126PRELIMINARY STATEMENT

128On February 22, 2018, the Department of Highway Safety and

138Mo tor Vehicl es (the Department) published notice in the Florida

149Administrative Register (Volume 44, Number 37, p. 898 - 899) of its

161intent to allow the establishment of Respondent Pinellas

169Powersports , LLC (Powersports), as a dealership for motorcycles

177produce d by Sanmen County Youngfu Machine, Co. , Ltd. (YNGF) , and

188distributed by Respondent Mot rac Motorcycles, LLC (Mot rac). On

198March 22, 2018, Tropical Scooters, LLC (Tropical Scooters) , filed

207a complaint protesting Respondents Ó application and the

215Department Ó s intention to grant the application.

223The Department referred the matter to DOAH on April 17,

2332018 , and requested a formal hearing. An Initial Order was

243issued on April 18, 2018, requesting the parties provide, among

253other information, dates and venue pre ferences for the hearing.

263Neither party submitted a response to the Initial Order.

272On May 1, 2018, the undersigned set the matter for hearing

283and DOAH mailed a Notice of Hearing to the parties Ó

294representatives listed on the Department Ó s referral letter. On

304May 16, 2018, an Amended Notice of Hearing was mailed by DOAH to

317the parties. No party objected to the hearing date of July 9,

3292018.

330At the hearing, Petitioner appeared and offered the

338testimony of its owner and corporate officer Michele R. Stanley;

348it did not offer any evidence or exhibits. Respondents did not

359appear at the hearing.

363At the conclusion of the final hearing, Petitioner was

372instructed about its right to order the transcript and provide a

383p roposed recommended order (PRO), but n o transcript was ordered .

395Petitioner submitted its PRO on July 19, 2018, which has been

406considered.

407FINDING S OF FACT

4111. Tropical Scooters is located at 11594 Seminole

419Boulevard, Largo, Florida 33778. It has been in the business of

430selling scooters and other motori zed vehicles for ten years.

4402. Michele Stanley is the owner and manager of Tropical

450Scooters and she has knowledge regarding its purchasing and

459franchise agreements, inventory, and sales figures.

4653. Although no franchise agreement was offered into

473eviden ce, Ms. Stanley testified Petitioner has an agreement with

483a distributor, Pacific Rim International , d/b/a Ice Bear ATV (Ice

493Bear) , to sell YNGF motorcycles.

4984. Ice Bear has been supplying Petitioner with YNGF

507motorcycles for approximately two and a half years. Tropical

516Scooters has had a good relationship with this distributor and

526has encountered no problems selling the YNGF line.

5345. In the last 18 months, Tropical Scooters has sold 137

545YNGF units and currently has 23 units at its showroom.

5556. Ms. Stan ley discovered that Respondents had applied wit h

566the Department to establish a YNGF motorcycle dealership at

5759145 66th Street North, Pinellas Park, Florida 33782, from the

585February 22, 2018 , notice published by the Department in the

595Florida Administrative Register. 2 / Subsequently, Tropical

602Scooters filed a timely complaint with the Department challenging

611Respondents Ó application .

6157. Ms. Stanley was familiar with the proposed location of

625the new dealership and stated that it was four miles Ð as the crow

639fl ies Ñ from the Tropical Scooters showroom.

6478. Tropical Scooters is an existing dealership that sells

656YNGF motorcycles and is within 12.5 of the location proposed by

667Powersports and Mot rac for the new dealership. Therefore,

676Tropical Scooters has standing t o bring this challenge pursuant

686to section 320.642(3).

6899. There was no evidence that Tropical Scooters Ó

698representation of the YGNF line of motorcycles was inadequate in

708its community or territory as described in section 320.642(2)(b).

717CONCLUSIONS OF LAW

7201 0. The Division of Administrative Hearings has

728jurisdiction over this proceeding pursuant to sections 120.569,

736120.57(1), 320.642 and 320.699 , Florida Statutes .

74311 . The Department is the agency responsible for regulating

753the licensing and franchising of motor vehicle dealers.

761§§ 320.60 - 320.70, Fla. Stat.

76712. The purpose of these regulations is Ð to prevent

777powerful manufacturers from taking unfair advantage of their

785dealers by overloading a market area with more dealers than can be

797justified by the legi timate interests of the manufacturer and its

808dealers, existing and prospective. Ñ Bill Kelley Chevrolet, Inc.

817v. Calvin , 322 So. 2d 50, 52 (Fla. 1st DCA 1975). As such,

830section 320.642 requires a determination as to Ð whether an

840additional (either new or relocated) dealership is justified,

848economically and otherwise, from the viewpoints of the existing

857dealers and the public, respectively. Ñ Gen. Motors Corp. v. Fla.

868Dep Ó t of High. Saf. & Motor Vehs. , 625 So. 2d 76, 78 (Fla. 1st DCA

8851993).

88613. As explaine d in section 320.642(2)(a), a challenge to a

897motor vehicle dealership application involves a two - part analysis:

907(1) the challengerÓs standing; and (2) the adequa cy of existing

918representation of the same vehicle line . That section states in

929relevant part:

931( 2)(a) An application for a motor vehicle

939dealer license in any community or territory

946shall be denied when:

9501. A timely protest is filed by a presently

959existing franchised motor vehicle dealer with

965standing . . . and

9702. The licensee fails to show tha t the

979existing franchised dealer or dealers who

985register new motor vehicle retail sales or

992retail leases of the same line - make in the

1002community or territory of the proposed

1008dealership are not providing adequate

1013representation of such line - make motor

1020vehicl es in such community or territory. The

1028burden of proof in establishing inadequate

1034representation shall be on the licensee .

1041( e mphasis added).

104514. Standing is further addressed in section 320.642(3),

1053which provides in relevant part :

1059(3) An existing fran chised motor vehicle

1066dealer or dealers shall have standing to

1073protest a proposed additional or relocated

1079motor vehicle dealer when the existing motor

1086vehicle dealer or dealers have a franchise

1093agreement for the same line - make vehicle to

1102be sold or serviced by the proposed

1109additional or relocated motor vehicle dealer

1115and are physically located so as to meet or

1124satisfy any of the following requirements or

1131conditions:

1132* * *

1135(b) If the proposed additional or relocated

1142motor vehicle dealer is to be lo cated in a

1152county with a population of more than 300,000

1161according to the most recent data of the

1169United States Census Bureau or the data of

1177the Bureau of Economic and Business Research

1184of the University of Florida:

11891. Any existing motor vehicle dealer or

1196dealers of the same line - make have a licensed

1206franchise location within a radius of 12.5

1213miles of the location of the proposed

1220additional or relocated motor vehicle

1225dealer[.]

122615. Tropical Scooters (as the Ð existing franchised motor

1235vehicle dealer Ñ ) h as the initial burden of establishing standing

1247by a preponderance of the evidence. See Recovery Racing, LLC v.

1258State Dep Ó t of High. Saf. & Motor Vehs. , 192 So. 3d 665, 669 n.1

1274(Fla. 4th DCA 2016)(noting plain language of statute places the

1284burden Ð squarel y on the existing dealer Ñ to show its standing).

129716. Once standing is established, the burde n shifts to

1307Powersports and Mot rac (as the applicants for the new dealer

1318license) to establish by a preponderance of the evidence that

1328Tropical Scooters (as the ex isting YNGF dealer) is not providing

1339adequate representation of YNGF products. See § 320.642(2);

1347Gen. Motors Corp. , 625 So. 2d at 77 (noting subsection (2)

1358requires a determination regarding the adequacy of existing

1366representation in the comm unity or ter ritory to be based on

1378evidence directed to 11 enumerated issues).

138417. Here, regarding the first part of the analysis,

1393Tropical Scooters met its burden of establishing standing .

140218. As to the second part of the analysis, there was no

1414evidence that Tropica l Scooters was providing in adequate

1423representation of the YNGF line of motorcycles.

1430RECOMMENDATION

1431Based on the foregoing Findings of Fact and Conclusions of

1441Law, it is RECOMMENDED that a final order be entered by the

1453Department denying the new dealership application o f Respondents

1462for the sale and service of Sanmen County Youngfu Machine Co. ,

1473Ltd . , vehicles at 9145 66th Street North, Pinellas Park, Pinellas

1484County, Florida.
