109filed with the Division of Administrative Hearings on January 3,

1192019, for the entry of an order approving the resolution of a

131claim for compensation benefits filed in accordance with the

140provisions of chapter 766 and a resolution of the exclus ive

151remedy otherwise available as outlined in chapter 766.

159By the terms of their stipulation, Petitioners, Ashley

167Mathis and Justin Bates, as parents and natural guardians of

177Aiden Bates (Aiden), a minor, and Respondent, the Florida Birth -

188Related Neurologi cal Injury Compensation Association (NICA),

195have agreed that Ashley Mathis and Justin Bates are the parents

206and legal guardians of Aiden, a minor; that Aiden was born a

218live infant on or about January 19, 2017, at Orlando Health,

229Inc., d/b/a Winnie Palmer Hospital for Women and Babies, a

239ÐhospitalÑ as defined by section 766.302(6) located in Orlando,

248Florida; and that AidenÓs birth weight exceeded 2,500 grams.

258The Parties have further agreed that Lisa Engel, M.D., provided

268obstetrical services at AidenÓs d elivery under the supervision

277of Jeannie McWhorter, M.D. The Parties stipulate that, at all

287material times, Dr. McWhorter was a Ðparticipating physicianÑ in

296the Florida Birth - Related Neurological Injury Compensation Plan,

305as defined by section 766.302(7). The Parties have agreed that

315Aiden suffered a Ðbirth - related neurological injury,Ñ as that

326term is defined by section 766.302(2).

332It is ORDERED:

3351. The Stipulation and Joint Petition filed on January 3,

3452019, is hereby approved, and the Parties are di rected to comply

357with the provisions of the Stipulation and Joint Petition.

3662. Petitioners, Ashley Mathis and Justin Bates, as the

375parents and legal guardians of Aiden, a minor, are awarded one

386hundred thousand dollars ($100,000.00), pursuant to section

3947 66.31(1)(b)1., to be paid as a lump sum to the parents; payment

407of benefits up to and including the effective date of the

418Stipulation and Joint Petition pursuant to section 766.31(1)(a),

426subject to the provisions of paragraph 19 of the Stipulation and

437Join t Petition; and payments of future expenses, as incurred.

4473. NICA will reimburse the McMillen Law Firm, P.A.,

456attorneys for Petitioners, an agreed - upon attorneyÓs fee of

466$10,000.00 and expenses of $255.94, totaling $10,255.94 in full

477for services rendered in the filing of this claim.

4864. Upon the payment of the award of $100,000.00, past

497benefit/expenses, and $10,255.94 for attorneyÓs fees and costs,

506the claims of Petitioners shall be deemed fully satisfied and

516extinguished, except for Respondent's continu ing obligation under

524section 766.31(2) to pay future expenses, as incurred.

5325. The Division of Administrative Hearings retains
