127STATEMENT OF THE ISSUE
131The issue is whether Petitioner properly issued a Stop - Work
142Order and Amended Order of Penalty Assessment against Respondent
151for failing to obtain workers ' compensation insurance that meets
161the requirements of chapter 440, Florida Statutes.
168PRELIMINARY STATEMENT
170On Aug ust 21, 2017, the Department of Financial Services,
180Division of Workers ' Compensation ( " Division " or " Petitioner " ) ,
190issued and served a Stop - Work Order and Order of Penalty
202Assessment on Grandview Gardens Bed and Breakfast, Inc.
210( " Grandview " or " Respondent " ), alleging that Respondent was not in
221compliance with the coverage requirements of chapter 440. An
230Amended Order of Penalty Assessment was issued on November 27,
2402017.
241On or about December 18, 2017 , Respondent challenged the
250Stop - Work Order and A mended Order of Penalty A ssessment and
263requested a formal hearing on the matter by p etition. The
274p etition was transferred to the Division of Administrative
283Hearings on February 7, 2018 , for assignment of an Administrative
293Law Judge to conduct the hearing.
299At hea ring, Respondent presented the testimony of four
308witnesses : Heinrich Rose ; Peter Emmerich ; Jay Montgomery ; and
317Jan Weimer. Respondent ' s Exhibits 1 through 6 were admitted into
329evidence. The Division presented the testimony of two witnesses:
338Jose Lopez , former compliance investigator and curr ent District II
348Workers ' Compensation Administrator ; and Eunika Jackson , penalty
356auditor. Petitioner ' s Exhibits 1 through 1 3 were received into
368evidence.
369The proceedings were transcribed, and the parties availed
377th emselves of the right to submit proposed recommended orders.
387The one - volume Transcript of the final hearing was filed with the
400Division of Administrative Hearings on August 23, 2018 .
409Petitioner and Respondent timely filed proposed recommended orders
417by t he deadline , which have been considered in the preparation of
429this Recommended Order.
432The parties stipulated to facts in the joint pre - hearing
443s tipulation, and the relevant facts stipulated therein are
452accepted and made part of the Findings of Fact below. Unless
463otherwise noted, all statutory referen ces are to the Florida
473Statutes ( 2017 ) .
478FINDING S OF FACT
4821. The Division is a component of the Department of
492Financial Services. It is responsible for enforcing the workers '
502compensation coverage requirement s pursuant to section 440.107.
5102. At all times relevant to this proceeding, Grandview was
520a corporation registered to do business in Florida.
5283. Grandview is a bread and breakfast and was an active
539company during the two - year a udit period from August 22, 2015,
552through August 21, 2017.
5564. On July 19 , 2017, 1/ Respondent met with a Henderson
567Insurance agent and learned that Respondent was not in compliance
577with the workers ' compensation requirements. Grandview
584immediately requested bids to obtain insuranc e , but did not
594purchase a policy because it was decided that it was " not the
606right time. "
6085. On August 21, 2017, Robert Feehrer ( " investigator " or
" 618Feehrer " ), compliance investigator for the Division, started a n
628investigation of Grandview . Feehrer discov ered that Grandview
637did not have any workers ' compensation policies, employee leasing
647agreements, or exemptions on file with the National Council on
657Compensation Insurance.
6596. That same day the Division issued Grandview a Stop - Work
671Order for Respondent ' s failure to secure the required workers '
683compensation insurance coverage.
6867. Petitioner also served Grandview with a Request for
695Production of Business Records for Penalty Assessment Calculation
703( " Request " ) asking for documentation to enable the Division to
714evaluate the payroll for the audit period of A ugust 22, 2015,
726through August 21, 2017, and to determine Respondent ' s compliance
737with the Workers ' Compensation Law of Florida.
7458. Grandview responded timely and provided sufficient
752business records in r esponse to the Division ' s Request .
7649. Eunika Jackson ( " auditor " or " Jackson " ), penalty auditor
774for the Division, was assigned to Grandview ' s investigation.
784Jackson reviewed the business records produced by Grandview .
79310. Jackson concluded her audit b y properly calculating the
803workers ' compensation amount owed by Grandview for the audit
813period using the Class Code 9052 for lodging facilities . Jackson
824applied the approved manual rates and methodology specified in
833section 44 0 .107(7)(d).
83711. Grandview had a t least four employees 2 / during the audit
850period and did not have any exemptions from workers ' compensation
861insurance coverage requirements during the audit period.
86812. Initially, Jackson calculated Grandview ' s penalty
876amount as being over $25,000. 00.
88313. After Grandview timely provided sufficient business
890records in response to the Request, Jackson correctly applied the
900penalty reduction credit to the calculation and concluded
908Grandview owed a reduced penalty amount of $13, 755.55.
91714. On Novembe r 27, 2017, Respondent was served with the
928Amended Order of Penalty Assessment totaling $13,755.55.
93615. On December 18, 2017, Respondent challenged the penalty
945assessment and requested a formal hearing.
951CONCLUSIONS OF LAW
95416. The Division of Administra tive Hearings has
962jurisdiction over the subject matter of this proceeding and the
972parties thereto pursuant to section 120.569 and 1 20.57(1),
981Florida Statutes (2018 ).
98517. Chapter 440 is known as the Workers' Compensation Law.
995Section 440.38(1) mandates th at employers secure payment of
1004workers' compensation for their employees.
100918. " Employer" is defined, in part, as "every person
1018carrying on any employment." § 440.02(16)(a), Fla. Stat. "If
1027the employer is a corporation, parties in actual control of the
1038c orporation, including, but not limited to the president,
1047officers who exercise broad corporate powers who . . . directly
1058or indirectly own a controlling interest in the corporation, are
1068considered the employer for the purposes of ss. 440.105, 440.106,
1078and 440.107." § 440.02(16)(a), Fla. Stat.
108419. "Employee" is defined, in part, as "any person who
1094receives remuneration from an employer for the performance of any
1104work or service while engaged in any employment under any
1114appointment or contract for hire or a pprenticeship, express or
1124implied, oral or written." § 440.02(15)(a), Fla. Stat.
113220. Because an administrative fine deprives the person
1140fined of substantial rights in property, such fines are punitive
1150in nature. Petitioner has the burden of proof and mu st establish
1162through clear and convincing evidence that Respondent violated
1170the workers' compensation law. Dep't of Banking & Fin., Div. of
1181Sec. and Investor Prot. v. Osborne Stern, Inc . , 670 So. 2d 932
1194(Fla. 1996).
119621. It is unfortunate that Respondent did not obtain
1205workers ' compensation after soliciting a quote for insurance in
1215July 2017 . However, Florida law does not provide any exceptions
1226for unknowingly going into non - compliance as Respondent contends
1236in its proposed recommended o rder.
124222. Instea d, t he greater weight of the evidence
1252demonstrates that Respondent employed at least four employees and
1261that Respondent was engaged in the lodging industry in Florida
1271during the audit period of August 2 2 , 201 5 , through August 2 1 ,
1285201 7 . Additionally, the r ecord shows Respondent failed to carry
1297workers' compensation insurance for its employees as required by
1306Florida's Workers' Compensation Law for the audit period.
1314Therefore, Petitioner met its burden in this matter and the
1324record is clear that Respondent ow es a total penalty amount of
1336$ 13,755.55 for failing to secure the payment of workers'
1347compensation insurance for its em ployees in violation of
1356chapter 440.
1358RECOMMENDATION
1359Based on the forgoing Findings of Fact and Conclusions of
1369Law, it is
1372RECOMMENDED tha t the Department of Financial Services,
1380Division of Workers' Compensation, issue a final order affirming
1389the Stop - Work Order and Amended Order of Penalty Assessment in
1401the amount of $ 13,755.55 .
