87STATEMENT OF THE CASE

91On August 9, 201 7 , Petitioner s , Lauren M. and Kristopher M.

103Shold, on behalf of and as parents and natur al guardian s of Amelia

117Ann Shold ( Amelia ), a minor, filed a Petition for Benefits

129pursuant to Florida Statute Section 766.301 et seq. (Petition)

138with the Division of Administrative Hearings (DOAH) for a

147determination of compensability under the Florida Bir th - Related

157Neurological Injury Compensation Plan ( the Plan). The Petition

166indicates in relevant part that the physician providing obstetric

175services , and who was present at the birth , w as Staci

186Tanouye, M.D., and that Amelia was delivered at Ba ptist Medi cal

198Center (Baptist) on August 11, 2015.

204DOAH served Baptist with a copy of the Petition on

214September 1 , 201 7 . Dr. Tanouye was served with a copy of the

228Petition on September 5, 2017, and NICA was served a copy of the

241Petition on September 13, 2017.

246On October 11 , 201 8 , NICA filed its Unopposed Motion for

257Summary Final Order on the issue of a birth - related neurological

269injury. Through its motion, NICA requested the entry of a s ummary

281f inal o rder determining that the claim is not compensable as a

294matter of law because Amelia did not suffer a birth - related

306neurological injury as defined by section 766.302(2), Florida

314Statutes , and denying the Petition for Benefits, with prejudice.

323STATEMENT OF THE ISSUE

327The issue in this case is whether Amelia Ann Shold s uffered a

340birth - related injury as defined by section 766.302(2), Florida

350Statutes, for which compensation should be awarded under the Plan.

360FINDINGS OF FACT

3631 . Amelia Ann Shold was born on August 11, 2015, at Baptist

376Medical Center South located at 800 Prudential Drive,

384Jacksonville, Florida 32207. The Petition alleged that the child

393Ðsuffered from brain damage as a result of a prolonged second

404stage labor.Ñ The circumstances of the labor, delivery , and birth

414of the minor child are reflected in the med ical records submitted

426to NICA in conjunction with the Petition.

4332 . At all times material, both Baptist and Dr. Tanouye were

445active members under NICA pursuant to section 766.302(6) and (7).

4553 . Petitioner s contend that Amelia suffered a birth - related

467neu rological injury and seek s compensation under the Plan.

477Respondent contends that Amelia has not suffered a birth - related

488neurological injury as defined by section 766.302(2).

4954 . In order for a claim to be compensable under the Plan,

508certain statutory req uisites must be met. Section 766.309

517provides:

518(1) The Administrative Law Judge shall make

525the following determinations based upon all

531available evidence:

533(a) Whether the injury claimed is a birth -

542related neurological injury. If the claimant

548has demon strated, to the satisfaction of the

556Administrative Law Judge, that the infant has

563sustained a brain or spinal cord injury

570caused by oxygen deprivation or mechanical

576injury and that the infant was thereby

583rendered permanently and substantially

587mentally and physically impaired, a

592rebuttable presumption shall arise that the

598injury is a birth - related neurological injury

606as defined in § 766.302(2).

611(b) Whether obstetrical services were

616delivered by a participating physician in the

623course of labor, delivery, or resuscitation

629in the immediate postdelivery period in a

636hospital; or by a certified nurse midwife in

644a teaching hospital supervised by a

650participating physician in the course of

656labor, delivery, or resuscitation in the

662immediate postdelivery period in a h ospital.

669* * *

672(c) How much compensation, if any, is

679awardable pursuant to § 766.31.

684(2) If the Administrative Law Judge

690determines that the injury alleged is not a

698birth - related neurological injury or that

705obstetrical services were not delivered by a

712participating physician at birth, she or he

719shall enter an order . . . .

727(Emphasis added).

7295. The term Ðbirth - related neurological injuryÑ is defined

739in s ection 766.302(2), Florida Statutes, as:

746[I] njury to the brain or spinal cord of a

756live infa nt weighing at least 2,500 grams for

766a single gestation or, in the case of a

775multiple gestation, a live infant weighing at

782least 2,000 grams at birth caused by oxygen

791deprivation or mechanical injury occurring in

797the course of labor, delivery, or

803resuscita tion in the immediate postdelivery

809period in a hospital, which renders the

816infant permanently and substantially mentally

821and physically impaired. This definition

826shall apply to live births only and shall not

835include disability or death caused by geneti c

843or congenital abnormality.

846(Emphasis added).

8486 . In the instant case, NICA has retained Laufey Y.

859Sigurdardottir , M.D. (Dr. Sigurdardottir ) , as its medical expert

868specializing in pediatric neurology.

8727 . Dr. Sigurdardottir reviewed the medical record s and

882conducted an in dependent medical examination (IME ) of the child

893on November 16, 2017. Dr. Sigurdardottir subsequently rendered a

902report and opined, in pertinent part, that:

909Summary: Patient is a 2 - year - old girl with

920history of neonatal focal seizur es and

927evidence of subdural and intraventricular

932hemorrhage along with several small foci of

939diffusion restriction in left frontal lobe

945after prolonged vaginal delivery. She has

951had a good developmental trajectory and

957currently exhibits mild right monopar esis and

964a mild expressive language delay.

969Substantial motor or mental delays are not

976noted.

977* * *

980In light of evidence presented I believe

987Amelia does not fulfill criteria of a

994substantial mental and physical impairment at

1000this time. I do not feel tha t Amelia should

1010be included in the NICA program.

10168 . A review of the file in this case reveals that there

1029have been no expert opinions filed that are contrary to the

1040opinion of Dr. Sigurdardottir . The opinion of Dr. Sigurdardottir

1050that Amelia d oes no t suffer from a substantial mental and

1062physical impairment at this time is credited.

1069CONCLUSIONS OF LAW

10729 . The Division of Administrative Hearings has jurisdiction

1081over the parties to and the subject matter of these proceedings.

1092§§ 766.301 - 766.316, Fla. Stat.

109810 . The Plan was established by the Legislature "for the

1109purpose of providing compensation, irrespective of fault, for

1117birth - related neurological injury claims" relating to births

1126occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

113711 . The injured infant, her or his personal representative,

1147parents, dependents, and next of kin may seek compensation under

1157the Plan by filing a claim for compensation with DOAH.

1167§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1175which administer s the Plan, has "45 days from the date of service

1188of a complete claim . . . in which to file a response to the

1203petition and to submit relevant written information relating to

1212the issue of whether the injury is a birth - related neurological

1224injury." § 766.3 05(4), Fla. Stat.

123012 . If NICA determines that the injury alleged in a claim

1242is a compensable brain - related neurological injury, it may award

1253compensation to the claimant, provided that the award is approved

1263by the Administrative Law Judge to whom the cla im has been

1275assigned. § 766.305(7), Fla. Stat. The Administrative Law Judge

1284must make the following determination based upon the available

1293evidence:

1294(a) Whether the injury claimed is a birth -

1303related neurological injury. If the claimant

1309has demonstrated , to the satisfaction of the

1316administrative law judge, that the infant has

1323sustained a brain or spinal cord injury

1330caused by oxygen deprivation or mechanical

1336injury and that the infant was thereby

1343rendered permanently and substantially

1347mentally and physica lly impaired, a

1353rebuttable presumption shall arise that the

1359injury is a birth - related neurological injury

1367as defined in s. 766.303(2).

1372(b) Whether obstetrical services were

1377delivered by a participating physician in the

1384course of labor, delivery, or resu scitation

1391in the immediate postdelivery period in a

1398hospital; or by a certified nurse midwife in

1406a teaching hospital supervised by a

1412participating physician in the course of

1418labor, delivery, or resuscitation in the

1424immediate postdelivery period in a hospit al.

1431§ 766.309(1), Fla. Stat. An award may be sustained only if the

1443Administrative Law Judge concludes that the "infant has sustained

1452a birth - related neurological injury and that obstetrical services

1462were delivered by a participating physician at birth."

1470§ 766.31(1), Fla. Stat.

147413 . The term "birth - related neurological injury" is defined

1485in section 766.302(2) as follows:

"1490Birth - related neurological injury" means

1496injury to the brain or spinal cord of a live

1506infant weighing at least 2,500 grams for a

1515sin gle gestation or, in the case of a

1524multiple gestation, a live infant weighing at

1531least 2,000 grams at birth caused by oxygen

1540deprivation or mechanical injury occurring in

1546the course of labor, delivery, or

1552resuscitation in the immediate postdelivery

1557period in a hospital, which renders the

1564infant permanently and substantially mentally

1569and physically impaired.

157214 . In the instant case, Petitioner s file d a claim alleging

1585that Amelia did sustain a birth - related neurological injury that

1596is compensable under the Plan. As the proponent of the issue of

1608compensability, the burden of proof is upon Petitioner s .

1618§ 766.309(1)(a), Fla. Stat.; see also Balino v. Dep't of HRS , 348

1630So. 2d 349, 350 (Fla. 1st DCA 1977)("[T]he burden of proof, apart

1643from statute, is on the party asserting the affirmative of an

1654issue before an administrative tribunal.").

166015 . Dr. Sigurdardottir 's opinion that Ð [ I ] n light of

1674evidence presented I believe Amelia does not fulfill criteria of

1684a substantial mental and physical impairment at this ti me. I do

1696not feel that Amelia should be included in the NICA program , " is

1708credited.

170916 . In order for a birth - related injury to be compensable

1722under the Plan, the injury must meet the definition of a birth -

1735related neurological injury and the injury must h ave caused both

1746permanent and substantial mental and physical impairment. Fla.

1754Birth - Related Neurological Injury Comp. Ass'n v. Div. of Admin.

1765Hearings , 686 So. 2d 1349 (Fla. 1997).

177217 . The evidence in this case reveals that there have been

1784no expert opi nions filed that are contrary to the opinion of

1796Dr. Sigurdardottir that Amelia does not have a substantial mental

1806or physical impairment acquired in the course of labor or

1816delivery. Thus, Amelia has not suffered a birth - related

1826neurological injury as def ined by section 766.302(2), and is

1836therefore not entitled to benefits under the Plan.

1844CONCLUSION

1845Based on the foregoing Findings of Fact and Conclusions of

1855Law, it is ORDERED that the Petition filed by Lauren M. and

1867Kristopher M. Shold, on behalf of and as parents and natura l

1879guardians of Amelia Ann Shold , a minor, is dismissed with

1889prejudice.
