34Pursuant to notice to all parties , a final hearing was
44conducted in this case on March 26, 2018, in Jacksonville ,
54Florida, before Administrative Law Judge R. Bruce McKibben of

105STATEMENT OF THE ISSUE
109The issue in this case is whether just cause exists for
120Petitioner, Department of Children and Families (ÐDCFÑ or the
129ÐDepartmentÑ), to impose sanctions against Respondent, Terri
136Hall , d/b/a Children of Liberty Child Care Center .
145PRELIMINARY STATEMENT
147T h e Department issued an Administrative Complaint dated
156on or about January 8, 2018 , pro posing a monetary fine of
168$ 2 00 against Respondent . Respondent timely filed a request for
180formal administrative hearing to contest the DepartmentÓs
187decision. The final h earing was scheduled on a date provided by
199the Department in its Unilateral Response to Initial Order.
208At the final hearing, the Department did not make an
218appearance . Respondent was in attendance. The undersigned
226verified with his administrative assista nt that no one from the
237Department had notified DOAH concerning attendance at final
245hearing. After a sufficient amount of time, the undersigned
254commenced the final hearing and, absent any evidence from the
264Department, closed the hearing.
268FINDINGS OF FACT
2711 . The Department did not provide any evidence to support
282the allegations set forth in the Administrative Complaint.
2902 . Respondent, Terri Hall, introduced herself to the
299Administrative Law Judge.
302CONCLUSIONS OF LAW
3053 . The Division of Administrative Hearings has
313jurisdiction over this matter pursuant to section 120.57,
321Florida Statutes. Unless specifically stated otherwise herein,
328all references to Florida Statutes will be to the 2016
338codification.
3394 . In cases where a state agency alleges that a lic ensee
352engaged in wrongdoing, the burden is on the Department to prove
363the wrongdoing. DepÓ t of Banking and Fin . v. Osborne Stern and
376Co. , 670 So. 2d 932, 934 (Fla. 1996).
3845 . The standard of proof in this case is clear and
396convincing evidence because th e Department is seeking to
405discipline Respondent and take action detrimental to it s
414license, thus making the matter penal in nature. Ferris v.
424Turlington , 510 So. 2d 292 (Fla. 1987).
4316 . The Department did not satisfy its burden.
440RECOMMENDATION
441Upon co nsideration of the foregoing , it is RECOMMENDED that
451a final order be entered by Respondent, Department of Children
461and Families , dismissing the Administrative Complaint against
468Respondent, Terri Hall , d/b/a Children of Liberty Child Care
477Center .
