61This cause came for consideration on a Motion for Partial

71Summary Final Order filed by Respondent, Florida Birth - Related

90STATEMENT OF THE CASE

94On June 21, 2018, Petitioners, Joshua and Laura Eggnatz, on

104behalf of and as paren ts and natural guardians of, Asher Lee

116Eggnatz (ÐAsherÑ), a minor, filed a Petition for Benefits

125Pursuant to Florida Statute Section 766.301 et seq. (ÐPetitionÑ)

134with the Division of Administrative Hearings (ÐDOAHÑ) for a

143determination of compensability un der the Florida Birth - Related

153Neurological Injury Compensation Plan (ÐPlanÑ).

158The Petition named Kompal Gadh, M.D., as the physician who

168provided obstetric al services at Asher Ós birth on April 20,

1792017, at Memorial Hospital West (ÐMemorial HospitalÑ) in

187Pembroke Pines, Florida.

190DOAH served Dr. Gadh with a copy of the Petition on

201July 11, 2018, and served Memorial Hospital that same date.

211NICA was also served with a copy of the Petition on July 11,

2242018.

225On October 24, 2018, NICA filed its response to the

235Petition, taking the position that PetitionersÓ claim was not

244compensable under the Plan. NICA requested that DOAH schedule a

254hearing to determine compensability. NICA also requested that

262DOAH bifurcate the administrative proceeding to address the

270is sue of compensability and notice first.

277On November 5, 2018, Petitioners filed a Notice Regarding

286Hearing Requirement wherein they advised DOAH that they did not

296desire a final hearing and did not oppose a summary disposition

307based on the written records a nd reports filed in this matter.

319On November 6, 2018, NICA filed a Motion for Partial

329Summary Final Order, requesting the Administrative Law Judge

337enter a summary final order finding that the claim is not

348compensable because Asher did not suffer a Ðbirth - related

358neurological injuryÑ as defined in section 766.302(2). As of

367the date of this Order, Petitioners have not responded to NICAÓs

378motion.

379FINDINGS OF FACT

3821. Asher was born on April 20, 2017, at Memorial Hospital

393located in Pembroke Pines, Florida.

3982. Upon receiving the Petition, NICA retained Michael S.

407Duchowny, M.D., a pediatric neurologist, to review AsherÓs case.

416NICA sought to obtain an opinion whether there was an injury to

428AsherÓs brain or spinal cord at birth caused by oxygen

438deprivation o r mechanical injury occurr ing in the course of

449labor, delivery, or resuscitation in the immediate post - delivery

459period, and whether that injury rendered Asher permanently and

468substantially mentally and physically impaired.

4733. Dr. Duchowny reviewed AsherÓs medical records, as well

482as examined Asher on October 10, 2018. Dr. Duchowny opined,

492within a reasonable degree of medical probability:

499[I]t is my opinion that ASHERÓs neurological

506examination reveals neurological findings

510consistent with a mild motor impairment

516primarily affecting his right upper

521extremity. In contrast, Asher has preserved

527cognitive function and social awareness. He

533evidences slightly decreased muscle tone in

539the right distal upper and lower extremities

546and slightly increased deep te ndon reflexes.

553As such, it is my opinion that despite

561ASHERÓs abnormal MR imaging studies at birth

568which document prominent hemorrhagic

572infarction in territories supplied by the

578left middle and posterior cerebral arteries

584with a smaller region of right mid dle

592cerebral artery infarction, and bilateral

597parieto - occipital areas of increased signal,

604he has recovered to a point where he no

613longer evidences either substantive mental

618or physical impairment.

621Based upon my evaluation and record review,

628as ASHER is developing normally, I am not

636recommending him for acceptance into the

642NICA program.

6444. A review of the records filed in this matter reveals no

656contrary evidence to dispute the findings and opinion of

665Dr. Duchowny. His opinion is credible and persuasi ve.

6745. Based on the opinion and conclusion of Dr. Duchowny,

684NICA determined that PetitionersÓ claim was not compensable.

692NICA subsequently filed the Motion for Partial Summary Final

701Order asserting that Asher has not suffered a Ðbirth - related

712neurologica l injuryÑ as defined by section 766.302(2).

720Petitioners do not oppose NICAÓs motion.

726CONCLUSIONS OF LAW

7296. The undersigned, as an Administrative Law Judge, has

738exclusive jurisdiction over the subject matter of this

746proceeding. § 766.304, Fla. Stat.

7517. The Florida Legislature established the Plan Ðfor the

760purpose of providing compensation, irrespective of fault, for

768birth - related neurological injury claimsÑ relating to births

777occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

7888. The injure d infant, her or his personal representative,

798parents, dependents, and next of kin may seek compensation under

808the Plan by filing a claim for compensation with DOAH.

818§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

826which administers the Plan, then has Ð45 days from the date of

838service of a complete claim . . . in which to file a response to

853the petition and to submit relevant written information relating

862to the issue of whether the injury is a birth - related

874neurological injury.Ñ £ 766.305(4), Fla. Stat.

8809. If NICA determines that the injury alleged in a claim

891is a compensable birth - related neurological injury, it may award

902compensation to the claimant, provided that the award is

911approved by the Administrative Law Judge to whom the claim has

922b een assigned. § 766.305(7), Fla. Stat.

92910. In this matter, however, NICA determined that

937PetitionersÓ claim is not compensable under the Plan.

945Therefore, NICA filed a Motion for Partial Summary Final Order,

955requesting an order be entered finding that the claim is not

966compensable.

96711. In ruling on NICAÓs motion, section 766.309(1)

975provides that the Administrative Law Judge must make the

984following determination based upon the available evidence:

991(a) Whether the injury claimed is a birth -

1000related neurolo gical injury. If the claimant

1007has demonstrated, to the satisfaction of the

1014administrative law judge, that the infant has

1021sustained a brain or spinal cord injury

1028caused by oxygen deprivation or mechanical

1034injury and that the infant was thereby

1041rendered per manently and substantially

1046mentally and physically impaired, a

1051rebuttable presumption shall arise that the

1057injury is a birth - related neurological injury

1065as defined in s. 766.302 (2).

107112. The term Ðbirth - related neurological injuryÑ is

1080defined in section 7 66.302(2) as follows:

1087ÐBirth - related neurological injuryÑ means

1093injury to the brain or spinal cord of a live

1103infant weighing at least 2,500 grams for a

1112single gestation or, in the case of a

1120multiple gestation, a live infant weighing

1126at least 2,000 grams at birth caused by

1135oxygen deprivation or mechanical injury

1140occurring in the course of labor, delivery,

1147or resuscitation in the immediate

1152postdelivery period in a hospital, which

1158renders the infant permanently and

1163substantially mentally and physically

1167impaire d. This definition shall apply to

1174live births only and shall not include

1181disability or death caused by genetic or

1188congenital abnormality.

119013. ÐThe [NICA] Statute is written in the conjunctive and

1200can only be interpreted to require permanent and substant ial

1210impairment that has both physical and mental elements.Ñ Fla.

1219Birth - Related Neurological Injury Comp. AssÓn v. Fla. Div. of

1230Admin. Hearings , 686 So. 2d 1349, 1356 (Fla. 1997).

123914. The undisputed evidence establishes that Asher did not

1248sustain a Ðbirth - related neurological injuryÑ as defined in

1258section 766.302(2). Dr. Duchowny concluded that, at this time,

1267Asher has recovered from the incident that occurred at his birth

1278to a point Ðwhere he no longer evidences either substantial

1288mental or physical impa irmentÑ and is developing normally.

1297Therefore, based on the evidence in the record, Asher has not

1308suffered a Ðbirth - related neurological injuryÑ and is not

1318eligible for NICA benefits.

1322DISPOSITION

1323Based upon the foregoing Findings of Fact and Conclusions o f

1334Law, it is ORDERED that the Petition is dismissed, with

1344prejudice.

1345DONE AND ORDERED this 8 th day of January, 2019 , in
