80STATEMENT OF THE CASE

84On October 18, 2017, Petitioner filed a Petition for

93Benefits Pursuant to Florida Statute Section 766.301 et seq.

102(Petition) with the Division of Administrative H earings (DOA H)

112for a determination of compensability under the Florida Birth -

122Related Neurological Injury Compensation Plan (Plan). The

129Petition named Dr. Maria Martino and Dr. Krysta Fee as the

140physicians who provided obstetric services for the birth of

149Jaliyah Figue roa (Jaliyah) on March 7, 2017, at Lakeland Regional

160Medical Center in Lakeland, Florida. 1 /

167On October 24, 2017, DOAH mailed a copy of the Petition to

179NICA by certified mail. The certified receipt indicates the sam e

190was served on November 6, 2017. On O ctober 24, 2017 , DOAH mailed

203copies of the Petition by certified mail to Lakeland Regional

213Medical Center; Maria Martino, M.D.; Krysta Fee, ARNP ; and Maria

223Martino - Villan ueva, M.D. On November 29, 2017 , Lakeland Regional

234Health Systems, Inc.Ós Petition fo r Leave to Intervene was

247On January 16, 2018, NICA filed its Response to Petition for

258Benefits, suggesting that the subject claim was not compensable

267and requesting a final hearing to address said issue.

276Ultimately, Petitioner retained counsel on or before April 3,

2852018, and the parties proceeded with discovery. NICAÓs Motion

294was filed on September 4, 2018, requesting that a summary final

305order be entered finding that the claim is not compensable

315because Jaliyah did not sustain a Ðbirth - relate d neurological

326injuryÑ as that term is defined in section 766.302(2), Florida

336Statutes, and dismissing the Petition with prejudice. Said

344motion represents that Petitioner does not oppose the instant

353motion.

354FINDINGS OF FACT

3571. Jaliyah was born on Mar ch 7, 2017, at Lakeland Regional

369Medical Center.

3712. With respect to JaliyahÓs birth, obstetrical services

379were delivered by Maria Martino, M.D., a NICA participating

388physician, in the course of labor, delivery , or resuscitation in

398the immediate postdeli very period.

4033. NICA retained Donald Willis, M.D., an obstetrician

411specializing in maternal - fetal medicine, to review JaliyahÓs

420medical records and opine as to whether there was an injury to her

433brain or spinal cord that occurred in the course of l abor,

445delivery, or resuscitation in the immediate post - delivery period

455due to oxygen deprivation or mechanical injury. In his report and

466subsequent affidavit (attached to NICAÓs Motion), Dr. Willis

474opines that Ðthere was an obstetrical event that resulted in loss

485of oxygen to the babyÓs brain during labor, delivery and

495continuing into the immediate post deliver [sic] period. The

504oxygen deprivation resulted in brain injury.Ñ

5104. NICA also retained Laufey Y. Sigurdardottir, M.D., a

519pediatric neurolog ist, to review JaliyahÓs medical records,

527conduct an Independent Medical Examination (IME), and opine as to

537whether she suffers from a permanent and substantial mental and

547physical impairment as a result of a birth - related neurological

558injury. Dr. Sigurda rdottir reviewed the available medical

566records, obtained a full historical account from Petitioner, and

575conducted an IME of Jaliyah on December 13, 2017.

5845. Dr. SigurdardottirÓs affidavit, attached to NICAÓs

591Motion, provides in pertinent part, as f ollows:

599Based upon my education, training and

605experience, it is my professional opinion,

611within a reasonable degree of medical

617probability that although there is evidence of

624impairment consistent with a neurologic injury

630to the brain or spinal cord acquir ed due to

640oxygen deprivation or mechanical injury,

645Jaliyah is not found to have substantial

652delays in motor and mental abilities. Her

659prognosis for full motor and mental recovery

666is excellent and her life expectancy is full.

6746. A review of the fi le reveals that no contrary evidence

686was presented to refute the findings and opinions of Dr. Willis

697and Dr . Sigurdardottir. Their unrefuted opinions are credited.

706CONCLUSIONS OF LAW

7097. DOAH has jurisdiction over the parties to and the

719subject matter of these proceedings. §§ 766.301 - 766.316,

728Fla. Stat.

7308. The Plan was established by the Legislature "for the

740purpose of providing compensation, irrespective of fault, for

748birth - related neurological injury claims" relating to births

757occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

7689. The injured infant, her or his personal representative,

777parents, dependents, and next of kin may seek compensation under

787the Plan by filing a claim for compensation with DOAH.

797§§ 766.302(3), 766.303(2), and 7 66.305(1), Fla. Stat. NICA,

806which administers the Plan, has "45 days from the date of service

818of a complete claim . . . in which to file a response to the

833petition and to submit relevant written information relating to

842the issue of whether the injury is a birth - related neurological

854injury." § 766.305(4), Fla. Stat.

85910. NICA has determined that Petitioner does not have a

869claim that is compensable under the Plan and has filed the

880instant U nopposed Motion for Summary Final Order, requesting that

890an order be entered finding that the claim is not compensable.

90111. In ruling on the motion, the administrative law judge

911must make the following threshold determinations based upon the

920available evidence:

922(a) Whether the injury claimed is a birth -

931related neurolog ical injury. If the claimant

938has demonstrated, to the satisfaction of the

945administrative law judge, that the infant has

952sustained a brain or spinal cord injury

959caused by oxygen deprivation or mechanical

965injury and that the infant was thereby

972rendered perm anently and substantially

977mentally and physically impaired, a

982rebuttable presumption shall arise that the

988injury is a birth - related neurological injury

996as defined in s. 766.303(2).

1001(b) Whether obstetrical services were

1006delivered by a participating physi cian in the

1014course of labor, delivery, or resuscitation

1020in the immediate postdelivery period in a

1027hospital; or by a certified nurse midwife in

1035a teaching hospital supervised by a

1041participating physician in the course of

1047labor, delivery, or resuscitation in the

1053immediate postdelivery period in a hospital.

1059§ 766.309(1), Fla. Stat.

106312 . The term "birth - related neurological injury" is defined

1074in section 766.302(2) as follows:

"1079Birth - related neurological injury" means

1085injury to the brain or spinal cord of a live

1095infant weighing at least 2,500 grams for a

1104single gestation or, in the case of a

1112multiple gestation, a live infant weighing at

1119least 2,000 grams at birth caused by oxygen

1128deprivation or mechanical injury occurring in

1134the course of labor, delivery, or

1140resuscitation in the immediate postdelivery

1145period in a hospital, which renders the

1152infant permanently and substantially mentally

1157and physically impaired.

116013 . The evidence establishes that there was an obstetrical

1170event that resulted in loss of oxygen t o JaliyahÓs brain during

1182labor, delivery , and continuing into the immediate postdelivery

1190period, resulting in an injury to her brain. The evidence

1200further establishes that obstetrical services were delivered by a

1209participating physician , Dr. Martino, in t he course of labor,

1219delivery, or resuscitation in the immediate postdelivery period

1227in a hospital , Lakeland Regional Health. The unrefuted evidence,

1236however, establishes that Jaliyah did not sustain a permanent and

1246substantial mental and physical impairme nt. Thus, she did not

1256sustain a birth - related neurological injury as defined in

1266section 766.302(2), Florida Statutes, and, therefore, is not

1274eligible for benefits under the Plan.

1280CONCLUSION

1281Based on the foregoing Findings of Fact and Conclusions of

1291Law , it is ORDERED that the Petition is dismissed with prejudice.
