48This cause came on for consideration upon an Unopposed
57Motion for Summary Final Order filed by Respondent, Florida

73(NICA), on September 5, 2018.
78STATEMENT OF THE CASE
82On February 28, 2018, Petitioners filed a Petition for
91Benefits (Petition) with the Division of Administrative hearings
99(DOAH) for a determination of compensability unde r the Florida
109Birth - Related Neurological Injury Compensation Plan (Plan). The
118Petition named Prashanti Logeswaran, M.D. , as the physician who
127provided obstetric services for the birth of Noble
135Lazzara (Noble) on May 4, 2017, at Bayfront Health
144St. Pete rsburg/Bayfront Baby Place in Lakeland, Florida.
152On March 21, 2018, DOAH mailed a copy of the Petition to
164NICA by certified mail. NICA was served with the same on or
176before March 29, 2018. On March 21, 2018, DOAH mailed copies of
188the Petition by certifie d mail to Dr. Logeswaran and Bayfront
199Health St. Petersburg.
202On June 25, 2018, NICA filed its Response to Petition for
213Benefits, suggesting that the subject claim was not compensable
222and requesting a final hearing to address said issue. On July 2,
2342018, the undersigned issue d an order requiring the parties to
245advise whether a final hearing would be required; and, if so, to
257advise the undersigned of when the parties would be prepared to
268proceed, the remaining issues, an estimate of time, and choice of
279ven ue. On July 23, 2018, NICA provided a written status report
291wherein it was represented that, after consultation, neither
299party was requesting a hearing and that NICA intended to file an
311unopposed motion for summary final hearing.
317On September 5, 2018, NI CA filed an Unopposed Motion for
328Summary Final Order requesting that a summary final order be
338entered finding that the claim is not compensable because Noble
348did not sustain a Ðbirth - related neurological injuryÑ as that
359term is defined in section 766.302(2 ), Florida Statutes, and
369dismissing the Petition with prejudice. Said motion represents
377that Petitioner s do not oppose the instant motion.
386FINDINGS OF FACT
3891. Noble was born on May 4, 2017, at Bayfront Health
400St. Petersburg. Noble wa s a single gestat ion, weighing over
4112 , 500 grams at birth.
4162. With respect to NobleÓs birth, obstetrical services were
425provided by Prashanti Logeswaran, M.D., a NICA participating
433physician, in the course of labor, delivery , or resuscitation in
443the immediate post - deliver y period.
4503. NICA retained Donald Willis, M.D., an obstetrician
458specializing in maternal - fetal medicine, to review Noble Ós medical
469records and opine as to wh ether there was an injury to his brain
483or spinal cord that occurred in the course of labor, deliv ery, or
496resuscitation in the immediate post - delivery period due to oxygen
507deprivation or mechanical injury. In his report dated June 18,
5172018, Dr. Willis set forth the following:
524In summary, what appeared to be an uneventful
532vaginal birth resulted in ne wborn depression
539with Apgar scores of 3/4/6. Bag and mask
547ventilation was required at birth, followed by
554CPAP in the nursery. ABG at one hour after
563birth was consistent with acidosis. The pH
570was 7.18 with a base excess of - 11. Seizure
580activity develope d within the first 24 h o urs
590after birth and was confirmed by EEG. MRI on
599DOL 3 had findings consistent with ischemic
606brain injury.
608There was no apparent obstetrical event that
615resulted in oxygen deprivation during labor
621and delivery, but oxygen deprivat ion did occur
629in the post - delivery period. The oxygen
637deprivation resulted in brain injury.
6424. Dr. Willis affirms in his affidavit, dat ed September 4,
6532018, the above - quoted opinion based upon his education,
663training, experience, and to a reasona ble degree of medical
673probability.
6745. NICA also retained Laufey Y. Sigurdardottir, M.D., a
683pediatric neurologist, to review NobleÓs medical records, conduct
691an Independent Medical Examination (IME), and opine as to whether
701he suffers from a permane nt and substantial mental and physical
712impairment as a result of a birth - related neurological injury.
723Dr. Sigurdardottir reviewed the available medical records,
730obtained information regarding NobleÓs developmental trajectory
736from Petitioners, and conducte d an IME of Noble on May 23, 2018.
7496. Dr. SigurdardottirÓs affidavit, attached to NICAÓs
756Motion, provides in pertinent part, as follows:
763Based upon my education, training and
769experience, it is my professional opinion,
775within a reasonable degree of medical
781probability that although there is evidence of
788impairment consistent with a neurologic injury
794to the brain or spinal cord acquired due to
803oxygen deprivation or mechanical injury, he
809has made an excellent recovery and has minimal
817delays in developme nt at this time. He has no
827delays in mental abilities.
8317. A review of the file reveals that no contrary evidence
842was presented to refute the findings and opinions of Dr. Willis
853and Dr . Sigurdardottir. Their unrefuted opinions are credited.
862CONCL USIONS OF LAW
8668. DOAH has jurisdiction over the parties to and the
876subject matter of these proceedings. §§ 766.301 - 766.316,
885Fla. Stat.
8879. The Plan was established by the Legislature "for the
897purpose of providing compensation, irrespective of fault, fo r
906birth - related neurological injury claims" relating to births
915occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
92610. The injured infant, her or his personal representative,
935parents, dependents, and next of kin may seek compensation under
945th e Plan by filing a claim for compensation with DOAH.
956§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
964which administers the Plan, has "45 days from the date of service
976of a complete claim . . . in which to file a response to the
991petition and t o submit relevant written information relating to
1001the issue of whether the injury is a birth - related neurological
1013injury." § 766.305(4), Fla. Stat.
101811. If NICA determines that the injury alleged is a claim
1029that is a compensable birth - related neurologic al injury, it may
1041award compensation to the claimant, provided that the award is
1051approved by the Administrative Law Judge (ALJ) to whom the claim
1062has been assigned. § 766.305(7), Fla. Stat. If, on the other
1073hand, NICA disputes the claims, as here, the di spute must be
1085resolved by the assigned ALJ in accordance with the provisions of
1096chapter 120, Florida Statutes. §§ 766.304, 766.309, and 766.31,
1105Fla. Stat.
110712. In discharging this responsibility, the ALJ is required
1116to make the following threshold deter minations based upon the
1126available evidence:
1128(a) Whether the injury claimed is a birth -
1137related neurological injury. If the claimant
1143has demonstrated, to the satisfaction of the
1150administrative law judge, that the infant has
1157sustained a brain or spinal cor d injury
1165caused by oxygen deprivation or mechanical
1171injury and that the infant was thereby
1178rendered permanently and substantially
1182mentally and physically impaired, a
1187rebuttable presumption shall arise that the
1193injury is a birth - related neurological injury
1201as defined in s. 766.303(2).
1206(b) Whether obstetrical services were
1211delivered by a participating physician in the
1218course of labor, delivery, or resuscitation
1224in the immediate postdelivery period in a
1231hospital; or by a certified nurse midwife in
1239a teachin g hospital supervised by a
1246participating physician in the course of
1252labor, delivery, or resuscitation in the
1258immediate postdelivery period in a hospital.
1264§ 766.309(1), Fla. Stat.
126813. The term "birth - related neurological injury" is defined
1278in section 76 6.302(2) as follows:
"1284Birth - related neurological injury" means
1290injury to the brain or spinal cord of a live
1300infant weighing at least 2,500 grams for a
1309single gestation or, in the case of a
1317multiple gestation, a live infant weighing at
1324least 2,000 grams at birth caused by oxygen
1333deprivation or mechanical injury occurring in
1339the course of labor, delivery, or
1345resuscitation in the immediate postdelivery
1350period in a hospital, which renders the
1357infant permanently and substantially mentally
1362and physically impaire d.
136614. The evidence establishes that there was oxygen
1374deprivation to NobleÓs brain occurring in the course of labor,
1384delivery, or resuscitation in the immediate post - delivery period,
1394resulting in an injury to NobleÓs brain. The evidence further
1404establi shes that obstetrical services were delivered by a
1413participating physician, Dr. Logeswaran, in the course of labor,
1422delivery, or resuscitation in the immediate post - delivery period
1432in a hospital, Bayfront Health St. Petersburg. The unrefuted
1441evidence, how ever, establishes that Noble did not sustain a
1451permanent and substantial mental and physical impairment. Thus,
1459he did not sustain a birth - related neurological injury as defined
1471in secti on 766.302(2) and, therefore, is not eligible for
1481benefits under the P lan.
1486CONCLUSION
1487Based on the foregoing Findings of Fact and Conclusions of
1497Law, it is ORDERED that the Petition is dismissed with prejudice.
