99STATEMENT OF THE CASE
103On May 17, 2018, Petitioners, Oluwat osin Otiki and Ayodele
113Jinadu, on behalf of and as parents of, Angel Jinadu ( Ð Angel Ñ ), a
129minor, filed a Petition for Benefits Pursuant to Florida Statute
139Section 766.301 et seq. ( Ð Petition Ñ ) with the Division of
152Administrative Hearings ( Ð DOAH Ñ ) for the det ermination of
164compensability under the Florida Birth - Related Neurological Injury
173Compensation Plan ( Ð Plan Ñ ).
180The Petition named Louis Stern, M.D., as the physician who
190provided obstetric services at the birth of Angel on October 14,
2012015, at Intervenor O rlando Health, Inc., d/b/a Winnie Palmer
211Hospital for Women and Babies ( Ð Orlando Health Hospitals Ñ ).
223DOAH served Dr. Stern with a copy of the Petition on May 29,
2362018, and served Orlando Health Hospitals that same date. NICA
246was also served with a copy of the Petition on May 29, 2018.
259On July 20, 2018, Orlando Health Hospitals filed a Motion to
270Intervene, which was granted. In its motion, Orlando Health
279Hospitals identified Martha Kuffskie, M.D., as the physician at
288the time of labor prior to Angel Ó s bi rth.
299On August 22, 2018, NICA filed its response to the Petition,
310taking the position that Petitioners Ó claim was not compensable
320under the Plan. NICA requested that DOAH schedule a hearing to
331determine compensability.
333On August 28, 2018, NICA filed a status report representing
343that no party requests a final hearing in this matter.
353On September 7, 2018, NICA filed an Unopposed Motion for
363Summary Final Order, requesting the Administrative Law Judge enter
372a summary final order finding that the claim was not compensable
383because Angel did not suffer a Ð birth - related neurological injury Ñ
396as defined in section 766.302(2).
401FINDINGS OF FACT
4041. Angel was born on October 14, 2015, at Orlando Health
415Hospitals located in Orlando, Florida.
4202. Based on the hospita l records in evidence, Louis
430Stern, M.D., was the delivering physician for Angel Ó s birth.
441Dr. Stern was not a Ð participating physician Ñ under the Plan at
454the time Angel was born. See § 766.302(7), Fla. Stat.
464(Dr. Kuffskie was a Ð participating physici an Ñ for the year in
477which the injury occurred.)
4813. Upon receiving the Petition, NICA retained
488Donald Willis, M.D., an obstetrician/gynecologist specializing in
495maternal - fetal medicine, as well as Laufey Y.
504Sigurdardottir, M.D., a pediatric neurologist , to review Angel Ó s
514medical records. NICA sought to obtain an opinion whether there
524was an injury to Angel Ó s brain or spinal cord at birth caused by
539oxygen deprivation or mechanical injury occurred in the course of
549labor, delivery, or resuscitation in the immediate post - delivery
559period, and whether that injury rendered Angel permanently and
568substantially mentally and physically impaired.
5734. Dr. Willis reviewed Angel Ó s medical records and opined,
584within a reasonable degree of medical probability :
592[T] here w as an apparent obstetrical event
600that resulted in oxygen deprivation or
606mechanical trauma during labor, delivery and
612the immediate post - delivery period. The
619oxygen deprivation resulted in brain injury.
6255. Dr. Sigurdardottir also reviewed Angel Ó s medical
634records, as well as examined Angel on August 1, 2018.
644Dr. Sigurdardottir opined, within a reasonable degree of medical
653probability:
654[A] lthough there is evidence of impairment
661consistent with a neurologic injury to the
668brain or spinal cord acquired due t o oxygen
677deprivation or mechanical injury, Angel is
683not found to have substantial delays in motor
691abilities. Angel is found to have mild to
699moderate delays in mental abilities, with a
706language delay noted on her exam. She has
714made good progress with her developmental
720delays and prognosis for full motor and metal
728recovery is good.
7316. A review of the file reveals no contrary evidence to
742dispute the findings and opinions of Dr. Willis and
751Dr. Sigurdardottir . Their opinions are credible and persuasive.
7607. Based on the opinions and conclusions of Dr. Willis and
771Dr. Sigurdardottir, NICA determined that Petitioner Ó s claim was
781not compensable. NICA subsequently filed the Unopposed Motion
789for Summary Final Order asserting that Angel has not suffered a
800Ð birth - related neurological injury Ñ as defined by section
811766.302(2). Neither Petitioners nor Intervenor oppose NICA Ó s
820motion.
821CONCLUSIONS OF LAW
8248. The undersigned, as an Administrative Law Judge, has
833exclusive jurisdiction over the subject matter of this pro ceeding.
843§ 766.304, Fla. Stat.
8479. The Florida Legislature established the Plan Ð for the
857purpose of providing compensation, irrespective of fault, for
865birth - related neurological injury claims Ñ relating to births
875occurring on or after January 1, 1989. § 7 66.303(1), Fla. Stat.
88710. The injured infant, her or his personal representative,
896parents, dependents, and next of kin may seek compensation under
906the Plan by filing a claim for compensation with DOAH.
916§§ 766.302(3), 766.30 3(2), and 766.305(1), Fla. Sta t . NICA, which
928administers the Plan, then has Ð 45 days from the date of service
941of a complete claim . . . in which to file a response to the
956petition and to submit relevant written information relating to
965the issue of whether the injury is a birth - related neurological
977injury. Ñ § 766.305(4), Fla. Stat.
98311. If NICA determines that the injury alleged in a claim
994is a compensable birth - related neurological injury, it may award
1005compensation to the claimant, provided that the award is approved
1015by the Administra tive Law Judge to whom the claim has been
1027assigned. § 766.305(7), Fla. Stat.
103212. In this matter, however, NICA has determined that
1041Petitioners Ó claim is not compensable under the Plan. Therefore,
1051NICA filed a n Unopposed Motion for Summary Final Order, requesting
1062an order be entered finding that the claim is not compensable.
107313. In ruling on NICA Ó s motion, section 766.309(1) provides
1084that the Administrative Law Judge must make the following
1093determination based upon the available evidence:
1099(a) Whether the injury claimed is a birth -
1108related neurological injury. If the claimant
1114has demonstrated, to the satisfaction of the
1121administrative law judge, that the infant has
1128sustained a brain or spinal cord injury caused
1136by oxygen deprivation or mech anical injury and
1144that the infant was thereby rendered
1150permanently and substantially mentally and
1155physically impaired, a rebuttable presumption
1160shall arise that the injury is a birth - related
1170neurological injury as defined in
1175s. 766.302(2).
117714. The term Ð birth - related neurological injury Ñ is defined
1189in section 766.302(2) as follows:
1194Ð Birth - related neurological injury Ñ means
1202injury to the brain or spinal cord of a live
1212infant weighing at least 2,500 grams for a
1221single gestation or, in the case of a multipl e
1231gestation, a live infant weighing at least
12382,000 grams at birth caused by oxygen
1246deprivation or mechanical injury occurring in
1252the course of labor, delivery, or
1258resuscitation in the immediate postdelivery
1263period in a hospital, which renders the infant
1271pe rmanently and substantially mentally and
1277physically impaired. This definition shall
1282apply to live births only and shall not
1290include disability or death caused by genetic
1297or congenital abnormality.
130015. Ð The [NICA] Statute is written in the conjunctive an d
1312can only be interpreted to require permanent and substantial
1321impairment that has both physical and mental elements. Ñ (emphasis
1331added) . Fla. Birth - Related Neurological Injury Comp. Ass Ó n v.
1344Fla. Div. of Admin. Hearings , 686 So. 2d 1349, 1356 (Fla. 1997) .
135716. The undisputed evidence establishes that Angel did not
1366sustain a Ð birth - related neurological injury Ñ as defined in
1378section 766.302(2). Dr. Willis concluded that an apparent
1386obstetrical event did occur to Angel that resulted in injury to
1397her brain. However, Dr. Sigurdardottir opined that Angel is not
1407currently suffering from substantial delays in her motor
1415abilities, and she only experiences mild to moderate delays in her
1426mental abilities. Dr. Sigurdardottir further commented that Angel
1434Ð has made go od progress with her developmental delays and
1445prognosis for full motor and me n tal recovery is good. Ñ Therefore,
1458based on the evidence in the record, Angel has not suffered a
1470Ð birth - related neurological injury Ñ and is not eligible for NICA
1483benefits.
1484DISPOS ITION
1486Based upon the foregoing Findings of Fact and Conclusions of
1496Law, it is ORDERED that the Petition is dismissed, with prejudice.
1507DONE AND ORDERED this 16 th day of October, 2018 , in
