88STATEMENT OF THE CASE

92On February 9, 2018 , Jorge Moreno and Griselda Torres, on

102behalf of and as parents and natural guardians of Andy Moreno

113(ÐAndyÑ) , a minor, filed a Petition for Benefits Pursuant to

123Florida Statute Section 766.301 et seq. (ÐPetitionÑ) , with the

132Division of Administrative Hearings (ÐDOAHÑ) for the determination

140of compensability under the Florida Birt h - Related Neurological

150Injury Compensation Plan ( the ÐPlanÑ).

156The Petition identified Alyssa J. Brown , M.D., as the

165physician who provided obstetric services at the birth of Andy on

176November 2, 2015 , at Tampa General Hospital (Ð Tampa General Ñ) in

188Tampa , Florida.

190DOAH served Dr. Brown with a copy of the Petition on

201February 28, 2018, and served Tampa General that same date. NICA

212was also served with a copy of the Petition on February 28 , 2018.

225University of South Florida Board of Trustees , on behalf of

235Tampa General, moved to intervene in this matter on April 12 ,

2462018, which was granted.

250On May 15 , 2018, NICA filed its response to the Petition,

261taking the position that PetitionerÓs claim is not compensable

270under the Plan. NICA requested that DOAH schedu le a hearing to

282determine compensability. After several extensions, the final

289hearing was set for March 27, 2019, then rescheduled for May 23,

3012019.

302On March 28 , 2019, NICA filed an Unopposed Motion for Summary

313Final Order, requesting the Administrative Law Judge enter a

322summary final order finding that the claim is not compensable

332under the NICA statute because Andy did not suffer a Ðbirth -

344related neurological injuryÑ as defined in section 766.302(2),

352Florida Statutes.

354FINDINGS OF FACT

3571. Andy was born on November 2, 2015, at Tampa General

368located in Tampa, Florida.

3722. Based on the available evidence, Alyssa J. Brown , M.D.,

382was the delivering physician for Andy Ós birth. Dr. Brown was a

394Ðparticipating physicianÑ under the Plan at the time Andy was

404born . See § 766.302(7), Fla. Stat.

4113. Upon receiving the Petition, NICA retained Donald

419Willis, M.D., a board - certified obstetrician/gynecologist

426specializing in maternal - fetal medicine, as well as Laufey Y.

437Sigurdardottir, M.D., a pediatric neurologist, to review Andy Ós

446medical condition. NICA sought to determine whether Andy

454suffered a Ðbirth - related neurological injuryÑ as defined in

464section 766.302(2). Specifically, NICA requested its medical

471experts opine whether Andy experienced an injury to the brain or

482spinal cord caused by oxygen deprivation or mechanical injury

491occurr ing in the course of labor, delivery, or resuscitation in

502the immediate post - delivery period; a nd, if so, whether this

514injury rendered Andy permanently and substantially mentally and

522p hysically impaired.

5254. Dr. Willis reviewed AndyÓs medical records and described

534AndyÓs birth as follows :

539[V]acuum assisted vaginal delivery at term

545resulted in a newborn with normal Apgar

552scores and a normal umbilical cord blood gas.

560[Andy] did not requi re resuscitation.

5665. Dr. Willis then opined:

571There was no apparent obstetrical event that

578would have resulted in loss of oxygen or

586mechanical trauma to the babyÓs brain during

593labor, delivery or the immediate post

599delivery period.

6016 . Dr. Sigurdardott ir also reviewed Andy Ós medical records,

612as well as conducted an independent medical exam of Andy on

623May 2 , 2018. Dr. Sigurdardottir commented that ÐAndy is found to

634have substantial delays in motor and mental abilities. . . .

645[T]here is no evidence o f impairment consistent with a neurologic

656injury to the brain or spinal cord acquired due to oxygen

667deprivation or mechanical injury.Ñ Dr. Sigurdardottir further

674opined :

676In light of evidence presented , I believe

683Andy does fulfill criteria of a substantial

690mental and physical impairment at this time ,

697but it is likely due to a genetic condition

706and not to be from birth related injury . I

716do not feel that Andy should be included in

725the NICA program.

7287 . A review of the file reveals no contrary evidence to

740di spute the findings and opinions of Dr. Willis and

750Dr. Sigurdardottir . Their opinions are credible and persuasive.

7598 . Based on the opinions and conclusions of Dr. Willis and

771Dr. Sigurdardottir, NICA determined that PetitionerÓs claim was

779not compensable. NICA subsequently filed the Unopposed Motion

787for Summary Final Order asserting that Andy has not suffered a

798Ðbirth - related neurological injuryÑ as defined by section

807766.302(2). Petitioners do not oppose NICAÓs motion.

814CONCLUSIONS OF LAW

8179 . The Divisio n of Administrative Hearings has jurisdiction

827over the parties and the subject matter of this proceeding

837pursuant to sections 766.301 through 766.316. The undersigned, as

846an Administrative Law Judge, has Ðexclusive jurisdiction to

854determine whether a clai m filed under [NICA] is compensable.Ñ

864§§ 766.301(1)(d), 766.304, and 766.311(1), Fla. Stat.

87110 . The Florida Legislature established the Plan Ðfor the

881purpose of providing compensation, irrespective of fault, for

889birth - related neurological injury claim s.Ñ £ 766.303(1), Fla.

899Stat.

9001 1 . To seek compensation under the Plan, a legal

911representative on behalf of an injured infant files a claim with

922DOAH. §§ 766.302(3) and 766.305(1), Fla. Stat. NICA, which

931administers the Plan, then has Ð45 days from the d ate of service

944of a complete claim . . . in which to file a response to the

959petition and to submit relevant written information relating to

968the issue of whether the injury is a birth - related neurological

980injury.Ñ £ 766.305(4), Fla. Stat.

9851 2 . If NICA dete rmines that the injury alleged in a claim

999is a compensable birth - related neurological injury, it may award

1010compensation to the claimant, provided that the award is approved

1020by the Administrative Law Judge to whom the claim has been

1031assigned. § 766.305(7), Fla. Stat.

10361 3 . In this matter, however, NICA determined that

1046PetitionerÓs claim is not compensable under the Plan. Therefore,

1055NICA filed the Unopposed Motion for Summary Final Order,

1064requesting an order be entered finding that the claim is not

1075compens able.

10771 4 . In reviewing the compensability of a claim, section

1088766.309(1) directs the Administrative Law Judge to make the

1097following determinations based upon the available evidence:

1104(a) Whether the injury claimed is a birth -

1113related neurological injury;

1116(b) Whether obstetrical services were

1121delivered by a participating physician in the

1128course of labor, delivery, or resuscitation in

1135the immediate postdelivery period in a

1141hospital; or by a certified nurse midwife in a

1150teaching hospital supervised by a

1155pa rticipating physician in the course of

1162labor, delivery, or resuscitation in the

1168immediate postdelivery period in a hospital;

1174and

1175(c) How much compensation, if any, is

1182awardable pursuant to s. 766.31.

11871 5 . The term Ðbirth - related neurological injuryÑ is defined

1199in section 766.302(2) as:

1203[I]njury to the brain or spinal cord of a live

1213infant weighing at least 2,500 grams for a

1222single gestation . . . caused by oxygen

1230deprivation or mechanical injury occurring in

1236the course of labor, delivery, or

1242resuscitati on in the immediate postdelivery

1248period in a hospital, which renders the infant

1256permanently and substantially mentally and

1261physically impaired.

12631 6 . Ð The [NICA] Statute is written in the conjunctive and

1276can only be interpreted to require permanent and sub stantial

1286impairment that has both physical and mental elements.Ñ Fla.

1295Birth - Related Neurological Injury Comp. AssÓn v. Fla. Div. of

1306Admin. Hearings , 686 So. 2d 1349, 1356 (Fla. 1997).

131517. In reviewing the injury in this matter, the undisputed

1325evidence es tablishes that Andy did not sustain a Ðbirth - related

1337neurological injuryÑ as defined in section 766.302(2). Dr. Willis

1346concluded that no apparent obstetrical event resulted in oxygen

1355deprivation or mechanical trauma during labor, delivery , and the

1364immedia te post - delivery period which caused brain injury to Andy .

1377Dr. Willis also noted that Andy did not require resuscitation at

1388birth. Dr. Sigurdardottir opined that , while Andy does suffer

1397from Ðsubstantial de lays in motor and mental abilities . . .

1409there i s no evidence of impairment consistent with a neurologic

1420injury to the brain or spinal cord acquired due to oxygen

1431deprivation or mechanical injury.Ñ

143518. Therefore, based on the available evidence in the

1444record, the undersigned determines that Andy ha s not suffered a

1455Ðbirth - related neurological injuryÑ and is not eligible for NICA

1466benefits.

1467DISPOSITION

1468Based upon the foregoing Findings of Fact and Conclusions of

1478Law, it is ORDERED that the Petition is dismissed, with prejudice.

1489DONE AND ORDERED this 1 0th day of April , 2019 , in
