48This cause came before the undersigned on RespondentÓs
56Motion for Summary Final Order (RespondentÓs Motion), filed
64January 22, 2019; and Peti tionerÓs Response, filed April 5,
742019.
75STATEMENT OF THE CASE
79On July 27, 2018, Petitioner filed a Petition for Benefits
89Pursuant to Florida Statute Section 766.301 et seq. (Petition)
98with the Division of Administrative Hearings (DOAH) for a
107determination of compensability under the Florida Birth - Related
116Neurological Injury Compensation Plan (Plan). The Petition
123named Gregory Delong, M.D., as the physician who provided
132obstetric services at the birth of Eleanor Elizabeth Ontiveros
141(Eleanor) on August 28, 2017, at Lower Keys Medical Center in
152Key West, Florida.
155On August 8, 2018, DOAH mailed a copy of the Petition to
167Respondent, Dr. Delong, and Lower Keys Medical Center.
175Respondent was served with the Petition on August 9, 2018.
185On December 13, 2018, R espondent filed its Response to
195Petition for Benefits, suggesting that the subject claim was not
205compensable, and requesting a hearing to address such issue.
214Thereafter, the final hearing was scheduled for March 7, 2019.
224On January 22, 2019, Respondent filed its Motion for
233Summary Final Order. Three days later, Respondent filed an
242Agreed Motion to Continue Final Hearing, wherein it was
251represented that Petitioner had requested of Respondent
258additional time to prepare a response to the Motion for Summary
269Final Order and the scheduled hearing. Said filing requested an
279order cancelling the final hearing and requiring the parties to
289provide the undersigned a status report. On January 29, 2019,
299the undersigned issued an O rder continuing the final hearing an d
311required the parties to submit a written status report on or
322before March 29, 2019.
326The parties timely filed status reports. Petitioner
333averred that she was prepared to reschedule the final hearing.
343Respondent requested that the undersigned rule upon RespondentÓs
351Motion. On March 29, 2019, the undersigned issued an O rder
362providing that Petitioner had the opportunity to file a response
372to RespondentÓs Motion within seven days. Petitioner filed a
381timely response.
383FINDINGS OF FACT
3861. Eleanor was bor n on August 28, 2017, at Lower Keys
398Medical Center in Key West, Florida. Eleanor was a single
408gestation weighing over 2,500 grams at birth.
4162. Respondent retained Donald Willis, M.D., an
423obstetrician specializing in maternal - fetal medicine, to review
432t he medical records of Eleanor and her mother, Laura Ann
443Ontiveros, and opine as to whether there was an injury to her
455brain or spinal cord that occurred in the course of labor,
466delivery, or resuscitation in the immediate postdelivery period
474due to oxygen d eprivation or mechanical injury. In his report,
485dated September 9, 2018, Dr. Willis set forth the following:
495The mother was admitted to the hospital at
50337 weeks gestational age in labor. A fetal
511heart rate (FHR) monitor tracing during
517labor was reviewed and showed no fetal
524distress. Delivery was by Cesarean section
530for arrest of dilation. Birth weight was
5372,857 grams. Amniotic fluid was clear.
544The baby was not depressed at birth. Apgar
552scores were 8/9. No resuscitation was
558required. Newborn physi cal exam states
564ÐHealthy Term Newborn.Ñ The baby failed the
571newborn hearing test in one ear. Newborn
578hospital course was otherwise uncomplicated
583and the baby was discharged home on DOL 2.
592Hearing evaluation after hospital discharge
597identified hearing loss in one ear. Records
604also indicate the child had Torticollis and
611limited mobility. MRI at 7 months of age
619identified a small Arachnoid cyst, slightly
625increased extra axial fluid and a simple
632pineal cyst. There were mention of findings
639suggestive of hypoxic ischemic
643encephalopathy (HIE).
645In summary, pregnancy was essentially
650uncomplicated. Cesarean section was done
655during labor for Arrest of Dilation. The
662baby was not depressed at birth with Apgar
670scores of 8/9. No resuscitation was
676required. T he baby was discharged home on
684DOL 2. MRI at 7 months of age did not
694describe findings consistent with HIE.
699There was no apparent obstetrical event that
706resulted in oxygen deprivation or mechanical
712trauma during labor, delivery or in the
719immediate post - delivery period.
7243. RespondentÓs Motion also relies upon Dr. WillisÓs
732January 14, 2019, affidavit, wherein he affirms, to a reasonable
742degree of medical probability, the above - quoted findings and
752opinions from the report.
7564. Respondent als o retained Michael S. Duchowny, M.D., a
766pediatric neurologist, to review the medical records of Eleanor
775and her mother, conduct an Independent Medical Examination (IME)
784of Eleanor, and opine as to whether Eleanor suffers from a
795permanent and substantial me ntal and physical impairment as a
805result of a birth - related neurological injury, as that term is
817defined in Section 766.302(2), Florida Statutes. Dr. Duchowny
825reviewed the medical records, obtained historical information
832from EleanorÓs mother, and perform ed an IME on November 28,
8432018.
8445. RespondentÓs Motion also relies upon the attached
852affidavit from Dr. Duchowny, dated January 14, 2019. In his
862affidavit, Dr. Duchowny testifies, as follows:
868It is my opinion that:
873In summary, EleanorÓs examinati on reveals
879neurological findings consistent with a
884diagnosis of ataxic hypotonic cerebral palsy
890associated with sensorineural and conductive
895hearing losses. Eleanor has preserved
900social awareness. It is premature to
906adequately assess cognitive functionin g
911although her speech output is obviously
917delayed. She evidences dysmorphism
921characterized by epicanthal folds and a
927saddle nasal bridge.
930A review of the medical records does not
938disclose any significant risk factors during
944labor or delivery. EleanorÓs Apgar scores
950were 8 and 9 at 1 and 5 minutes, and her
961post - natal course in the newborn nursery was
970unremarkable. MR imaging performed on
975April 26, 2018 revealed benign cysts of the
983right anterior temporal and pineal regions.
989Based on todayÓs evaluatio n and record
996review, I believe that EleanorÓs
1001neurological disabilities were acquired
1005prior to birth and did not result from
1013either oxygen deprivation or mechanical
1018injury in the course of labor or delivery.
10266. In his affidavit, Dr. Duchowny testifi es that his
1036opinions are to a reasonable degree of medical probability. A
1046review of the file, including PetitionerÓs Response, reveals
1054that no contrary evidence was presented to dispute the findings
1064and opinions of Drs. Willis and Duchowny. Their opinion s are
1075credited. 1/
1077CONCLUSIONS OF LAW
10807. DOAH has jurisdiction over the parties to and the
1090subject matter of these proceedings. §§ 766.301 - 766.316,
1099Fla. Stat.
11018. The Plan was established by the Legislature "for the
1111purpose of providing compensation, irrespective of fault, for
1119birth - related neurological injury claims" relating to births
1128occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
11399. The injured infant, her or his personal representative,
1148parents, dependents, and next of kin may se ek compensation under
1159the Plan by filing a claim for compensation with DOAH.
1169§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
1177which administers the Plan, has "45 days from the date of
1188service of a complete claim . . . in which to file a respon se to
1204the petition and to submit relevant written information relating
1213to the issue of whether the injury is a birth - related
1225neurological injury." § 766.305(4), Fla. Stat.
123110. If Respondent determines that the injury alleged is a
1241claim that is a compen sable birth - related neurological injury,
1252it may award compensation to the claimant, provided that the
1262award is approved by the Administrative Law Judge (ALJ) to whom
1273the claim has been assigned. § 766.305(7), Fla. Stat. If, on
1284the other hand, Respondent disputes the claims, as here, the
1294dispute must be resolved by the assigned ALJ in accordance with
1305the provisions of chapter 120, Florida Statutes. §§ 766.304,
1314766.309, and 766.31, Fla. Stat.
131911. In its present posture, the ALJ is required to make
1330the f ollowing threshold determination based upon the available
1339evidence:
1340(a) Whether the injury claimed is a birth -
1349related neurological injury. If the
1354claimant has demonstrated, to the
1359satisfaction of the administrative law
1364judge, that the infant has sustaine d a brain
1373or spinal cord injury caused by oxygen
1380deprivation or mechanical injury and that
1386the infant was thereby rendered permanently
1392and substantially mentally and physically
1397impaired, a rebuttable presumption shall
1402arise that the injury is a birth - relat ed
1412neurological injury as defined in
1417s. 766.303(2).
1419§ 766.309(1), Fla. Stat. An award may be sustained only if the
1431ALJ concludes that the Ðinfant has sustained a birth - related
1442neurological injury . . . .Ñ £ 766.31(1), Fla. Stat.
145212. The term "birth - related neurological injury" is
1461defined in section 766.302(2) as follows:
"1467Birth - related neurological injury" means
1473injury to the brain or spinal cord of a live
1483infant weighing at least 2,500 grams for a
1492single gestation or, in the case of a
1500multiple gest ation, a live infant weighing
1507at least 2,000 grams at birth caused by
1516oxygen deprivation or mechanical injury
1521occurring in the course of labor, delivery,
1528or resuscitation in the immediate
1533postdelivery period in a hospital, which
1539renders the infant permanen tly and
1545substantially mentally and physically
1549impaired. This definition shall apply to
1555live births only and shall not include
1562disability or death caused by genetic or
1569congenital abnormality.
157113. The undisputed evidence establishes that there was not
1580an injury to EleanorÓs brain or spinal cord caused by oxygen
1591deprivation or mechanical injury occurring in the course of
1600labor, delivery, or resuscitation in the immediate postdelivery
1608period in a hospital. Accordingly, Eleanor did not sustain a
1618birth - related neurological injury as defined in section
1627766.302(2), Florida Statutes, and, therefore, is not eligible for
1636benefits under the Plan.
1640CONCLUSION
1641Based on the foregoing Findings of Fact and Conclusions of
1651Law, it is ORDERED that RespondentÓs Motion for Summary Final
1661Order is granted, and PetitionerÓs claim is found and determined
1671to not be compensable. The Petition is dismissed with
1680prejudice.
1681DONE AND ORDERED this 9th day of April , 2019 , in
