48This case is before the administrative law judge to consider
58the Unopposed Motion for Summary Final Order (Motion) filed
67March 4, 20 19, by Respondent, Florida Birth - Related Neurological
78Injury Compensation Association (NICA) . The Motion relies on the
88affidavits and reports of Donald C. Willis, M.D., and Laufey Y.
99Sigurdardottir, M.D . The time authorized pursuant to Florida
108Administra tive Code Rule 28 - 106.204 to respon d to the Motion has
122passed, with no responses being filed, and the case is ripe for
134consideration.
135STATEMENT OF THE ISSUES
139The issue s to be determined are whether Eliana Ricketts
149(Eliana) suffered a birth - related neurolog ical injury ; and , if
160so, whether that injury renders the infant permanently and
169substantially mentally and physically impaired , as provided by
177section 766.302(2), Florida Statutes (2016) .
183PRELIMINARY STATEMENT
185On January 8, 2018, Petitioners filed a Peti tion for
195Determination of NICA Coverage Filed Under Protest with the
204Division of Administrative Hearings (Division) , for a
211determination of compensability under the Florida Birth - Related
220Neurological Injury Compensation Plan (Plan). The Petition named
228Eri ka D. Glas, D.O., as the physician who provided obstetrical
239services at ElianaÓs birth on September 16, 2017 , 1/ at Southern
250Baptist Hospital of Florida, Inc., d/b/a Baptist Medical Center
259Jacksonville (Baptist Hospital ).
263On January 19, 2018, the Division m ailed a copy of the
275Petition to NICA, Dr. Glas, and Baptist Hospital by certified
285mail. All three were served on January 22, 2018.
294After receiving an extension of time for filing a response,
304on April 26, 2018, NICA filed a Response to Petition for Benefit s
317indicating its position that ElianaÓs injury was not compensable
326under the Plan. That same day, an Order was issued instructing
337the parties to notify the administrative law judge whether a
347hearing was necessary ; and , if so, appropriate dates upon which
357to conduct the hearing.
361Petitioners requested and received an extension of time in
370which to respond to the Order, because their experts had not had
382sufficient time to review NICAÓs expert reports . On May 25,
3932018, Baptist Hospital filed a Petition for Lea ve to Intervene,
404which was granted by Order dated May 31, 2018. Baptist Hospital
415also requested and received an extension of time to file a
426response regarding the need for a hearing. On July 30, 2018, the
438parties filed a Joint Response to Order Requiring Dates for
448Hearing, and based upon their response, the matter was scheduled
458for hearing to commence April 25, 2019. 2/
466On February 1, 2019, Baptist Hospital filed a Notice of
476Voluntary Withdrawal of Intervention with Prejudice, advising
483that it had determin ed not to take any position on the issue of
497compensability . Finally, on March 4, 2019, NICA filed an
507Unopposed Motion for Summary Final Order. NICA advised that
516Petitioners do not intend to challenge NICAÓs determination on
525compensability, and requested that a s ummary f inal o rder be
537issued determining that the claim is not compensable. The Motion
547relies on the reports and affidavits of Donald C. Willis , M.D.,
558and Laufey Y. Sigurdardottir , M.D.
563FINDINGS OF FACT
5661. Eliana was born on September 16, 2017, a t Baptist
577Hospital , a licensed hospital in Jacksonville, Florida.
5842. Eliana was a child born of a single gestation, weighing
5953,595 grams.
5983. NICA retained Donald C. Willis, M.D., an obstetrician
607specializing in maternal - fetal medicine, to review the medi cal
618records of Eliana and her mother, Michelle Ricketts. NICA asked
628Dr. Willis to provide an opinion as to whether there was a brain
641or spinal cord injury to Eliana , due to either oxygen deprivation
652or mechanical injury that occurred in the course of labo r,
663delivery, or resuscitation in the immediate postdelivery period
671in the hospital.
6744 . Dr. Willis authored a report to NICA on February 20,
6862018, which is incorporated into his affidavit dated March 7,
6962019 . In his report, Dr. Willis stated in part:
706The mother, Michelle Ricketts [had] . . . no
715significant prenatal problems. She was
720admitted to the hospital at term in labor.
728Her cervix was d i lated 4 cms on admission.
738The fetal heart rate (FHR) monitor tracing
745during labor was available for review. The
752b aseline heart rate was normal at 140 bpm
761with normal v ariabi lity. A decrease in FHR
770variability developed about 3 hours prior to
777delivery. Variable FHR decelerations started
782about 30 minutes prior to delivery. Cervical
789dilat ion was complete.
793Vacuum ext ractor was applied to assist
800vaginal delivery due to FHR decelerations and
807maternal fatigue. Delivery of the fetal head
814occurred after three pulls with one pop - off.
823Delivery was then complicated by a shoulder
830dystocia, lasting 4 minute 40 seconds. Birth
837weight was 3,595 grams.
842The newborn was depressed with Apgar scores
849of 3/5. Umbilical cord blood gas was not
857done. There was no respiratory effort at
864birth. Intubation was required and the baby
871transferred to the NICU. Chest X - R ay showed
881no infiltrat es. Hypoxic ischemic
886encephalopathy (HIE) was suspected and head
892cooling protocol initiated.
895There was a large subgaleal hematoma. The
902scalp was boggy with swelling behind the
909ears. The subgaleal hemorrhage resulted in
915anemia with a Hct of 27% to 28%. Blood
924transfusion was required. DIC was also
930present. The platelet count dropped to
93684,000 with fibr inogen levels of 166 to
945110 and prolonged PT and PTT.
951Cryoprecipitate and platelet transfusions
955were given.
957Seizures began shortly after birth. Arteri al
964blood gas (ABG) at one hour after birth had a
974pH of 7.23 and a base excess of - 17. ABG 4
986hours later had a pH of only 7.14 and a base
997excess remaining at - 17. The initial EEG was
1006abnormal, confirming seizure activity.
1010Follow - up EEG on DOL [day of lif e] 3 was
1022consistent with diffuse cerebral dysfunction.
1027MRI on DOL 5 showed extensive bilateral
1034infarctions, consistent with Ðsignificant
1038anoxic injuryÑ and extensive scalp swelling.
1044* * *
1047There was an obstetrical event that resulted
1054in loss of oxyge n to the babyÓs brain during
1064delivery and continuing into the immediate
1070post delivery period. The oxygen deprivation
1076resulted in brain injury. I am not able to
1085comment about the severity of the injury.
10925 . ElianaÓs medical records were also reviewed by Laufey
1102Sigurdardottir , M.D., a board - certified pediatric neurologist at
1111Nemours ChildrenÓ s Hospital. Dr. Sigurdardottir examined Eliana
1119when she was just short of seven months old. Included in the
1131records she reviewed were records of a neurological follo w - up at
1144four months with another neurologist , which state in part :
1154[Four] month old girl with history of HIE and
1163subsequent seizures that have since resolved.
1169Over all , Eliana has tolerated Phenobarbital
1175without side effects. Her most recent EEG
1182(12/5/17 ) was normal. She has not had any
1191clinical events concerning for seizures. She
1197is currently on track with milestones
1203(tracking, rolling, cooing, etc.) and
1208physical exam is notable for the absence of
1216any focal features and normal tone. She
1223previously tes ted out of ÒEarly StepsÓ as
1231there were no motor concerns from that
1238perspective.
12396 . As a result of her own examination of the infant,
1251Dr. Sigurdardottir found Eliana upon examination to be alert,
1260interactive, with what appeared to be normal development. She
1269also found that she had a strong grasp with both hands
1280bilaterally, and had normal response on vertical and horizontal
1289suspension. She stated in summary:
1294Patient is a 6 month old with history of
1303Brachial plexus injury during complicated
1308vaginal deli very as well as hypoxic ischemic
1316event, resulting in a moderate to severe
1323hypoxic ischemic encephalopathy. She had
1328refractory neonatal seizures, evidence of
1333acute ischemic injury on brain MRI and
1340abnormal neurological exam in neonatal
1345period. She has dev eloped acquired
1351microcephaly but has made remarkable
1356neurologic recovery and is close to being age
1364appropriate for her motor milestones at this
1371time.
13727 . Dr. Sigurdardottir opined that while Eliana did suffer a
1383neurological i njury to the brain due to oxyg en deprivation during
1395labor and delivery, she did not find permanent and substantial
1405delays in motor and mental abilities, and, at the time of the
1417examination, did not fulfill the criteria of having permanent and
1427substantial mental and physical impairment.
14328 . The opinions of Dr s . Willis and Sigurdardottir , which
1444are unrebutted, are credited. It is found that Eliana suffered
1454from oxygen deprivation during delivery and into the immediate
1463postdelivery period, which caused a brain injury.
14709 . While Dr. Will is determined that there was a brain
1482injury at birth, he did not comment on the severity of the
1494injury. Dr. Sigurdardottir , however, opined , and it is found ,
1503that the injury did not result in a permanent and substantial
1514physical and mental impairment.
1518CON CLUSIONS OF LAW
152210 . The Division has jurisdiction over the parties to and
1533the subject matter of these proceedings. §§ 766.301 - 766.316,
1543Fla. Stat.
15451 1 . The Plan was established by the Legislature Ðfor the
1557purpose of providing compensation, irrespective of fault, for
1565birth - related neurological injury claimsÑ related to births
1574occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
15851 2 . An injured infant, his or her personal representative,
1596parents, dependents, and next of kin may seek compensation under
1606the Plan by filing a claim for compensation with the Division .
1618§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat.
1625Section 766.305(4) provides that NICA, which administers the
1633Plan, has 45 days from the date that a complete claim is served
1646to fil e a response to the petition and to submit relevant written
1659information relating to the issue of whether the injury is a
1670birth - related neurological injury.
16751 3 . If NICA determines that the alleged injury is a
1687birth - related neurological injury that is comp ensable under the
1698Plan, it may award compensation to the claimant, provided that
1708the award is approved by the assigned administrative law judge.
1718§ 766.305(7), Fla. Stat. However, if NICA disputes the claim as
1729it does in this case, the dispute must be res olved by the
1742administrative law judge in accordance with chapter 120, Florida
1751Statutes. §§ 766.304, 766.30, and 766.31, Fla. Stat.
17591 4 . The first inquiry is whether the infant has sustained a
1772birth - related neurological injury as defined by section
1781766.302 (2), which provides:
1785(2) ÐBirth - related neurological injuryÑ
1791means injury to the brain or spinal cord of a
1801live infant weighing at least 2,500 grams for
1810a single gestation or, in the case of a
1819multiple gestation, a live infant weighing at
1826least 2,000 gram s at birth caused by oxygen
1836deprivation or mechanical injury occurring in
1842the course of labor, delivery, or
1848resuscitation in the immediate postdelivery
1853period in a hospital, which renders the
1860infant permanently and substantially mentally
1865and physically imp aired. This definition
1871shall apply to live births only and shall not
1880include disability or death caused by genetic
1887or congenital abnormality.
18901 5 . If the administrative law judge determines that the
1901infant has sustained a brain or spinal cord injury caus ed by
1913oxygen deprivation or mechanical injury, and that as a result the
1924infant was rendered permanently and substantially mentally and
1932physically impaired, then section 766.309(1) provides that there
1940is a rebuttable presumption that the injury is a birth - r elated
1953neurological injury. The presumption requires evidence of both
1961the injury and the impairments as a result of that injury.
19721 6 . In this case, the evidence does not support such a
1985presumption. The undisputed evidence presented indicates that
1992there w as an injury to ElianaÓs brain or spinal cord that was
2005caused by oxygen deprivation occurring in the course of labor,
2015delivery, and into the immediate postdelivery period.
20221 7 . However, the evidence presented indicates that the
2032injury suffered at birth d id not render Eliana to be permanently
2044and substantially mentally and physically impaired.
20501 8 . Based upon the affidavits and opinions of Drs. Willis
2062and Sigurdardottir , Eliana did not sustain a birth - related
2072neurological injury as defined in section 766 .302(2) and is not
2083eligible for benefits under the Plan.
2089CONCLUSION
2090Based on the foregoing, Findings of Fact and Conclusions of
2100Law, it is ORDERED that RespondentÓs Motion for Summary Final
2110Order on the issue of a birth - related neurological injury is
2122grant ed, and Petitioners Ó claim is found and determined not to be
2135compensable. The Petition is dismissed with prejudice.
2142DONE AND ORDERED this 1 5 th day of March , 2019 , in

2228as opposed to 2017, but refers to the obstetrical records as
2239being from 2017. All of the records submitted indicate that
2249Eliana was born in 2017, not 2007.
22562/ The hearing was scheduled several months in advance because of
2267ElianaÓs age at the time of her evaluation by Dr. Sigurdardottir .
2279The delay would give the parties an opportunity for a
2289re - evaluation to see if there was any change in age - related
2303benchmarks. Given the partiesÓ decision not to contest NICAÓs
2312determination that the claim was not compensable, no
2320re - evaluation became necessary.
