73This cause came on for consideration upon a Motion for
83Summary Final Order filed by Respondent, Florida Birth - Related
93Neurological Injury Compensation Association (NICA), on April 9,
1012018.
102STATEMENT OF THE CASE
106On November 27, 2 017, Petitioners filed a Petition for
116Benefits Pursuant to Florida Statute Section 766.301 et seq.
125(Petition) with the Division of Administrative Hearings (DOAH)
133for the determination of compensability under the Florida Birth -
143Related Neurological Injury Co mpensation Plan (Plan). The
151Petition named Judette Louis, M.D., as the physician who provided
161obstetric services at the birth of Daisy Posada on December 1,
1722014, at Tampa General Hospital in Tampa, Florida.
180DOAH served Tampa General Hospital with a cop y of the
191Petition on December 8, 2017. NICA was served with a copy of the
204Petition on December 15, 2017. DOAH sent a copy of the Petition
216to Dr. Louis via certified mail on December 6, 2017.
226On December 21, 2017, Florida Health Sciences Center, Inc. ,
235d /b/a Tampa General HospitalÓs Petition for Leave to Intervene
245was granted. On January 10, 2018, University of South Florida
255Board of TrusteeÓs Motion to Intervene was granted.
263On February 12, 2018, NICA filed its Response to Petition
273for Benefits, sugges ting that the subject claim was not
283compensable and requesting that a hearing be scheduled to address
293such issue. On April 2, 2018, the undersigned issued an O rder
305directing the parties to confer and advi se whether a final
316hearing would be required. On A pril 9, 2018, Respondent filed a
328status report wherein it was represented that a telephonic
337conference had been conducted by counsel for all parties. Said
347filing further represented that none of the parties were
356requesting a final hearing and that neither Petitioners nor
365Intervenors take a position on NICAÓs anticipated Motion for
374Summary Final Order. On the same date, Respondent filed a Motion
385for Summary Final Order, requesting that a summary final order be
396entered finding that the claim was not compens able because Daisy
407Posada did not sustain a Ðbirth - related neurological injuryÑ as
418that term is defined in section 766.302(2), Florida Statutes.
427Neither Petitioners nor Intervenors filed a response.
434FINDINGS OF FACT
4371. Daisy Posada was born on December 1, 2014, at Tampa
448General Hospital in Tampa, Florida.
4532. Donald Willis, M.D., an obstetrician specializing in
461maternal - fetal medicine, was requested by NICA to review the
472medical records of Daisy Posada and to opine whether an injury
483occurred in the cour se of labor, delivery or resuscitation in the
495immediate post - delivery period at Tampa General due to oxygen
506deprivation or mechanical injury. In a report dated December 29,
5162017, Dr. Willis described his findings in pertinent part as
526follows:
527In summary, delivery was complicated by a
534significant shoulder dystocia, requiring
538multiple maneuvers to complete the delivery.
544The newborn was depressed with Apgar of 0/0.
552Full resuscitation was required. The newborn
558hospital course was complicated by multi -
565system organ failures. The initial ABG,
571which was done after resuscitation, had a pH
579of only 692. EEG was abnormal, but MRI was
588reported as normal.
591* * *
594There was an obstetrical event (shoulder
600dystocia) that resulted in loss of oxygen to
608the babyÓs brain during delivery and
614continuing into the immediate post delivery
620period. The oxygen deprivation resulted in
626at least some degree of brain injury
633initially, based on the abnormal EEG.
639However, the brain MRI was normal. There was
647no mechanical trauma or i njury to the spinal
656cord.
6573. Attached to RespondentÓs Motion for Summary Final Order
666is the affidavit of Dr. Willis, dated April 2, 2018. In his
678affidavit, Dr. Willis affirms the findings in his above - quoted
689report and maintains that his opinions are within a reasonable
699degree of medical probability.
7034. NICA also retained Michael S. Duchowny, M.D., a
712pediatric neurologist, to review Daisy PosadaÓs medical records
720and to conduct an Independent Medical Evaluation of her and to
731opine as to whet her she suffers from a permanent and substantial
743mental and physical impairment as a result of a birth - related
755neurological injury. Dr. Duchowny reviewed the medical records,
763obtained historical information from Ms. Arellano Benitez, and
771performed an eval uation on January 31, 2018.
7795. In a report authored after the neurological evaluation,
788Dr. Duchowny summarized his findings, in pertinent part, as
797follows:
798In SUMMMARY, DaisyÓs neurological examination
803today reveals no specific findings apart from
810very slight decreased supination of the left
817hand. She does not otherwise display left
824upper extremity weakness and has full range
831of motion. The examination reveals no
837functional compromise of the left upper
843extremity, and the remainder of the
849neurologi cal examination is unremarkable.
854* * *
857Despite a complicated perinatal course, Daisy
863has developed well - therapeutic hyperthermia
869may have contributed to her favorable outcome
876responsible [sic]. As there is no evidence
883of a substantial mental or motor impairment,
890I do not believe that Daisy should be
898considered for inclusion within the NICA
904program.
9056. RespondentÓs Motion for Summary Final Order also relies
914upon the attached affidavit from Dr. Duchowny, dated March 27,
9242018. In his affidavit, h e affirms the findings contained in his
936report and opines, based upon his education, training and
945experience, within a reasonable degree of medical probability,
953that Daisy Posada has not suffered a substantial mental or
963physical impairment.
9657. A re view of the file reveals that no contrary evidence
977was presented to dispute the findings and opinions of Dr. Willis
988and Dr. Duchowny. Their opinions are credited.
995CONCLUSIONS OF LAW
9988. DOAH has jurisdiction over the parties to and the
1008subject matter of these proceedings. §§ 766.301 - 766.316, Fla.
1018Stat.
10199. The Plan was established by the Legislature "for the
1029purpose of providing compensation, irrespective of fault, for
1037birth - related neurological injury claims" relating to births
1046occurring on or after Ja nuary 1, 1989. § 766.303(1), Fla. Stat.
105810. The injured infant, her or his personal representative,
1067parents, dependents, and next of kin may seek compensation under
1077the Plan by filing a claim for compensation with DOAH.
1087§§ 766.302(3), 766.303(2), and 76 6.305(1), Fla. Stat. NICA,
1096which administers the Plan, has "45 days from the date of service
1108of a complete claim . . . in which to file a response to the
1123petition and to submit relevant written information relating to
1132the issue of whether the injury is a birth - related neurological
1144injury." § 766.305(4), Fla. Stat.
114911. NICA has determined that Petitioners do not have a
1159claim that is compensable under the Plan and has filed a Motion
1171for Summary Final Order, requesting that an order be entered
1181finding tha t the claim is not compensable.
118912. In ruling on the motion, the administrative law judge
1199must make the following determination based upon the available
1208evidence:
1209(a) Whether the injury claimed is a birth -
1218related neurological injury. If the claimant
1224has demonstrated, to the satisfaction of the
1231administrative law judge, that the infant has
1238sustained a brain or spinal cord injury
1245caused by oxygen deprivation or mechanical
1251injury and that the infant was thereby
1258rendered permanently and substantially
1262mentall y and physically impaired, a
1268rebuttable presumption shall arise that the
1274injury is a birth - related neurological injury
1282as defined in s. 766.303(2).
1287§ 766.309(1), Fla. Stat.
129113. The term "birth - related neurological injury" is defined
1301in section 766.302 (2) as follows:
"1307Birth - related neurological injury" means
1313injury to the brain or spinal cord of a live
1323infant weighing at least 2,500 grams for a
1332single gestation or, in the case of a
1340multiple gestation, a live infant weighing at
1347least 2,000 grams at birt h caused by oxygen
1357deprivation or mechanical injury occurring in
1363the course of labor, delivery, or
1369resuscitation in the immediate postdelivery
1374period in a hospital, which renders the
1381infant permanently and substantially mentally
1386and physically impaired.
138914. The evidence establishes that there was an obstetrical
1398event that resulted in loss of oxygen to Daisy PosadaÓs brain
1409during labor, delivery, or the immediate post - delivery period.
1419The evidence further establishes, however, that Daisy Posada did
1428not s ustain a permanent and substantial mental impairment. Thus,
1438Daisy Posada did not sustain a birth - related neurological injury
1449as defined in section 766.302(2), Florida Statutes, and,
1457therefore, is not eligible for benefits under the Plan.
1466CONCLUSION
1467Base d upon the foregoing Findings of Fact and Conclusions of
1478Law, it is ORDERED that the Petition is dismissed with prejudice.
1489DONE AND ORDERED this 24th day of April , 2018 , in
