76766.304 and 766.305(7), Florida Statutes, upon the Stipulation

84and Joint Petition for Compensation of Claim Arising Out of

94Florida Birth - Related Neurological Injury Pursuant to

102Chapter 766, Florida Statutes (Stipulation and Joint Petition),

110filed with the Division of Administrative Hearings on April 15,

1202019, for the entry of an order approving the resolution of a

132claim for compensation benefits filed in accordance with the

141provisions of cha pter 766 and a resolution of the exclusive

152remedy otherwise available as outlined in chapter 766.

160By the terms of their stipulation, Petitioner, Kassady

168OÓConner, as parent and natural guardian of Olivia OÓConner

177(Olivia) , a minor, and Respondent, Florida Birth - Related

186Neurological Injury Compensation Association (NICA), have agreed

193that Kassady OÓConner is the parent and natural guardian of

203Olivia ; that Olivia was born a live infant on or about February

21519, 2016, at Memorial Health Systems, Inc. , d/b/a Flo rida

225Hospital Memorial Medical Center, a ÐhospitalÑ as defined by

234section 766.302(6) located in Daytona Beach, Florida; and that

243OliviaÓs birth weight exceeded 2,500 grams. The Parties have

253further agreed that Meetesh Desai, M.D., provided obstetrical

261ser vices at Olivia's delivery and was a Ðparticipating

270physicianÑ in the Florida Birth - Related Neurological Injury

279Compensation Plan, as defined by section 766.302(7). The

287Parties have agreed that Olivia suffered a Ðbirth - related

297neurological injury,Ñ as tha t term is defined by section

308766.302(2), which was the sole and proximate cause of Olivia's

318current medical condition.

321It is ORDERED:

3241. The Stipulation and Joint Petition filed on April 15,

3342019, is hereby approved, and the Parties are directed to comply

345with the provisions of the Stipulation and Joint Petition.

3542. Petitioner, Kassady OÓConner, as the parent and natural

363guardian of Olivia OÓConner, a minor, is awarded one hundred

373thousand dollars ($100,000.00), pursuant to section

380766.31(1)(b)1., to be p aid as a lump sum to Kassady OÓConner;

392payment of benefits up to and including the effective date of the

404Stipulation and Joint Petition pursuant to section 766.31(1)(a),

412subject to the provisions of paragraph 19 of the Stipulation and

423Joint Petition; and p ayments of future expenses, as incurred.

4333. NICA will reimburse McMillen Law Firm, A Professional

442Association, attorneys for Petitioner, an agreed - upon attorneyÓs

451fee of $10,000.00 and expenses of $1,895.33 (one thousand eight

463hundred ninety - five dollars and thirty - three cents), totaling

474$11,895.33 in full for services rendered in the filing of this

486claim.

4874. Upon the payment of the award of $100,000.00, past

498benefit/expenses, and $11,895.33 for attorneyÓs fees and costs,

507the claims of Petitioner shall be deemed fully satisfied and

517extinguished, except for Respondent's continuing obligation under

524section 766.31(2) to pay future expenses, as incurred.

5325. The Division of Administrative Hearings retains

539jurisdiction over this matter to resolve any disputes, should

548they arise, regarding the PartiesÓ compliance with the terms of

558this Order.
