49This came before the undersigned on RespondentÓs Motion for
58Partial Summary Final Order, filed May 1, 2019. In its Motion ,
69the Florida Birth - Related Neurological Injury Compensation
77Association ( NICA ) asserts that in order for a claim to be
90compensable under the Florida Birth - Related Neurological Injury
99Compensation Plan ( the Plan), the statutory prerequisites of
108s ection 766 .309, Florida Statutes, must be met, including:
118(1) The administrative law judge shall make
125the following determinations based upon all
131available evidence:
133(a) Whether the injury claimed is a birth -
142related neurological injury . . .
148(b) Whether obstetrical services were
153delivered by a participating p hysician in
160the course of labor, delivery, or
166resuscitation in the immediate postdelivery
171period in a hospital; or by a certified
179nurse midwife in a teaching hospital
185supervised by a participating physician in
191the course of labor, delivery, or
197resuscitatio n in the immediate postdelivery
203period in a hospital.
207* * *
210(2) If the administrative law judge
216determines that the injury alleged is not a
224birth - related neurological injury or that
231obstetrical services were not delivered by a
238participating physician at the birth, she or
245he shall enter an order . . . (emphasis
254suppl ied).
256The term Ðbirth - related neurological injuryÑ is defined in
266section 766.302(2) as:
269(2) ÐBirth - related neurological injuryÑ
275means injury to the brain or spinal cord of
284a live infant weighing at least 2,500 grams
293for a single gestation or, in the ca se of a
304multiple gestation, a live infant weighing
310at least 2,000 grams at birth caused by
319oxygen deprivation or mechanical injury
324occurring in the course of labor, delivery,
331or resuscitation in the immediate
336postdelivery period in a hospital, which
342render s the infant permanently and
348substantially mentally and physically
352impaired. This definition shall apply to
358live births only and shall not include
365disability or death caused by genetic or
372congenital abnormality. (emphasis added).
376Petitioner did n ot file a response to NICAÓs motion within
387the allowable response period. However, due to the dispositive
396nature of the motion, on May 22, 2019 , the undersigned entered
407an Order to Show Cause, affording Petitioner an additional
416opportunity to file a writt en response, should she so choose.
427Petitioner did not file a response to the Order to Show Cause.
439FINDINGS OF FACT
4421 . On July 5, 2018 , the Petitioner filed a Petition for
454Benefits pursuant to Florida Statute Section 766.301 et seq. for
464b enefits pursuant to s ections 766.301 - 766.316, Florida Statutes,
475otherwise known as the Plan.
4802 . The baby was born on October 13, 2014 , at Homestead
492Hospital. The circumstances of the labor, delivery and birth of
502the minor child are reflected in the medical records o f
513Homestead Hospital submitted with the Petition.
5193 . In the instant case, NICA has retained Donald Willis,
530M.D. as its medical expert specializing in maternal - fetal
540medicine pediatric neurology. Upon examination of the pertinent
548medical records, Dr . Willis opined:
554Nursery notes indicate Ðpatient with routine
560transition . Ñ Neurologic exam was normal.
567The baby was described as active, alert
574throughout the newborn hospital stay. Exam
580showed normal range of movement for all
587extremities. No EEGÓs or i maging studies
594were done prior to hospital discharge.
600Subsequently the child was diagnosed with
606cerebral palsy with spastic hemiplegia and
612partial seizures. MRI at about 20 - months of
621age showed Gilosis and encephalomalasia,
626likely related to old vascula r injury.
6334. Dr. WillisÓs m edical r eports dated October 23, 2018 ,
644and February 20, 2019 (which reviews additional medical
652records) , are attached to his Affidavit, with the Affidavit
661being attached to the motion as Exhibit Ð1 Ñ . His Affidavit
673reflects his ultimate opinion that:
678In summary, the baby did not appear to be
687depressed at birth. Apgar scores were 9/9.
694Transition was stated to be routine. This
701does not appear to be a birth related brain
710injury. The additional medical records are
716in agreement w ith my opinion that the baby
725did not suffer a birth related injury.
7325 . In the instant case, NICA has retained Michael S.
743Duchowny, M.D. as itÓs medical expert in pediatric neurology.
752Upon examination of the child and the pertinent medical records,
762Dr. Duchowny opined:
765NICOLE ANGUIANOÓs neurological evaluation
769reveals findings consistent with a mild - to -
778moderate right hemiparesis, in - toeing and
785circumducted gait, but stable and
790independent ambulation. She evidences delay
795in her expressive language d evelopment and a
803speech articulation deficit. There is a
809history of right - sided motor convulsions
816that are presently well - controlled.
822Dr. DuchownyÓs medical Report is attached to his Affidavit, with
832the Affidavit being attached to the motion as Exhibit Ð 2Ñ . His
845Affidavit reflects his ultimate opinion that:
851I am not recommending NICOLE ANGUIANO for
858inclusion within the NICA program. I
864believe that her neurological injuries
869resulted from a prenatal stroke that
875predated labor and delivery. Furthermore,
880Ni cole does not evidence substantial mental
887or motor impairments and thus does not have
895either a permanent substantial mental
900impairment nor a permanent substantial motor
906impairment.
9076 . The affidavits of Dr. Willis and Dr. Duchowny are the
919only eviden ce of record relating to the issue of whether the
931subject claim is compensable as defined by statute. As noted,
941Petitioner did not file a response to the motion, nor submit
952countervailing affidavits. The Petition, along with the
959Affidavits attached to th e motion, establish that there are no
970genuine issues of material fact regarding the compensability of
979this claim.
981CONCLUSIONS OF LAW
9847 . The Division of Administrative Hearings (DOAH) has
993jurisdiction over the parties to and the subject matter of these
1004pro ceedings. §§ 766.301 - 766.316, Fla. Stat.
10128 . The Plan was established by the Legislature Ðfor the
1023purpose of providing compensation, irrespective of fault, for
1031birth - related neurological injury claimsÑ related to births
1040occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
10519 . An injured infant, his or her personal representative,
1061parents, dependents, and next of kin may seek compensation under
1071the Plan by filing a claim for compensation with DOAH.
1081§§ 766.302(3), 766.303(2), and 766.3 05(1), Fla. Stat. Section
1090766.305(4) provides that NICA, which administers the Plan, has
109945 days from the date that a complete claim is served to file a
1113response to the petition and to submit relevant written
1122information relating to the issue of whether t he injury is a
1134birth - related neurological injury.
113910 . If NICA determines that the alleged injury is a birth -
1152related neurological injury that is compensable under the Plan,
1161it may award compensation to the claimant, provided that the
1171award is approved by the assigned administrative law judge.
1180§ 766.305(7), Fla. Stat. However, if NICA disputes the claim,
1190as it does in this case, the dispute must be resolved by the
1203assigned administrative law j udge in accordance with
1211chapter 120, Florida Statutes. §§ 7 66.304, 766.30, and 766.31,
1221Fla. Stat.
122311 . The first inquiry is whether the infant has sustained
1234a birth - related neurological injury as defined by section
1244766.302(2), which provides:
1247ÐBirth - related neurological injuryÑ means
1253injury to the brain or sp inal cord of a live
1264infant weighing at least 2,500 grams for a
1273single gestation or, in the case of
1280amultiple gestation, a live infant weighing
1286at least 2,000 grams at birth caused by
1295oxygen deprivation or mechanical injury
1300occurring in the course of labor, delivery,
1307or resuscitation in the immediate
1312postdelivery period in a hospital, which
1318renders the infant permanently and
1323substantially mentally and physically
1327impaired. This definition shall apply to
1333live births only and shall not include
1340disability or de ath caused by geneticor
1347congenital abnormality. (emphasis added).
135112 . If the administrative law judge determines that the
1361infant meets the statutory threshold for weight and has
1370sustained a brain or spinal cord injury caused by oxygen
1380deprivation o r mechanical injury, and that as a result of the
1392injury the infant was rendered permanently and substantially
1400mentally and physically impaired, then section 766.309(1)
1407provides that there is a rebuttable presumption that the injury
1417is a birth - related neuro logical injury.
142513 . In this case, the evidence does not support a finding
1437that the injury is a birth - related neurological injury. This
1448issue is dispositive with respect to compensability. Based upon
1457this evidence, Nicole Anguiano did not sustain a birth - related
1468neurological injury as defined in section 766.302(2), and is not
1478eligible for benefits under the Plan.
1484CONCLUSION
1485Based upon the Findings of Fact and Conclusions of Law
1495provided above, Petitioner Ó s claim is not compensable under the
1506Plan, and the Petition is dismissed with prejudice.
1514DONE AND ORDERED this 28th day of June , 2019 , in
