108ST ATEMENT OF THE ISSUES

113The issue in this case is whether Koda Fisher - Douglas (Koda)

125suffered a birth - related injury as defined by section 766.302(2),

136Florida Statutes, for which compensation should be awarded under

145the Florida Birth - Related Neurological Inj ury Compensation Plan

155(Plan).

156PRELIMINARY STATEMENT

158On February 20, 2018, Petitioners filed a Petition for

167Determination of NICA Coverage (Petition) with the Division of

176Administrative Hearings (DOAH) alleging that they were uncertain

184as to whether Koda sustained a birth - related neurological injury

195as defined by section 766.302, Florida Statutes, and sought a

205determination of the same.

209The Petition named John William C. Meyers, M.D.

217(Dr. Meyers) , as the physician who provided obstetric services

226fo r the birth of Koda on November 17, 2016, at Halifax Medical

239Center in Daytona Beach, Florida.

244On March 5, 2018, DOAH mailed a copy of the Petition to NICA

257by certified mail. The certified receipt indicates the same was

267served on March 9, 2018. On March 5, 2018, DOAH mailed copies of

280the Petition by certified mail to Dr. Meyers and Halifax Medical

291Center. On March 19, 2018, Halifax Medical CenterÓs Motion to

301Intervene was granted. On March 27, 2018, Dr. MeyerÓs Motion to

312Intervene was granted.

315On June 13, 2018, NICA filed its Response to Petition for

326Benefits, suggesting that the subject claim was not compensable

335because Koda had not suffered a birth - related neurological injury

346and requesting a final hearing to address said issue.

355Ultimate ly, the parties filed a Joint Motion to Submit Stipulated

366Factual Record in Lieu of Contested Hearing. Said motion was

376granted on August 10, 2018, and the parties were directed to

387submit their stipulated record on or before August 17, 2018, and

398any writte n arguments or proposed final orders on or before

409August 24, 2018. Upon NICAÓs Unopposed Motion to Extend Deadline

419to Submit a Proposed Final Order, an Order was entered, giving

430the parties until August 27, 2018, to file their written

440arguments and/or pro posed final orders.

446On August 14, 2018, Pe titioners, NICA, and Dr. Meyers filed

457a ÐJoint Stipulation Concerning IntervenorÓs Participation in

464NICA.Ñ In this filing, the above - noted parties agreed and

475stipulated that, on or about November 17, 2016, Dr. Meyers was a

487participating provider in the Plan.

492The partiesÓ Stipulated Record was timely filed on

500August 16, 2018, and the following were thereby admitted into

510evidence without objection of any party: Joint Exhibits A

519through O; and NICAÓs E xhibits A through D. NICA timely filed a

532proposed final order on August 27, 2018, which has been

542considered in preparation of this Final Order. Neither

550Petitioner s nor Intervenors filed a written argument or proposed

560final order.

562FINDINGS OF FACT

5651. Koda was born a live infant on November 17, 2016, at a

578hospital, Halifax Medical Center. Koda was a single gestation,

587weighing over 2 , 500 grams at birth.

5942. With respect to KodaÓs birth, obstetrical services were

603delivered by Dr. Meyers, a NICA partici pating physician, in the

614course of labor, delivery or resuscitation in the immediate post -

625delivery period.

6273. NICA retained Donald Willis, M.D., an obstetrician

635specializing in maternal - fetal medicine, to review KodaÓs medical

645records and opine as to whe ther there was an injury to his brain

659or spinal cord that occurred in the course of labor, delivery, or

671resuscitation in the immediate post - delivery period due to oxygen

682deprivation or mechanical injury. In his March 13, 2018, report ,

692Dr. Willis set forth his findings and opinions which have been

703admitted in this matter, without objection. Said findings and

712opinions are set forth below in pertinent part:

720In summary, pregnancy was complicated by

726poorly controlled Maternal Diabetes. Fetal

731distress was note d on BPP at 37 weeks,

740requiring delivery. Delivery was further

745complicated by hydramnios and maternal

750obesity. Vacuum extraction and an extended

756ÐTÑ incision in the uterus was required. The

764baby was depressed at birth with Apgar Scores

772of 1/2/5. Cord b lood gas was consistent with

781acidosis with a pH of 6.9. The newborn

789hospital course was complicated by multi -

796system organ failures. Seizure activity was

802noted on EEG and MRI was consistent with HIE.

811Although the mother was not in labor prior to

820deliver y, there was an apparent obstetrical

827event that resulted in loss of oxygen to the

836babyÓs brain during delivery and continuing

842into the immediate post - delivery period. The

850oxygen deprivation resulted in a brain injury.

8574. NICA also retained Laufey Y. Sigurdardottir, M.D., a

866pediatric neurologist, to review KodaÓs medical records, conduct

874an Independent Medical Examination (IME), and opine as to whether

884he suffers from a permanent and substantial mental and physical

894impairment as a result of a birth - related neurological injury.

905Dr. Sigurdardottir reviewed the available medical records,

912obtained a full historical account from Petitioners, and conducted

921an IME of Koda on May 31, 2018.

9295. In her IME report, Dr. Sigurdardottir set forth her

939find ings and opinions which have been admitted in this matter,

950without objection. Said findings are set forth below in pertinent

960part:

961Pregnancy and Birth Summary: Koda was born at

96913:37 on 11/17/2016 at Halifax hospital at

97637 weeks gestation to a 33 yr old G5P1 female

986with insulin dependent diabetes after a high -

994risk pregnancy via emergent cesarean section

1000for non - reassuring fetal heart rate tracing.

1008There was meconium stained amniotic fluid.

1014There was difficulty delivering fetal head and

1021multiple attempt s with vacuum was needed along

1029with needing to extend incision in T. Infant

1037was floppy and non - reactive at birth. The

1046infant was born with Apgar scores of 1 after

1055one minute, 2 after 5 minutes and 5 at 10

1065minutes. Patient had respiratory distress and

1071re quired intubation and positive pressure

1077ventilation and cardiac compressions was

1082admitted in critical condition to NICU. Birth

1089weight 3960 gm (LGA), HC 35.5 cm (>75th

1097percentile). Cord gas pH 6.9 and BE - 9,

1106lactic acid 9.7. He had a complex NICU course

1115requiring cooling for HIE. He had seizures on

1123rewarming, a congential heart defect (bicuspid

1129ao valve and VSD). MRI on 11/28/2016 was

1137abnormal: Ðfindings consistent with hypoxic

1142ischemic encephalopathy, with acute lesions

1147within the posterior parietal a nd posterior

1154parietooccipital watershed areas.Ñ There was

1159also increased signal attenuation within the

1165bilaterial lentiform nuclei. Prominent

1169extraaxial spaces were also noted over the

1176bifrontal and bitemporal areas. The magnetic

1182resonance spectroscopy showed Ðmild reversal

1187of the NAA choline and NAA creatine as well as

1197elevation of lactate peaks.Ñ He had

1203respiratory issues and was intubated for

1209approximately one month. He had G tube placed

1217for aspirations. He was discharged from

1223hospital around age 2 months.

1228* * *

1231Developmental history: Initially he had

1236significant stiffness around the hip and

1242should er girdles and mom describes fisting of

1250both hand requiring hand and thumb splints.

1257Koda has no major delays in motor milestones,

1265was walking at 13 months. He knows 15 words

1274and does not use any 2 - word phrases. He is

1285social engaged and is always on the go. He is

1295in no therapy. Mom feels he is right sided

1304dominant, both with arm and with leg.

1311He was seen by rehabilitation at UF. He was

1320receiving PT at Speech Works in Daytona for an

1329evaluation, which noted some tightness of

1335shoulders and hips, and that was flatfooted.

1342PT feels he is up to date with gross motor

1352milestones, but problems with hand eye

1358coordination. He has not been evaluated for

1365OT/ SLP.

1367Past medical history: He has a known cardiac

1375defect with VSD and a bicuspid aortic valve.

1383This is stable at this time. There was

1391concern for shuddering spells at age on e year

1400but EEG was normal.

14046. Dr. Sigurdardottir, after conducting he r evaluation,

1412provided the following opinions: 1) there is evidence of

1421impairment consistent with a neurologic injury to the brain or

1431spinal cord acquired due to oxygen deprivation or mechanical

1440injury; 2) Koda is not found to have substantial delays in m otor

1453or mental abilities; and 3) that his prognosis for full motor and

1465mental recovery is good and his life expectancy is full. In

1476summary, Dr. Sigurdardottir opined that, Ð[i]n light of evidence

1485presented I believe Koda does not fulfill criteria of a

1495sub stantial mental and physical impairment at this time. I do not

1507feel that Koda should be included in the NICA program due to his

1520near age appropriate motor and language development.Ñ

15277. No contrary evidence has been submitted to refute the

1537findings and opinion of Drs. Willis and Sigurdardottir. Their

1546unrefuted findings and opinions are credited.

1552CONCLUSIONS OF LAW

15558. DOAH has jurisdiction over the parties to and the

1565subject matter of these proceedings. §§ 766.301 - 766.316,

1574Fla. Stat.

15769. The Pla n was established by the Legislature "for the

1587purpose of providing compensation, irrespective of fault, for

1595birth - related neurological injury claims" relating to births

1604occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

161510. The injured infan t, her or his personal representative,

1625parents, dependents, and next of kin may seek compensation under

1635the Plan by filing a claim for compensation with DOAH.

1645§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1653which administers the Plan, has "45 days from the date of service

1665of a complete claim . . . in which to file a response to the

1680petition and to submit relevant written information relating to

1689the issue of whether the injury is a birth - related neurological

1701injury." § 766.305(4), Fla. Stat.

170611. If NICA determines that the injury alleged is a claim

1717that is a compensable birth - related neurological injury, it may

1728award compensation to the claimant, provided that the award is

1738approved by the Administrative Law Judge (ALJ) to whom the claim

1749has been assigned. § 766.305(7), Fla. Stat. If, on the other

1760hand, NICA disputes the claims, as here, the dispute must be

1771resolved by the assigned ALJ in accordance with the provisions of

1782chapter 120, Florida Statutes. §§ 766.304, 766.309, and 766.31,

1791Fla. Stat.

179312. In discharging this responsibility, the ALJ is required

1802to make the following threshold determinations based upon the

1811available evidence:

1813(a) Whether the injury claimed is a birth -

1822related neurological injury. If the claimant

1828has demonstrated , to the satisfaction of the

1835administrative law judge, that the infant has

1842sustained a brain or spinal cord injury

1849caused by oxygen deprivation or mechanical

1855injury and that the infant was thereby

1862rendered permanently and substantially

1866mentally and physica lly impaired, a

1872rebuttable presumption shall arise that the

1878injury is a birth - related neurological injury

1886as defined in s. 766.303(2).

1891(b) Whether obstetrical services were

1896delivered by a participating physician in the

1903course of labor, delivery, or resu scitation

1910in the immediate postdelivery period in a

1917hospital; or by a certified nurse midwife in

1925a teaching hospital supervised by a

1931participating physician in the course of

1937labor, delivery, or resuscitation in the

1943immediate postdelivery period in a hospit al.

1950§ 766.309(1), Fla. Stat.

195413 . The term "birth - related neurological injury" is defined

1965in section 766.302(2) as follows:

"1970Birth - related neurological injury" means

1976injury to the brain or spinal cord of a live

1986infant weighing at least 2,500 grams for a

1995single gestation or, in the case of a

2003multiple gestation, a live infant weighing at

2010least 2,000 grams at birth caused by oxygen

2019deprivation or mechanical injury occurring in

2025the course of labor, delivery, or

2031resuscitation in the immediate postdelivery

2036pe riod in a hospital, which renders the

2044infant permanently and substantially mentally

2049and physically impaired.

205214 . The evidence establishes that there was an apparent

2062obstetrical event that resulted in loss of oxygen to the babyÓs

2073brain during delivery an d continuing into the immediate post -

2084delivery period, resulting in an injury to KodaÓs brain. The

2094evidence further establishes that obstetrical services were

2101delivered by a participating physician , Dr. Meyers, in the course

2111of labor, delivery, or resuscit ation in the immediate post -

2122delivery period in a hospital , Halifax Medical Center. The

2131unrefuted evidence, however, establishes that Koda did not

2139sustain a permanent and substantial mental and physical

2147impairment. Thus, he did not sustain a birth - related

2157neurological injury a s defined in section 766.302(2) and,

2166therefore, is not eligible for benefits under the Plan.

2175CONCLUSION

2176Base on the foregoing Findings of Fact and Conclusions of

2186Law, it is ORDERED that the Petition is dismissed with prejudice.
