91STATEMENT OF THE ISSUE
95Did Respondent, Winter Haven Housing Authority (Authority),
102discriminate against Petitioner, Donald Bayer, in the sale or
111rental of housing on account of a disability?
119PRELIMINARY STATEMENT
121Mr. Bayer filed h ousing d iscrimination c omplaint s with the
133United States Department of Housing and Urban Development and the
143Florida Commission on Human Relations (Commission). The
150complaints alleged that the Authority discriminated against
157Mr. Bayer because of a visual disability. Mr. Bayer asserted
167that the Authori ty did not provide him a reasonable accommodation
178for completing an application for low - income Ð section 8
189housing . Ñ 1/ The Commission investigated the complaint s . It
201determined that the Authority did not unlawfully discriminate
209against Mr. Bayer. The Commission concluded that Mr. Bayer did
219not allow the Authority sufficient time to grant his
228accommodation request.
230Mr. Bayer disputed the decision by filing a Pet ition for
241Relief with the Commission. The Commission transmitted the
249matter to the Division to conduct a formal hearing.
258Mr. Bayer presented testimony from Dian Diaz and himself at
268the hearing. Mr. BayerÓs Exhibits 1 through 4 and 6 through 15
280were admit ted. The Authority presented testimony from Bersy
289Sanchez.
290As an accommodation for his visual impairment, Mr. Bayer was
300provided a transcript of the hearing in computer formats that his
311software could convert to spoken word. Also , Mr. Bayer was
321provided additional time in which to prepare a proposed
330recommended order.
332The Authority timely filed a proposed recommended order.
340Mr. Bayer did not file a proposed recommended order.
349FINDING S OF FACT
3531. Mr. Bayer is visually impaired. At all material times
363he was a resident of Lakeside Terrace Senior Apartment Homes
373(Lakeside) in Winter Haven, Florida, operated by the Authority.
382On March 3, 2017, while in LakesideÓs management office to pay
393his rent, Mr. Bayer asked the property manager, Bersy Sanchez, to
404help him complete an application for a s ection 8 h ousing subsidy.
4172. Because it was early in the month, Ms. Sanchez was very
429busy collecting rent s for LakesideÓs 84 units. She was the only
441employe e in the office.
4463. Ms. Sanchez and Mr. Bayer disagree about the exact
456content of their conversation. Consider ing the witnessesÓ
464demeanor and the areas about which there is no disagreement,
474Ms. SanchezÓ testimony was more credible and persuasive. In
483ad dition, they agree that Ms. Sanchez told Mr. Bayer she was too
496busy to assist him that day but would assist him if he returned
509to the office the following day. (T r 61 & 62). According to
522Mr. Bayer, Ms. Sanchez said, ÐWill you come back tomorrow?Ñ
533(Tr 19).
5354. Mr. Bayer did not return to the office to complete the
547application the next day or any day afterwards. He explained his
558decision like this: ÐI Î if I would have went back the next day
572I would have given away my complaint that she had violated my
584rights because maybe she would have helped me fill out the
595application. IÓm not giving away a free violation of my rights,
606and tha tÓs why I did not go back.Ñ (Tr 61).
6175. By any measure, Ms. SanchezÓ offer to assist Mr. Bayer
628the next day was a reason able accommodation for his visual
639disability. Mr. BayerÓs explanation for refusing to return the
648next day demonstrates intent to secure an advantage over the
658Authority.
659CONCLUSIONS OF LAW
6626. The Division has jurisdiction over the parties and
671subject matter of this proceeding. §§ 120.569, 120.57(1), and
680760.35(3), Fla. Stat. (2018) . 2/
6867. Mr. Bayer brings his complaint under FloridaÓs Fair
695Housing Act, sections 760.20 through 760.37, Florida Statutes.
703He alleges that the Authority engaged in a discri minatory housing
714practice by refusing to immediately assist him with completing
723the s ection 8 housing application. Mr. Bayer bears the burden of
735proving his claim by a preponderance of the evidence. See
745§§ 760.34(5) and 120.57(1)(j), Fla. Stat.
7518. Disc riminati on against a person in the sale or rental of
764housing because of a handicap is unlawful. § 760.23, Fla. Stat.
775Mr. BayerÓs visual disability is a handicap. £ 760.22(7)(a),
784Fla. Stat. Refusing to provide him a reasonable accommodation
793for his disability woul d be unlawful, if it occurred.
803§ 760.23(9)(b), Fla. Stat.
8079. The Authority did not refuse to provide Mr. Bayer a
818reasonable accommodation. It offered to provide the requested
826accommodation. It only asked in good faith that Mr. Bayer return
837the next day for assistance because the only person in the offic e
850on the day of his request was very busy. This was reasonable.
862Mr. BayerÓs response was not.
86710. Mr. Bayer rejected the accommodation because he saw a
877chance to impose liability upon the Authority. Accommodation is
886an interactive, Ðgive and take,Ñ pro cess to determine what
897accommodation will help. Neither party may sabotage the process
906in order to avoid or inflict liability. Ward v. McDonald , 762
917F.3d 24 ( D.C. Cir. 2014) (Prompt meeting to address accommodation
928request with some delay to complete pap erwork documenting
937disability was reasonable; employee leaving the same day and
946never returning was not.); c ompare Groome Res., Ltd. v. Parish of
958Jefferson , 234 F.3d 192 (5th Cir. 2000) ( C ontinued indeterminate
969delay in responding to accommodation request can amount to

981RECOMMENDATION
982Based on the foregoing Findings of Fact and Conclusions of
992Law, it is RECOMMENDED that the Florida Commission on Human
1002Relations dismiss the Petition for Relief of Petitioner,
1010Donald Bayer.
