98STATEMENT OF THE CASE

102On March 22, 2018, Petitioner, Sheila Gonzalez, on behal f of

113and as parent and natural guardian of, Jayden Jacomina ( Ð Jayden Ñ ),

127a minor, filed a Petition for Benefits Pursuant to Florida Statute

138Section 766.301 et seq. ( Ð Petition Ñ ) with the Division of

151Administrative Hearings ( Ð DOAH Ñ ) for the determination of

162c ompensability under the Florida Birth - Related Neurological Injury

172Compensation Plan ( Ð Plan Ñ ).

179The Petition named Megan Piper Gray, M.D., as the physician

189who provided obstetric services at the birth of Jayden on

199February 8, 2015, at Intervenor Orlando H ealth, Inc., d/b/a

209Winnie Palmer Hospital for Women and Babies ( Ð Orlando Health

220Hospitals Ñ ).

223DOAH served Dr. Gray with a copy of the Petition on

234April 19, 2018, and upon Orlando Health Hospitals on or about

245April 25, 2018. NICA was served with a copy of the Petition on

258April 16, 2018.

261On June 25, 2018, NICA filed its response to the Petition,

272suggesting that the subject claim was not compensable and

281requesting that a hearing be scheduled to address such issue. On

292July 19, 2018, the undersigned issued an Order directing the

302parties to confer and advise whether a final hearing would be

313required. On July 26, 2018, NICA filed a response to the Order

325indicating that no party requested a final hearing in this matter.

336On September 4, 2018, NICA filed an Unop posed Motion for

347Summary Final Order, requesting that a summary final order be

357entered finding that the claim was not compensable because Jayden

367did not suffer a Ð birth - related neurological injury Ñ as defined in

381section 766.302(2) , Florida Statutes .

386FINDIN GS OF FACT

3901. Jayden was born on February 8, 2015, at Orlando Health

401Hospitals located in Orlando, Florida.

4062. NICA retained Donald Willis, M.D., an

413obstetrician/gynecologist, specializing in maternal - fetal

419medicine, as well as pediatric neurologist, Lau fey Y.

428Sigurdardottir, M.D., to review Jayden Ó s medical records. NICA

438sought to obtain an opinion whether an injury to Jayden Ó s brain

451or spinal cord at birth caused by oxygen deprivation or

461mechanical injury occurred in the course of labor, delivery, or

471r esuscitation in the immediate post - delivery period, and whether

482that injury rendered Jayden permanently and substantially

489mentally and physically impaired.

4933. Dr. Willis reviewed Jayden Ó s medical records and opined,

504within a reasonable degree of medical p robability, that:

513[T] here was no apparent obstetrical event

520that resulted in oxygen deprivation or

526mechanical trauma during labor, delivery and

532the immediate post - delivery period.

5384. Dr. Sigurdardottir also reviewed Jayden Ó s medical

547records, as well as e xamined Jayden on May 29, 2018.

558Dr. Sigurdardottir found that Jayden exhibits a neurodevelopment

566disorder with a severe language delay, as well as autistic

576features. However, Dr. Sigurdardottir also opined that, within a

585reasonable degree of medical pro bability:

591Jayden is not found to have substantial

598delays in motor abilities.

6025. A review of the file reveals that no contrary evidence

613dispute s the findings and opinions of Dr. Willis and

623Dr. Sigurdardottir . Their opinions are credible and persuasive.

6326. Based on the opinions and conclusions of Dr. Willis and

643Dr. Sigurdardottir, NICA determined that Petitioner Ó s claim was

653not compensable. NICA subsequently filed the Motion for Summary

662Final Order asserting that Jayden has not suffered a Ð birth -

674related neurological injury Ñ as defined by section 766.302(2).

683Neither Petitioner nor Intervenor oppose s NICA Ó s motion.

693CONCLUSIONS OF LAW

6967. The undersigned, as an Administrative Law Judge, has

705exclusive jurisdiction over the subject matter of this proceeding.

714§ 766.304, Fla. Stat.

7188. The Florida Legislature established the Plan Ð for the

728purpose of providing compensation, irrespective of fault, for

736birth - related neurological injury claims Ñ relating to births

746occurring on or after January 1, 1989. § 766.303(1 ), Fla. Stat.

7589. The injured infant, her or his personal representative,

767parents, dependents, and next of kin may seek compensation under

777the Plan by filing a claim for compensation with DOAH.

787§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA, which

796administers the Plan, then has Ð 45 days from the date of service

809of a complete claim . . . in which to file a response to the

824petition and to submit relevant written information relating to

833the issue of whether the injury is a birth - related neurolog ical

846injury. Ñ § 766.305(4), Fla. Stat.

85210. If NICA determines that the injury alleged in a claim is

864a compensable birth - related neurological injury, it may award

874compensation to the claimant, provided that the award is approved

884by the Administrative Law Judge to whom the claim has been

895assigned. § 766.305(7), Fla. Stat.

90011. In this matter, however, NICA has determined that

909Petitioner Ó s claim is not compensable under the Plan. Therefore,

920NICA filed a Motion for Summary Final Order, requesting an order

931be entered finding that the claim is not compensable.

94012. In ruling on NICA Ó s motion, section 766.309(1) provides

951that the Administrative Law Judge must make the following

960determination based upon the available evidence:

966(a) Whether the injury claimed i s a birth -

976related neurological injury. If the claimant

982has demonstrated, to the satisfaction of the

989administrative law judge, that the infant has

996sustained a brain or spinal cord injury caused

1004by oxygen deprivation or mechanical injury and

1011that the infant was thereby rendered

1017permanently and substantially mentally and

1022physically impaired, a rebuttable presumption

1027shall arise that the injury is a birth - related

1037neurological injury as defined in s.

1043766.302 (2).

104513. The term Ð birth - related neurological injury Ñ is defined

1057in section 766.302(2) as follows:

1062Ð Birth - related neurological injury Ñ means

1070injury to the brain or spinal cord of a live

1080infant weighing at least 2,500 grams for a

1089single gestation or, in the case of a multiple

1098gestation, a live infant weighing at least

11052,000 grams at birth caused by oxygen

1113deprivation or mechanical injury occurring in

1119the course of lab or, delivery, or

1126resuscitation in the immediate postdelivery

1131period in a hospital, which renders the infant

1139permanently and substantially mentally and

1144physically impaired. This definition shall

1149apply to live births only and shall not

1157include disability or death caused by genetic

1164or congenital abnormality.

116714. The undisputed evidence establishes that there was no

1176obstetrical event that caused the loss of oxygen to Jayden Ó s brain

1189or spinal cord during labor, delivery, or the immediate post -

1200delivery period. The undisputed evidence further establishes that

1208Jayden did not suffer a substantial mental impairment. 1/ Thus,

1218Jayden did not sustain a Ð birth - related neurological injury Ñ as

1231defined in section 766.302(2). Accordingly, Petitioner is not

1239eligible for b enefits under the Plan.

1246DISPOSITION

1247Based upon the foregoing Findings of Fact and Conclusions of

1257Law, it is ORDERED that the Petition is dismissed, with prejudice.

1268DONE AND ORDERED this 21st day of September, 2018 , in
