147PRELIMINARY STATEMENT
149By letter dated October 5, 2017, Respondent notified Felicia
158Whipple , as Owner/Operator of Miracles House, Inc. ( " Petitioner "
167or " Whipple " ) of Re spondent ' s intent to terminate Petitioner ' s
181Medicaid Waiver Services Agreement ( " MWSA " ) with cause.
190Dissatisfied with Respondent ' s decision, Petitioner challenged
198the termination and timely requested a formal hearing. On
207November 2, 2017, Respondent refe rred the case to the Division
218of Administrative Hearings ( " DOAH " ) for assignment of an
228administrative law judge to conduct the hearing. On January 16,
2382018, the formal hearing was held as scheduled.
246At the formal hearing, Whipple testified on her own beha lf
257but did not offer any evidentiary exhibits. Respondent presented
266the testimony of Cassandra Jenkins and Tom Rice. Respondent ' s
277Exhibits 1 through 3 and 8 were received into evidence.
287The proceedings of the hearing were recorded. On April 2,
2972018, the Transcript of the hearing was filed at DOAH.
307P etitioner did not file any post - hearing pleadings. Respondent
318filed a timely P roposed R ecommended O rder, which the undersigned
330has considered, as well as the testimony and exhibits presented
340at hearing, in t he preparation of this Recommended Order. The
351undersigned is prohibited from taking any new evidence after a
361hearing adjourns. Accordingly, the undersigned did not consider
369Respondent ' s e xhibits attached to Respondent ' s Proposed
380Recommended Order in deci ding this matter.

403FINDING S OF FACT
4071. The Agency for Health Care Administration ( " AHCA " ) is
418Florida ' s designated Medicaid agent pursuant to chapter 409,
428Florida Statut es. In that role, AHCA has delegated d uties with
440respect to the MWSA to Agency for Persons with Disabilities
450(" APD " or "Respondent") .
4562. APD ensures that Medicaid w aiver providers comply with
466applicable Medicaid rules. To ensure compliance, APD enters i nto
476a MWSA with providers to facilitate payment. AHCA pays the
486providers for services rendered according to the MWSA.
4943. On April 22, 2015, Petitioner entered into a MWSA with
505Respondent. As a qualified provider, the MWSA allowed Petitioner
514to perform s ervices for APD clients and get paid through the
526Medicaid program by reimbursement.
5304. Section I.B. of the MWSA provides:
537Prior to executing this Agreement and
543furnishing any waiver services, the Provider
549must have executed a Medicaid Provider
555Agreement with the Agency for Health Care
562Administration (AHCA), and be issued a
568Medicaid provider number by AHCA. The
574Provider must at all times during the term of
583this Agreement maintain a current and valid
590Medicaid Provider Agreement with AHCA, and
596comply with the terms and conditions of the
604Medicaid Provider Agreement.
6075. On or about August 3, 2017, AHCA terminated Petitioner ' s
619Medicaid Provider Agreement and notified Petitioner by letter
627that " Medicaid will no longer pay for claims for reimbursement
637for good s or services that you furnish. "
6456. APD investigated AHCA ' s termination and concluded that
655Petitioner did not comply with section I. B. of the MWSA that
667required P etitioner to maintain a current and valid Medicaid
677Provider Agreement with AHCA.
6817. On Oct ober 5, 2017, by letter , APD terminated
691Petitioner ' s MWSA pursuant to section III. B., which provides
702Petitioner ' s " agreement may be terminated for the Provider ' s
714unacceptable performance, non - performance or misconduct. " APD ' s
724letter detailed the basis for Petitioner ' s termination as
734follows:
735Provider ' s Medicaid Provider Number was
742terminated by the Agency for Health Care
749Administration (AHCA) on September 2, 2017.
755Therefore, the Provider is not performing in
762accordance with the MWSA, Section I., B.,
769which requires that " The Provider must at all
777times during the term of this Agreement,
784maintain a current and valid Medicaid
790Provider Agreement with AHCA, and comply with
797the terms and conditions of the Medicaid
804Provider Agreement .
8078. At hearing, Petitioner ad mitted that Respondent
815terminated the MWSA when APD became aware of ACHA ' s termination.
827Petitioner also acknowledged that Miracle s House , Inc., has been
837unable to bill since ACHA suspended its services, but Whipple is
848contesting ACHA ' s actions.
8539. On o r about October 27, 2017, Petitioner challenged
863APD ' s termination and timely requested a formal hearing.
873CONCLUSIONS OF LAW
87610. DOAH has jurisdiction over the subject matter of
885this proceeding and of the parties thereto pursuant to
894sections 120.569 and 12 0.57(1), Florida Statutes (2017).
90211. Petitioner lost its Medicaid provider authorization
909rights to furnish Medicaid services and receive Medicaid
917reimbursements from ACHA. Uncontested evidence at hearing
924demonstrated that Petitioner no longer met the MW SA ' s
935section I. B. after ACHA terminated Petitioner ' s Medicaid
945Provider Agreement. By Petitioner no longer being a Medicaid
954provider in good standing , APD properly sought termination of the
964MWSA according to section III.B. Accordingly, APD met its burden
974in this matter and demonstrated that Petitioner ' s MWSA should be
986terminated with cause.
989RECOMMENDATION
990Based upon the foregoing Findings of Fact and Conclusions of
1000Law, it is RECOMMENDED that the Agency for Persons with
1010Disabilities enter a final order terminating Petitioner ' s
1019Medicaid Waiver Services Agreement.
