82STATEMENT OF THE CASE
86On September 28, 2018, Petitioners, Lindsey McNeil and
94Benjamin Galbraith, individually and as parents of Noelle
102Gal braith (Noelle), a minor, filed a Petition for Determination
112of Compensability Pursuant to Florida Statute Section 766.301
120et seq. (Petition) with the Division of Administrative Hearings
129(DOAH) for the determination of compensability under the
137Florid a Birth - Related Neurological Injury Compensation Plan
146(Plan).
147The Petition identified Kyle Crofoot, M.D., as the physician
156who provided obstetric al services at the birth of Noelle on
167February 9, 2017, at Adventist Health Systems/Sunbelt, Inc.,
175d/b/a Ad ventHealth Orlando (AdventHealth) 1/ in Orlando, Florida.
184DOAH served Dr. Crofoot with a copy of the Petition on
195October 16, 2018, and served AdventHealth that same date. NICA
205was also served with a copy of the Petition on October 16, 2018.
218On December 19, 2018, NICA filed its response to the
228Petition, taking the position that Petitioners claim is not
237compensable under the Plan. NICA requested that DOAH schedule a
247hearing to determine compensability.
251AdventHealth moved to intervene in this matter on
259February 4, 2019, which was granted.
265On October 11, 2019, NICA filed an Unopposed Motion for
275Summary Final Order, requesting the Administrative Law Judge
283enter a summary final order finding that the claim is not
294compensable under the NICA statute because Noelle did not suffer
304a birth - related neurological injury as defined in section
314766.302(2) , Florida Statutes . In its motion, NICA represent s
324that Petitioners do not oppose the motion. Petitioners have not
334otherwise responded to NICAs motion.
339FINDINGS OF FACT
3421. Noelle was born on February 9, 2017 , at AdventHealth
352located in Orlando , Florida.
3562. Upon receiving the Petition, NICA retained Donald
364Willis, M.D., a board certified obstetrician/gynecologist
370specializing in maternal - fetal medicine, as well as Laufey Y.
381Sigurdardottir, M.D., a pediatric neurologist, to review Noelle s
390medical condition . NICA sought to determine whether Noelle
399suffered a birth - related neurological injury as defined in
409section 766.302(2). Specifically, NICA requested its me dical
417experts render an opinion whether Noelle experienced an injury to
427the brain or spinal cord caused by oxygen deprivat ion or
438mechanical injury occurring in the course of labor, delivery, or
448resuscitation in the immediate post - delivery period ; a nd, if s o,
461whether th is injury rendered Noelle permanently and substantially
470mentally and physically impaired.
4743 . Dr. Willis reviewed Noelle s medical records and
484observed:
485A cephalohematoma was noted on admission to
492the nursery, but the baby was not felt to be
502i n acute distress. Neurologic exam was
509normal.
510* * *
513The child was seen in the ED at about 13 -
524months of age for head trauma related to a
533fall. MRI showed diffuse periventricular
538white matter volume loss. Evaluation at
544about 18 - months of age d escribed decrease
553movement of left arm and leg. A diagnosis of
562cerebral palsy with hemiplegia and partial
568epilepsy was made.
5714 . Dr. Willis then opined :
578In summary, vaginal delivery was complicated
584by a shoulder dystocia, lasting one - minute.
592The baby wa s not depressed with Apgar scores
601of 7/9. No resuscitation was required. The
608baby was transferred to the nursery at about
61616 hours after birth with decreasing blood
623sugars and desaturations occurred in the
629nursery. This would be after resuscitation
635in t he immediate post - delivery period.
643* * *
646This child suffered a brain injury as
653documented by the MRI findings. However, the
660brain injury does not appear to be birth
668related.
669* * *
672There was no apparent obstetrical event that
679resulted in oxygen deprivation or mechanical
685trauma to the brain or spinal cord during
693labor, delivery or the immediate post -
700delivery period.
7025 . Dr. Sigurdardottir also reviewed Noelles medical
710records, as well as conducted an independent medical exam of
720Noelle on November 28, 2018. Dr. Sigurdardottir opined, within a
730reasonable degree of medical probability:
735Noelle Galbraith has substantial delays in
741motor and mild delays in mental abilities.
748* * *
751Noelle has serious delays in motor milestones
758and carries diagnosis of hemiplegic cerebral
764palsy. She had delays in gross motor
771development.
7726 . Despite these findings, Dr. Sigurdardottir concluded
780that:
781In review of available documents, there is
788evidence of impairment consistent with a
794neurologic inju ry to the brain or spinal cord
803acquired due to oxygen deprivation or
809mechanical injury, but timing of injury to
816the labor, birth or immediate post natal
823period is not able to be determined.
830* * *
833I believe Noelle does not fulfill criteria of
841a su bstantial mental and physical impairment
848at this time. I do feel that Noelle should
857not be included in the NICA program.
8647 . A review of the file reveals no contrary evidence to
876dispute the findings and opinions of Dr. Willis and
885Dr. Sigurdardottir . Th eir opinions are credible and persuasive.
8958 . Based on the opinions and conclusions of Dr. Willis and
907Dr. Sigurdardottir, NICA determined that Petitioners claim was
915not compensable. NICA subsequently filed the Unopposed Motion
923for Summary Final Order ass erting that Noelle has not suffered a
935birth - related neurological injury as defined by section
944766.302(2). Petitioners do not oppose NICAs motion.
951CONCLUSIONS OF LAW
9549 . The Division of Administrative Hearings has jurisdiction
963over the parties and the subject matter of this proceeding
973pursuant to sections 766.301 through 766.316. The undersigned, as
982an Administrative Law Judge, has exclusive jurisdiction to
990determine whether a claim filed under [NICA] is compensable.
999§§ 766.301(1)(d), 766 .304, and 766.311(1), Fla. Stat .
100810 . The Florida Legislature established the Plan for the
1018purpose of providing compensation, irrespective of fault, for
1026birth - related neurological injury claims relating to births
1035occurring on or after January 1, 1989. § 766.303 (1), Fla. Stat.
10471 1 . To seek compensation under the Plan, the injured infant,
1059her or his personal representative, parents, dependents, and next
1068of kin may seek compensation under the Plan by filing a claim for
1081compensation with DOAH. §§ 766.302(3), 766.30 3(2), and
1089766.305(1), Fla. Stat. NICA, which administers the Plan, then has
109945 days from the date of service of a complete claim . . . in
1114which to file a response to the petition and to submit relevant
1126written information relating to the issue of whether the injury is
1137a birth - related neurological injury. § 766.305(4), Fla. Stat.
114712 . If NICA determines that the injury alleged in a claim
1159is a compensable birth - related neurological injury, it may award
1170compensation to the claimant, provided that the award is approved
1180by the Administrative Law Judge to whom the claim has been
1191assigned. § 766.305(7), Fla. Stat.
11961 3 . In this matter, however, NICA determined that
1206Petitioners claim is not compensable under the Plan. Therefore,
1215NICA filed the Unopposed Moti on for Summary Final Order,
1225requesting an order be entered finding that the claim is not
1236compensable.
123714 . In reviewing the compensability of a claim, section
1247766.309(1) directs the Administrative Law Judge to make the
1256following determination based upon th e available evidence:
1264(a) Whether the injury claimed is a birth -
1273related neurological injury. If the claimant
1279has demonstrated, to the satisfaction of the
1286administrative law judge, that the infant has
1293sustained a brain or spinal cord injury caused
1301by oxygen deprivation or mech anical injury and
1309that the infant was thereby rendered
1315permanently and substantially mentally and
1320physically impaired, a rebuttable presumption
1325shall arise that the injury is a birth - related
1335neurological injury as defined in
1340s. 766.302(2).
134215 . The term birth - related neurological injury is defined
1354in section 766.302(2) as follows:
1359Birth - related neurological injury means
1365injury to the brain or spinal cord of a live
1375infant weighing at least 2,500 grams for a
1384single gestation or, in the case of a multiple
1393gestation, a live infant weighing at least
14002,000 grams at birth caused by oxygen
1408deprivation or mechanical injury occurring in
1414the course of labor, delivery, or
1420resuscitation in the immediate postdelivery
1425period in a hospital, which renders the infant
1433per manently and substantially mentally and
1439physically impaired. This definition shall
1444apply to live births only and shall not
1452include disability or death caused by genetic
1459or congenital abnormality.
146216 . The [NICA] Statute is written in the conjunctive and
1474can only be interpreted to require permanent and substantial
1483impairment that has both physical and mental elements. Fla.
1492Birth - Related Neurological Injury Comp. Assn v. Fla. Div. of
1503Admin. Hearings , 686 So. 2d 1349, 1356 (Fla. 1997).
151217 . In reviewing the injury in this matter, the undisputed
1523evidence establishes that Noelle did not sustain a birth - related
1534determined that Noelles brain injury did not appear to be birth
1545related. Conseq uently, he concluded that, There was no apparent
1555obstetrical event that resulted in oxygen deprivation or
1563mechanical trauma to the brain or spinal cord during labor,
1573delivery or the immediate post - delivery period. Similarly,
1582Dr. Sigurdardottir opined th at Noelle only had mild delays in
1593mental abilities. Further, she could not connect Noelles
1601injury to the labor, birth , o r immediate post - natal period.
161318 . Accordingly, based on the available evidence in the
1623record, the undersigned determines that Noe lle has not suffered a
1634birth - related neurological injury and is not eligible for NICA
1645benefits .
1647DISPOSITION
1648Based upon the foregoing Findings of Fact and Conclusions of
1658Law, it is ORDERED that the Petition is dismissed, with prejudice.
