55This cause came on for consideration upon a Motion for
65Summary Final Order filed by Respond ent, Florida Birth - Related
76Neurological Injury Compensation Association (NICA), on April 3,

85STATEMENT OF THE ISSUES
89On August 28, 2017, Petitioners, Gayla Lavender and Timothy
98Lavender, as parents and natural guardians of Timothy Ryan Edward
108Lavend er (Timothy) , a minor, filed a Petition for Benefits
118Pursuant to Florida Statute Section 776.301 et seq. (Petition)
127with the Division of Administrative Hearings (DOAH) for a
136determination of compensability under the Florida Birth - Related
145Neurological Injur y Compensation Plan (Plan). The Petition named
154Karen Bruder, M.D., as the physician who provided obstetric
163services for the birth of Timothy at Tampa General Hospital, in
174Tampa, Florida, on October 25, 2009.
180DOAH served a copy of the Petition to NICA on September 18,
1922017. Karen L. Bruder, M.D., was served with a copy of the
204Petition, and filed a Petition to Intervene on October 16, 2017.
215DOAH sent Tampa General Hospital a copy of the Petition via
226certified mail on September 15, 2017.
232On April 3, 201 8, NICA filed a Motion for Summary Final
244Order, requesting that a summary final order be entered finding
254that the claim was not compensable because Timothy did not meet
265the requisite minimum statutory birth weight as required by
274section 766.302, Florida St atutes. Neither Petitioner nor
282Intervenor Karen L. Bruder, M.D., filed a response to the Motion
293for Summary Final Order.
297FINDINGS OF FACT
3001. Timothy was bor n at Tampa General Hospital, in Tampa,
311Florida, on October 25, 2009. He was a single gestation.
3212. NICA attached t o its motion the affidavit of the
332Custodian of Records fo r Tampa General Hosp i tal, and nine pages
345of medical records for Timothy. The medical records show that
355TimothyÓs birth weight was less than 2,500 grams. Specifically,
365the recor ds show that his birth weight was 1,980 grams.
3773. A review of the file reveals that no contrary evidence
388was presented to dispute the medical records from Tampa General
398Hospital showing that TimothyÓs birth weight was less than 2,500
409grams.
410CONCLUSION S OF LAW
4144. DOAH has jurisdiction over the parties to and the
424subject matter of these proceedings. §§ 766.301 - 766.316, Fla.
434Stat.
4355. The Plan was established by the Legislature Ðfor the
445purpose of providing compensation, irrespective of fault , for
453birth - related neurological injury claimsÑ related to births
462occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
4736. The injured infant, her or his personal representative,
482parents, dependents, and next of kin may seek compensation under
492the Plan by filing a claim for compensation with DOAH.
502§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
510which administers the Plan, has Ð45 days from the date of service
522of a complete claim . . . in which to file a response to the
537petit ion and to submit relevant written information relating to
547the issue of whether the injury is a birth - related neurological
559injury.Ñ £ 766.305(4), Fla. Stat.
5647. NICA has determined that Petitioner does not have a
574claim that is compensable under the Plan and has filed a Motion
586for Summary Final Order, requesting that an order be entered
596finding that the claim is not compensable.
6038. In ruling on the motion, the administrative law judge
613must make the following determination based upon the availab le
623evidence:
624(a) Whether the injury claimed is a birth -
633related neurological injury. If the claimant
639has demonstrated, to the satisfaction of the
646administrative law judge, that the infant has
653sustained a brain or spinal cord injury
660caused by oxygen depri vation or mechanical
667injury and that the infant was thereby
674rendered permanently and substantially
678mentally and physically impaired, a
683rebuttable presumption shall arise that the
689injury is a birth - related neurological injury
697as defined in s. 766.302 (2).
703§ 766.309(1), Fla. Stat.
7079. The term Ðbirth - related neurological injuryÑ is defined
717in section 766.302(2) as follows:
722ÐBirth - related neurological injuryÑ means
728injury to the brain or spinal cord of a live
738infant weighing at least 2,500 grams for a
747single gestation or, in the case of a
755multiple gestation, a live infant weighing at
762least 2,000 grams at birth ca used by oxygen
772deprivation or mechanical injury occurring in
778the course of labor, delivery, or
784resuscitation in the immediate postdelivery
789period in a hospital, which renders the
796infant permanently and substantially mentally
801and physically impaired.
80410. The evidence, which is not refuted, established that
813Timothy was a single gestation and did not weigh at least 2,500
826grams at birth. Thus, Timothy did not sustain a birth - related
838neurological injury because he did not meet the minimum statutory
848weight as set forth in the definition of Ðbirth - related
859neurological injury,Ñ in section 766.302(2).
865CONCLUSION
866Based upon the foregoing Findings of Fact and Conclusions of
876Law, it is ORDERED that the Petition is dismissed with
886prejudice. 1 /
