105STATEMENT OF THE CASE
109On S eptember 22, 2017, Petitioners filed a Petition Pursuant
119to Florida Statute Section 766.301 et seq. (Petition) with the
129Division of Administrative Hearings (DOAH) for a determination of
138compensability under the Florida Birth - Related Neurological
146Injury Com pensation Plan (Plan). The Petition named John H.
156Marston, M.D., as the physician who provided obstetric services
165for the birth of Andrew G. Reid (Andrew) o n May 2, 2015,
178at St. JosephÓs WomenÓs Hospital in Tampa, Florida.
186DOAH served NICA with a copy of the Petition on or before
198October 23, 2017. Dr. Marston and St. JosephÓs WomenÓs Hospital
208w ere served with a copy of the Petition on or before October 27
222and November 16, 2017, respectively. On October 31, 2017,
231Dr. Marston Ós and St. JosephÓs Hospita l, Inc. , d/b/a St. JosephÓs
243WomenÓs Hospital Ós Petitions to Intervene were granted.
251On March 30, 2018, NICA filed its Response to Petition for
262Benefits, suggesting that the subject claim was not compensable
271and requesting a final hearing to address said i ssue. On
282April 2, 2018, the undersigned issued an O rder directing the
293parties to confer and advise whether a final hearing would be
304required. NICA filed a status report on April 12, 2018,
314representing that, following a telephonic conference with all
322cou nsel, none of the parties were requesting a final hearing.
333On April 27, 2018, NICA filed an Unopposed Motion for
343Summary Final Order, requesting that a summary final order be
353entered finding that the claim is not compensable because Andrew
363did not sustain a Ðbirth - related neurological injuryÑ as that
374term is defined in section 766.302(2), Florida Statutes , and
383dismissing the Petition. Said motion represents that Petitioners
391and Intervenors Ðtake no position on this motion.Ñ As noted
401above, Petitioners an d Intervenors did not file a response to the
413motion.
414FINDINGS OF FACT
4171. Andrew was born on May 2, 2015, at St. JosephÓs WomenÓs
429Hospital in Tampa, Florida.
4332. NICA retained Donald Willis, M.D., an obstetrician
441specializing in maternal - fetal medi cine, to review AndrewÓs
451medical records and opine as to whether there was an injury to his
464brain or spinal cord that occurred in the course of labor,
475delivery, or resuscitation in the immediate post - delivery period
485due to oxygen deprivation or mechanical injury.
4923. In a report dated November 26, 2017, Dr. Willis concluded
503the following:
505There was no obstetrical event that resulted
512in loss of oxygen or mechanical trauma to the
521babyÓs brain during labor or delivery.
527However, some oxygen deprivation was present
533during the immediate post - delivery period.
540Due to the essentially normal MRI report, I
548would prefer to have Pediatric Neurology
554discuss if any oxygen deprivation during the
561immediate post - delivery period resulted in
568brain injury.
5704. At tached to NICAÓs Unopposed Motion for Summary Final
580Order is the affidavit of Dr. Willis, dated April 23, 2018. In
592his affidavit, Dr. Willis opines, based on his education,
601training, and experience, and within a reasonable degree of
610m edical probability, t hat there was no obstetrical event that
621resulted in loss of oxygen or mechanical trauma to AndrewÓs brain
632during the labor or delivery; however, some oxygen deprivation
641was present during the immediate post - delivery period.
6505. NICA also retained La ufey Y. Sigurdardottir, M.D., a
660pediatric neurologist, to review AndrewÓs medical records, conduct
668an Independent Medical Examination (IME), and opine as to whether
678he suffers from a permanent and substantial mental and physical
688impairment as a result of a birth - related neurological injury.
699Dr. Sigurdardottir reviewed the available medical records,
706obtained a full historical account from Petitioners, and conducted
715an IME of Andrew on March 7, 2018.
7236. Dr. SigurdardottirÓs IME report provides, in pa rt, as
733follows:
734Summary: Patient is a 2 - year - old with
744history of neurologic depression at birth and
751laboratory measurements suggestive of
755asphyxia. Neonatal seizures were seen and
761multisystem derangements noted. Patient had
766hypotonia and required early intervention.
771H e has made remarkable recovery and now has
780mild delays in gross and fine motor skills
788along with an expressive language disorder.
7947. Dr. Sigurdardottir further concluded that, in review of
803the available records, there is evidence o f impairment consistent
813with a neurologic injury to the brain or spinal cord acquired due
825to oxygen deprivation, and that the neurologic injury was felt to
836be birth related. She further concluded that, at the time of the
848IME, Andrew d id not have substanti al delays in motor and mental
861abilities , and, therefore, does not fulfill the criteria of a
871substantial mental and physical impairment.
8768. RespondentÓs Unopposed Motion for Summary Final Order
884also relies upon the attached affidavit of Dr. Sigurdard ottir,
894dated April 17 , 2018. In her affidavit, she opines, based upon
905her education, training, and experience, and to a reasonable
914degree of medical probability, that Andrew Ðis not found to have
925substantial delays in motor and mental abilities at this ti me.Ñ
9369. A review of the file reveals that no contrary evidence
947was presented to refute the findings and opinions of Dr. Willis
958and Dr. Sigurdardottir. Their unrefuted opinions are credited.
966CONCLUSIONS OF LAW
96910. DOAH has jurisdiction over the pa rties to and the
980subject matter of these proceedings. §§ 766.301 - 766.316,
989Fla. Stat.
99111. The Plan was established by the Legislature "for the
1001purpose of providing compensation, irrespective of fault, for
1009birth - related neurological injury claims" relati ng to births
1019occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
103012. The injured infant, her or his personal representative,
1039parents, dependents, and next of kin may seek compensation under
1049the Plan by filing a claim for compensation with DOA H.
1060§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
1068which administers the Plan, has "45 days from the date of service
1080of a complete claim . . . in which to file a response to the
1095petition and to submit relevant written information relating to
1104the issue of whether the injury is a birth - related neurological
1116injury." § 766.305(4), Fla. Stat.
112113. NICA has determined that Petitioners do not have a
1131claim that is compensable under the Plan and has filed a n
1143unopposed Motion for Summary Final Order, requesting that an
1152order be entered finding that the claim is not compensable.
11621 4 . In ruling on the motion, the administrative law judge
1174must make the following determination based upon the available
1183evidence:
1184(a) Whether the injury claimed is a birth -
1193r elated neurological injury. If the claimant
1200has demonstrated, to the satisfaction of the
1207administrative law judge, that the infant has
1214sustained a brain or spinal cord injury
1221caused by oxygen deprivation or mechanical
1227injury and that the infant was thereb y
1235rendered permanently and substantially
1239mentally and physically impaired, a
1244rebuttable presumption shall arise that the
1250injury is a birth - related neurological injury
1258as defined in s. 766.303(2).
1263§ 766.309(1), Fla. Stat.
12671 5 . The term "birth - related ne urological injury" is defined
1280in section 766.302(2) as follows:
"1285Birth - related neurological injury" means
1291injury to the brain or spinal cord of a live
1301infant weighing at least 2,500 grams for a
1310single gestation or, in the case of a
1318multiple gestation, a l ive infant weighing at
1326least 2,000 grams at birth caused by oxygen
1335deprivation or mechanical injury occurring in
1341the course of labor, delivery, or
1347resuscitation in the immediate postdelivery
1352period in a hospital, which renders the
1359infant permanently and su bstantially mentally
1365and physically impaired.
13681 6 . The evidence establishe s that there was an obstetrical
1380event that resulted in loss of oxygen to AndrewÓs brain during
1391the immediate post - delivery period. The unrefuted evidence,
1400however, establishe s tha t Andrew did not sustain a permanent and
1412substantial mental and physical impairment. Thus, he did not
1421sustain a birth - related neurological injury as defined in
1431section 766.302(2), Florida Statutes, and, therefore, is not
1439eligible for benefits under the P lan.
1446CONCLUSION
1447Based on the foregoing Findings of Fact and Conclusions of
1457Law, it is ORDERED that the Petition is dismissed with prejudice.
1468DONE AND ORDERED this 9 th day of May , 2018 , in Tallahassee,
