was very compliant and cooperative
701with each request made by Officer Newton. L.L. told O fficer
712Newton that he wanted to harm himself. Officer Newton took L.L.
723into custody. L.L. was ultimately held pursuant to the Baker
733Act . Further testimony also noted that on February 24, 2017,
744Mr. Joseph Burden, an auto mechanic, was also able to easily
755calm L.L. However, Ms. Burden and the facility staff were not
766able to calm L.L. The sole staff member on duty merely told L.L .
780to listen to music. There is no evidence that facility staff
791employed any other technique s in an attempt to calm L.L.
8028. After easing L.L.Ós behavior episode, Officer Newton
810spoke to Ms. Burden. Officer Newton described Ms. Burden as
820Ðabsolutely uncoo perative.Ñ Ms. Burden insisted that L.L . be
830arrested. Officer Newton refused to arrest L.L. for a criminal
840act. Ms. Burden informed Officer Newton that Ms. Burden was
850going to call Congress because Officer Newton was not doing his
861job. Officer Newton s tated that it appeared that Ms. Burden does
873not have enough staff at the facility to ensure it provides a
885safe working environment for Ms. BurdenÓs employees.
8929. Petitioner failed to properly report the Baker Act
901of L.L. to APD .
906COUNT II
90810. Police Detec tive El iad Glenn testified that on
918February 11, 2017, he was dispatched to PetitionerÓs facility
927because of a call about an emotionally disturbed person. Upon
937arrival at the facility, Detective Glenn found that L.L. had hit
948himself and had suffered a smal l laceration on his face. L.L.
960indicated that he wanted to hurt himself. Detective Glenn
969took L.L. to a facility for emotionally disturbed persons
978pursuant to the Baker Act .
98411. Again, Petitioner failed to report the Baker Act
993of L.L. to APD.
99712. At th e hearing, Petitioner attempted to demonstrate
1006that Petitioner submitted the required incident report to APD via
1016e - mail. However, Petitioner failed to admit the incident
1026reporting form from this incident into evidence. Instead,
1034Petitioner merely submitte d what appears to be a screen shot of
1046the header of an e - mail. The header of the e - mail does not
1062indicate that the e - mail contained an attachment. PetitionerÓs
1072attempt to prove that it submitted the incident report in this
1083manner is not credited , since t he document purported to have been
1095submitted to APD was not produced.
1101COUNT III
110313. Clearwater P olice O fficer Michael Jenson testified that
1113on July 26, 2016, he was dispatched to Ms. BurdenÓs facility in
1125response to a potential battery. Officer Jenson co ntacted L.L.
1135Angel Child Home Care staff informed Officer Jenson that L.L. had
1146gotten upset and thr own furniture inside the home. Angel Child
1157Home Care staff informed Officer Jenson that no one was injured.
1168Officer Jenson determined that a battery did n ot occur.
117814. L.L. informed Officer Jenson that he did not want to go
1190back to the home. Officer Jenson asked Angel Child Home Care
1201staff if there was a counselor or physician available to speak
1212to L.L. Officer Jenson was informed that no counselor or
1222ph ysician was available to assist L.L. Officer Jenson took L.L.
1233into custody pursuant to the Baker Act , so that L.L. could
1244receive assistance from a counselor or physician .
125215. Again, Petitioner failed to report the Baker Act
1261of L.L. to APD.
126516. Similar t o the February 11, 2017 , incident, Petitioner
1275attempted to demonstrate that it submitted the required incident
1284report to APD via e - mail. However, as before, Petitioner failed
1296to admit the incident reporting form from this incident into
1306evidence. Instead, Petitioner merely submitted what appears to
1314be a screen shot of the header of an e - mail. The header of the
1330e - mail does not indicate that the e - mail contained an attachment.
1344PetitionerÓs attempt to prove that it submitted the incident
1353report in this mann er is not credited , since the document
1364purported to have been submitted to APD was not produced.
1374COUNT IV
137617. Clearwater P olice O fficer Michael Jenson testified that
1386on July 5, 2016, he was dispatched to Ms. BurdenÓs facility
1397located at 1641 Sunset Point Road. St. MichaelÓs Guardian Home
1407Care (ÐSt. MichaelÓsÑ) , a Department of Children and Families
1416group home , which is owned by Ms. Burden , reported R esident B.B.
1428as a runaway. St. Michael Ó s agents or employees reported
1439that B.B. was not welcome at St. Mic hael Ó s. Officer Jenson
1452confirmed that the child was locked out of St. Michael Ó s ,
1464and B.B. stayed at PetitionerÓs facility on Sunset Point Road.
1474COUNT V
147618. On May 2, 2016, police were called to Angel Child Home
1488CareÓs facility. As a result, L.L. was ins titutionalized
1497pursuant to the Baker Act.
150219. Yet again, Petitio ner failed to report the Baker Act
1513of L.L. to APD.
151720. A s before, Petitioner failed to admit the incident
1527reporting form from this incident into evidence. Instead,
1535Petitioner merely submitt ed what appears to be a screen shot of
1547the header of an e - mail. The header of the e - mail does not
1563indicate that the e - mail contained an attachment. PetitionerÓs
1573attempt to prove that it submitted the incident report in this
1584manner is not credited , since the document purported to have been
1595submitted to APD was not produced.
1601CONCLUSIONS OF LAW
160421 . The Division of Administration Hearings has
1612jurisdiction over the subject matter of and the parties to this
1623proceeding. §§ 120.569 and 120.57(1), Fla. Stat.
163022 . Petitioner, as the party asserting the affirmative of
1640the issue in this proceeding, has the burden of proof. Balino v.
1652DepÓt of HRS , 348 So. 2d 349 (Fla. 1st DCA 1977); DepÓt of Agric.
1666& Consumer Servs. v. Strickland , 262 So. 2d 893 (Fla. 1st DCA
16781972) . The level of proof is generally a preponderance of the
1690evidence. DepÓt of Banking & Fin. v. Osborne Stern & Co. ,
1701670 So. 2d 932 (Fla. 1996). See also Davis v. DepÓt of Child. &
1715Fam. Servs. , 160 So. 3d 854, 857 (Fla. 2015). Here, Petitioner
1726must prove by a preponderance of the evidence that its
1736application for an additional licensed facility should be
1744approved.
174523. Section 393.067 sets forth APDÓs responsibilities
1752regarding application procedures and provider qualifications.
1758Section 393.0673 provides considerations pertaining to the
1765denial, suspension, or revocation of a license. Section
1773393.0673(2) provides that the agency may deny an application for
1783licensure submitted pursuant to section 393.067, if the applicant
1792has failed to comply with the requ irements of c hapter 393 or the
1806rules applicable to the applicant. § 393.0673(2)(a) 3 ., Fla.
1816Stat.
181724. In Counts I - III and V, Petitioner violated rules
1828applicable to the applicant by failing to properly report L.L.Ós
1838commitments to a mental health service pursuant to the Baker Act.
1849Fla. Admin. Code R. 65G - 2.010(5)(b)7. and 65G - 2.010(5)( c ), ( d ) ,
1865and (e) .
186825. In Counts II - V, Petitioner violated rules applicable to
1879the applicant by failing to provide the level of supervision
1889necessary to ensure that residents are protected from harm and
1899that a safe and healthy living environment is created and
1909maintained. Fla. Admin. Code R. 65G - 2.009(3)(b) and 65G -
19202.009(6)(a) and (c).
192326. The evidence and testimony at hearing demonstrated that
1932Petitioner is unable to properl y supervise L.L . or ensure that
1944he has a safe living environment. Petitioner merely demands
1953that L.L. be arrested by police when ever L.L. has an outburst.
1965Police officers and an auto mechanic were better able to
1975calm L.L. than PetitionerÓs staff. Additi onally, Petitioner
1983does not have enough staff at the facility to provide a safe
1995working environment for PetitionerÓs employees.
200027. Petitioner failed to meet its burden of proving that it
2011can comply with the statutes and rules for operation of its
2022curren t facility in a safe and proper manner. The thought of
2034awarding Petitioner a license for an additional facility is
2043neither supported by the evidence nor sensible.
205028. Accordingly, considering the various statutory and rule
2058provisions cited above, APD was justified in denying PetitionerÓs
2067application for licensure of an additional facility.
2074RECOMMENDATION
2075Based on the foregoing Findings of Fact and Conclusions of
2085Law, it is RECOMMENDED that the Agency for Persons with
2095Disabilities enter a f inal o rder den ying PetitionerÓs application
2106for licensure.
