131P RELIMINARY S TATEMENT
135On January 4, 2019, Peti tioners filed a Petition for Benefits Filed Under
148Protest Pursuant to Florida Statute Section 766.301 et seq. (Petition). On
159February 7, 2019, t he undersigned issued an Order G ranting Good
171Samaritans Motion to Intervene. On the same date, the undersigne d issued
183an Order G ranting Palm Beachs Motion to Intervene. On June 12, 2019,
196Respondent filed its Notice of Compensability and Request for Evidentiary
206Hearing, suggesting that the subject claim is compensable and requesting an
217evidentiary hearing. On Jun e 13, 2019, the undersigned issued an Order
229requiring the parties to advise by June 26, 2019, whether a hearing would be
243required.
244On July 31, 2019, Petitioners original legal counsel filed a motion to
256withdraw as counsel, and said motion was granted on August 8, 2019.
268Thereafter, on September 4 , 2019, this matter came before the undersigned
279on a previously - noticed telephonic status conference. Petitioner, Yanara
289Avila - Cana, participated in the conference pro se and an interpreter was
302provided for Petiti oner. During the telephonic status conference, Petitioner s
313requested a 60 - day extension to evaluate Respondents acceptance of
324Petitioners claim as compensable and to seek new legal counsel. Neither
335Respondent nor Intervenors objected to the requested ext ension. Accordingly,
345on September 4, 2019, an Order Granting Extension of Time was issued,
357granting Petitioners a n extension of time of 60 days to seek new legal counsel
372and evaluate Respondents Notice of Compensability. Petitioners were
380further ordered t o submit a written status report, on or before November 4,
3942019, advising whether Petitioners intend ed to accept the Florida Birth -
406Related Neurological Injury Compensation Association ( NICA ) benefits or
416whether a final hearing would be required.
423On Octob er 22, 2019, Respondent filed a Motion for Summary Final Order
436contending the claim is compensable under the Florida Birth - Related
447Neurological Injury Plan (Plan). On October 25, 2019, Good Samaritan filed a Motion for Summary Final Order, also contending that the claim is
470compensable under the Plan. On October 28 , 2019, Petitioners, pro se, filed a
483Notice of Election of Remedies Declining NICA Benefits, and requested that
494the instant matter with the Division of Administrative Hearings (DOAH)
504shall be clos ed with prejudice.
510On October 30, 2019, Petitioners current counsel filed a notice of
521appearance. On October 31, 2019, Petitioners, now through counsel, filed the
532following: an Amended Petition Under Protest (Amended Petition); an
541Objection to Defendant s Motion for Summary Final Order and Motion for a
554Stay of Deadlines (Petitioners Objection); and a Notice of Election of
565Remedies Declining NICA Benefits (Petitioners Notice). Pursuant to
573Petitioners Objection, Petitioners requested 60 days to respond t o the
584pending motions for summary final order and to conduct necessary discovery
595to respond to the same. Pursuant to Petitioners Notice, Petitioners
605represented that they have willfully and voluntarily elected not to pursue any NICA benefits, and do no t wish to seek any award or any benefits of
633any kind. Petitioners requested that the instant matter with DOAH be
644closed with prejudice.
647On November 20, 2019, Palm Beach filed a Motion For Summary Final
659Order , contending Petitioners claim is compensab le under the Plan.
669On November 21, 2019, a telephonic motion hearing was conducted
679regarding Petitioners Notice, with counsel for all parties in attendance. In response to the undersigneds inquiry, Petitioners counsel represented and confirmed that it was Petitioners intent that the undersigned construe
709Petitioners Notice as a notice of dismissal with prejudice. Accordingly, on November 25, 2019, the undersigned issued a Final Order of Dismissal with prejudice.
733Thereafter, this matter came before t he undersigned on Petitioners
743Motion for Rehearing and/or Motion for Relief Based on Mistake,
753Inadvertence, Surprise, or Excusable Neglect and/or Exception of Court
762Order Entered on November 25, 2019 (Petitioners Motion), filed
771December 10, 2019. Palm B each and Good Samaritan filed their respective
783Notice of Joinder in Petitioners Motion. Subsequently, the undersigned
792granted Petitioners Motion, and the November 25, 2019, Final Order of
803Dismissal was rescinded and the file at DOAH was reopened.
813Upon reopening the matter, on December 19, 2019, a telephonic case
824management conference was conducted to address the pending motions for
834summary final order as well as Petitioners Objection. On the same date, the
847undersigneds Order Extending Time to Conduct Discovery and Respond to
857Pending Motions for Summary Final Order was issued. It was ordered that:
8691) all discovery, including written responses to written discovery and
879depositions, was to be completed within 50 days from the date of this Order;
893and 2) the parties could resubmit any previously filed motions for summ ary
906final order, if they so cho se , based on the co mpleted discovery. Petitioners
920were granted 60 days from the date of this Order to file any response to the
936pending motions for summary final ord er.
943After multiple extensions of time, on May 21, 2020, the existing discovery
955Order was again extended for 30 days to complete limited remaining
966discovery. On June 10, 2020, an Order Requiring Response was issued
977directing the parties to file a joint re sponse providing several mutually
989agreeable dates in which to conduct the hearing, an estimate of the time required to conduct the hearing, and the parties preferred mode for conducting the hearing (in - person, video - teleconference, or Zoom meeting). In
1026re sponse, a s tatus r eport was filed, wherein the parties requested an
1040evidentiary hearing on the issue of compensability as raised in the motions at issue , and a separate final hearing on whether the notice r equirements of
1066section 766.316 were satisfied.
1070T he evidentiary hearing on compensability was conducted on July 30,
10812020, with counse l for all parties in attendance. On August 5, 2020, the
1095undersigned issued a Partial Summary Final Order gra n ting Respondent and
1107Intervenors respective motions for partial summary final order addressing
1116compensability. Petitioners claim was found and determined to be
1125compensable. Jurisdiction was reserved to determine whether the notice
1134requirements of section 766.31 were satisfied and to determine an award pursuant to sec tion 766.31.
1150On August 20, 2020, p ursuant to notice, a final hearing on the issue of
1165notice was held by Zoom Conference. At the hearing, Good Samaritan
1176presented the live testimony of one witness, Dianne Jimenez. The parties
1187further stipulated and mutual ly agreed to the presentation of their respective
1199cases solely by the admission of deposition transcripts, affidavits, and documents attached to and in support of their previously filed motions; and
1221Petitioners Notice of Filing Exhibits. The identity of t he exhibits and rulings
1234regarding each are as set forth in the final hearing T ranscript, which was
1248filed on August 28, 2020.
1253Upon the conclusion of the final hearing, the parties stipulated to the
1265submission of proposed final orders within 30 days of the filing of the
1278transcript and to the issuance of the undersigneds Final Order on or before 60 days from the filing of the T ranscript. The parties timely filed proposed
1305final orders, which have been considered in the preparation of this Final
1317Order.
1318F IND INGS O F F ACT
13251. Petitioners , Yanara Avila - Cana and Julio Cesar Hassan Herrera, are
1337the parents and natural guardians of Scarlett Hassan - Avila, a minor.
13492. Ms. Avila - Cana graduated from law school in Cuba in 2005, and was a
1365practicing lawyer until 2011, wh en she began residing in the United States of
1379America.
13803. On June 15, 2016, Intervenor Palm Beach began provi di ng prenatal
1393care to Ms. Avila - Cana. Dr. Lazo credibly testified that it was Palm Beachs
1408policy and practice to provide every new patient with a brochure prepared by
1421NICA entitled Peace of Mind for an Unexpected Problem (NICA brochure)
1432and to go over the content s of the brochure as part of the patients prenatal
1448packet. The NICA brochure includes a clear and concise explanation of a
1460patients ri ghts and limitations under the Plan.
14684. Palm Beachs customary policy and practice was to provide the new
1480patient the NICA brochure in the patients primary language. NICA
1490brochures printed in Spanish, English, and Creole were available in the office.
15025. On June 15, 2016, Ms. Avila - Cana was seen at Palm Beach by Barbara
1518Telan, ARNP, CNM (Midwife Telan). Midwife Telans duties included seeing patients in the office, delivering babies, and assisting in surgery. For new patients, Midwife Telan would obtain a patients history, conduct a physical
1551examination, explain Palm Beachs practice, obtain an ultrasound, and explain to the patient Palm Beachs Palm Beach Obstetrics & Gynecology -
1572Obstetric Informed Consent (consent form).
15776. On June 15, 2016, Midwife T elan provided Ms. Avila - Cana with the
1592consent form. The four - page consent form addressed several topics including:
1604genetic testing, routine testing, medications, vaccinations, and labor and
1613delivery. Of significance to this proceeding, on the last page of the consent
1626form, the following is provided:
1631I was furnished information prepared by the
1638Florida Birth - Related Neurological Injury
1644Compensation Association (NICA) pursuant to Section 766.316, Florida Statutes, and was advised
1656that our Doctors (Samuel Le derman, MD, Gloria
1664Hakkarainen MD, Sylvia Siegfried MD, Joy Cavalaris MD, Lori Sevald MD, Marcela Lazo MD,
1678Marilynn Nunez and Barbara Telan CNM) are
1685participating physicians in that program. By participating in this program, limited compensation is availab le in the event that certain types of
1707qualifying neurological injuries occurs during labor,
1713delivery or resuscitation in the hospital. For specifics about the program, I understand that I can contact the Florida Birth - Related Neurological
1736Injury Compensati on Association (NICA), at
1742PO Box 14567, Tallahassee, FL 32317, Tel No. 1.800.398.2129. I further acknowledge that I have received a copy of the brochure prepared by NICA.
1766I acknowledge that I read this form and fully
1775understand its contents. I was given ample
1782opportunity to ask questions and all questions were answered to my satisfaction.
1794I also acknowledge that I was given a copy of this
1805form so that my family and I can review its contents at home and ask questions in the future.
18247. Immediately belo w the above - quoted language, the form contains a
1837signature line for the patient and a signature line for a witness. Ms. Avila -
1852Cana concedes that she printed her name on the consent form, and signed her
1866name above the Patient line. Her signature on the co nsent form was
1879witnessed by Midwife Telan.
18838. The consent form provided to Ms. Avila - Cana was printed in English;
1897however, Ms. Avila - Canas primary language is Spanish. Accordingly, Sandra
1908Hoyos, Palm Beachs Surgical Coordinator, who speaks English and Sp anish,
1919assisted Midwife Telan during the initial prenatal visit. Although neither
1929Midwife Telan nor Ms. Hoyos have an independent recollection of the visit,
1941they credibly testified that, pursuant to their customary and routine practice,
1952Midwife Telan would explain the consent form in its entirety with the new
1965patient, and Ms. Hoyos would translate the same from English to Spanish.
1977Indeed, handwritten on the consent form provided to Ms. Avila - Cana is the
1991following notation: Explanation in Spanish by Sandra Hoyos. Midwife Telan
2001credibly testified that the notation was her handwriting.
20099. Midwife Telan and Ms. Hoyos testified that , pursuant to Palm Beachs
2021customary practice and routine, Ms. Avila - Cana was provided with the NICA
2034brochure on June 15, 2016. Th ereafter, pursuant to Palm Beachs customary
2046practice, the executed consent form was scanned into Ms. Avila - Canas
2058medical chart.
206010. Ms. Avila - Cana testified at her deposition that she did not receive a
2075NICA brochure from Palm Beach. Her deposition testim ony is contradicted by
2087the deposition testimony of Midwife Telan and Ms. Hoyos. The undersigned
2098finds, based upon the totality of credible evidence, that it is more likely than
2112not that Ms. Avila - Cana was provided a NICA brochure during her prenatal
2126visit at Palm Beach on June 15, 2016; and that Palm Beach provided notice
2140to Ms. Avila - Cana of its participation in the Plan.
215111. Ms. Avila - Cana presented to Good Samaritan on January 8, 2017. On
2165this occasion, she was presented with a form entitled Notice to Obstetrical
2177Patient. This form provided as follows:
2183I have been furnished information by Good
2190Samaritan Medical Center prepared by the Florida Birth Related Neurological Injury Compensation
2202Association, and have been advised that this
2209hospital participat es in that program. Physicians
2216and midwives and their groups providing care at the Good Samaritan Medical Center, are or may be
2233participating in that program, wherein certain
2239limited compensation is available is available in the event certain neurological injury may occur during
2254labor, delivery or resuscitation. For specifics on this program, I understand that I can contact:

231812. The form also contained the above - quoted language in Spanish and
2331Creole.
233213. Immediately below the above - quoted la nguage, the form contains a
2345line for the NAME OF PATIENT PRINTED,a line for SIGNATURE OF
2357PATIENT, a line for SIGNATURE OF WITNESS, and a line for NAME
2371OF WITNESS PRINTED. Ms. Avila - Cana concedes that, on January 8,
23832017, Good Samaritan provided her with the form, and that her name and
2396signature is on the form.
240114. Ms. Avila - Cana testified, however, that she did not recall reading the
2415document (or any document provided her on that occasion). She further
2426testified that nobody explained anything abou t NICA to me and that she
2439did not receive the NICA brochure as indicated on the form.
245015. On January 16, 2017, Ms. Avila - Cana again presented to Good
2463Samaritan. Dianne Jimenez, who was employed by Good Samaritan as a
2474patient access registrar, conducted t he registration process for Ms. Avila -
2486Cana. Ms. Jimenez is fluent in Spanish and regularly communicates in
2497Spanish with patients who present to the hospital. Ms. Jimenez credibly
2508testified that she had no difficulty in communicating with Ms. Avila - Cana.
25211 6. On this occasion, Ms. Avila - Cana was being admitted to the Labor and
2537Delivery department. As part of the obstetrical packet, and pursuant to Good
2549Samaritans customary practice, Ms. Jimenez presented Ms. Avila - Cana with
2560the same Notice to Obstetrical Pa tient form as described above. Ms. Jimenez
2573credibly testified that she provided Ms. Avila - Cana a chance to read the form
2588in Spanish prior to asking her to sign. Ms. Avila - Cana again printed her
2603name and signed the form. The form was then witnessed by Ms. J imenezs
2617signature.
261817. Ms. Jimenez also provided credible testimony that she provided the
2629NICA brochure in Spanish. She credibly testified that it was her routine
2641practice to explain to the patient that the brochure explains what would
2653happen if the baby had a neurological injury, and that if the patient had any
2668questions to call the telephone number on the form and contained in the
2681NICA brochure.
268318. Ms. Avila - Cana testified that, despite her signature on the form, she
2697again did not receive the NICA bro chure on January 16, 2017. Her deposition
2711testimony is contradicted by the deposition testimony of Ms. Jimenez. The
2722undersigned finds, based upon the totality of credible evidence, that it is more likely than not that Ms. Avila - Cana was provided a NICA bro chure during
2750her hospital visits to Good Samaritan on January 8, 2017, and January 16, 2017; and that Good Samaritan provided notice to Ms. Avila - Cana of its
2777participation in the Plan.
2781C ONCLUSIONS O F L AW
278719 . DOAH has jurisdiction over the parties to and the subject matter of
2801these proceedings. §§ 766.301 - 766.316, Fla. Stat.
280920 . The Plan was established by the Legislature for the purpose of
2822providing compensation, irrespective of fault, for birth - related neurological
2832injury claims relating to births occ urring on or after January 1, 1989.
2845§ 766.303(1), Fla. Stat.
284921 . Section 766.301(2) provides that it is the intent of the Legislature to
2863provide compensation, on a no - fault basis, for a limited class of catastrophic
2877injuries that result in unusually hig h costs for custodial care and
2889rehabilitation. The injured infant, her or his personal representative,
2898parents, dependents, and next of kin may seek compensation under the Plan
2910by filing a claim for compensation with DOAH. §§ 766.302(3), 766.303(2),
2921and 766.305(1), Fla. Stat. The ALJ has exclusive jurisdiction to determine
2932whether a claim filed under the Plan is compensable. § 766.304, Fla. Stat.
294522 . In discharging this responsibility, pursuant to section 766.309(1), the
2956ALJ must make the following deter minations based upon all available
2967evidence:
2968(a) Whether the injury claimed is a birth - related
2978neurological injury. If the claimant has
2984demonstrated, to the satisfaction of the
2990administrative law judge, that the infant has
2997sustained a brain or spinal cor d injury caused by
3007oxygen deprivation or mechanical injury and that
3014the infant was thereby rendered permanently and
3021substantially mentally and physically impaired, a
3027rebuttable presumption shall arise that the injury
3034is a birth - related neurological injury as defined in
3044s. 766.302 (2).
3047(b) Whether obstetrical services were delivered by a
3055participating physician in th e course of labor,
3063delivery, or resuscitation in the immediate
3069postdelivery period in a hospital; or by a certified
3078nurse midwife in a teaching hospital supervised by
3086a participating physician in the course of labor,
3094delivery, or resuscitation in the immed iate
3101postdelivery period in a hospital.
3106(c) How much compensation, if any, is awardable
3114pursuant to s. 766.31 .
3119(d) Whether, if raised by the claimant or other
3128party, the factual determinations regarding the
3134notice requirements in s. 766.316 are satisfied.
31412 3 . At issue here is whether Intervenors Palm Beach and Good Samaritan
3155complied with the notice requirements of section 766.316. Specifically, with
3165respect to Palm Beach, Petitioners contend that Palm Beachs consent form
3176was not f urnished by NICA, and, therefore, is insufficient. Petitioners also
3188maintain that the notice requirements were not met because Ms. Avila - Cana
3201did not receive a copy of the NICA brochure, which was furnished by NICA,
3215from Palm Beach or Good Samari tan. 1
322324. As the proponents of the proposition that appropriate notice was given
3235or that notice was not required, the burden on the issue of notice is upon
3250Palm Beach and Good Samaritan . Tabb v. Fla. Birth - Related Neurological
3263Injury Comp. Assn , 880 So. 2d 1253, 1257 (Fla. 1st DCA 2004).
32752 5 . Section 733.316 provides as follows:
3283Notice to obstetrical patients of participation
3289in the plan. Each hospital with a participating
3298physician on its staff and each participating
3305physician, other than residents, a ssistant residents,
3312and interns deemed to be participating physicians
3319under s. 766.314 (4)(c), under the Florida Birth -
3328Related Neurological Injury Compensation Plan
3333shall provide notice to the obstetrical patients as to
3342the limited no - fault alternative for birth - related
3352neurological injuries. Such notice shall be provided
3359on forms furnished by the association and sha ll
3368include a clear and concise explanation of a
3376patients rights and limitations under the plan. The
3384hospital or the participating physician may elect to
3392have the patient sign a form acknowledging receipt
3400of the notice form. Signature of the patient
3408acknow ledging receipt of the notice form raises a
3417rebuttable presumption that the notice
3422requirements of this section have been met. Notice
3430need not be given to a patient when the patient has
3441an emergency medical condition as defined in
3448s. 395.002 (8)(b) or when notice is not practicable.
34571 Petitioners in their Proposed Final Order do not make a specific argument that Good
3472Samaritan failed to comply with the requirements of section 766.316; however, as Petitioners
3485are not advocating for NICA benefits, Good Samaritans notice compliance is addressed.
349726. Petitioners contentions that Palm Beach failed to provide the NICA
3508brochure an d failed to provide notice to Ms. Avila - Cana on forms furnished
3523by the association, is not supported by the evidence.
353327. As set forth in the Findings of Fact, the greater weight of the evidence
3548establishes that, on June 15, 2016, Palm Beach provided Ms . Avila - Cana with
3563the NICA brochure in Spanish. The brochure is furnished by NICA and
3575includes a clear and concise explanation of a patients rights and limitations under the Plan.
359028. Palm Beach elected to have Ms. Avila - Cana sign its consent form
3604acknowl edging her receipt of the NICA brochure. The consent form also
3616provided notice to Ms. Avila - Cana of its participating physicians in the Plan.
3630Pursuant to section 766.316, Ms. Avila - Canas signature on the consent form,
3643acknowledging receipt of the NICA bro chure, raises a rebuttable presumption
3654that the notice requirements of section 766.316 have been met.
366429. While Ms. Avila - Cana testified that she did not receive the NICA
3678brochure, her testimony on this issue is contradicted by the testimony of
3690Midwife Te lan and Ms. Hoyos, whose testimony is found to be more credible.
3704Accordingly, it is concluded that Palm Beach met its burden of establishing it
3717satisfied the notice requirements of section 766.316.
372430. As set forth in the Findings of Fact, the greater wei ght of the evidence
3740establishes that, on January 8, 2017, and again on January 16, 2017, Good Samaritan provided Ms. Avila - Cana with the NICA brochure in Spanish. The
3766brochure is furnished by NICA and includes a clear and concise explanation
3778of a patients rights and limitations under the Plan.
378731. On both occasions Good Samaritan elected to have Ms. Avila - Cana
3800sign its consent form acknowledging her receipt of the NICA brochure. The consent form also provided notice to Ms. Avila - Cana of Good Samaritans
3825p articipation in the Plan. Ms. Avila - Canas signature on the consent form,
3839acknowledging receipt of the NICA brochure, raises a rebuttable presumption
3849that the notice requirements of section 766.316 have been met.
385932. Ms. Avila - Canas testimony that she di d not receive the NICA
3873brochure on January 8, 2017 , or January 16, 2017, was contradicted by
3885Ms. Jiminez, whose testimony was found to be more credible. Accordingly, it
3897is concluded that Good Samaritan met its burden of establishing it satisfied
3909the notic e requirements of section 766.316.
391633. Petitioners failed to present sufficient evidence that the Intervenors
3926did not provide notice on forms furnished by NICA or that the Intervenors
3939consent form is insufficient or defective. The NICA brochure is the fo rm
3952furnished by NICA that satisfies the statutory requirement of a clear and
3964concise explanation of a patients rights under the plan. Dianderas v. Fla. Birth - Related Neurological , 973 So. 2d 523, 527 (Fla. 5th DCA 2007).
3989Petitioners failed to present su fficient evidence that NICA furnishes a
4000required form that, in addition to the brochure, hospitals and participating physicians must utilize in satisfying the notice requirement.
4019C ONCLUSION
4021Based on the foregoing Findings of Fact and Conclusions of Law, it is
4034ORDERED:
40351. Intervenors Marcela Andrea Lazo, M.D.; Barbara Telan, ARNP, CNM;
4045and Palm Beach Obstetrics and Gynecology, P.A., satisfied the notice
4055requirements of section 766.316.
40592. Intervenor Good Samaritan Medical Center, Inc. , satisfied the noti ce
4070requirements of section 766.316.
40743 . The parties are accorded 30 days from the date of this Order to resolve,
4090subject to approval of the ALJ, the amount and manner of payment of an
4104award to Petitioner s ; the reasonable expenses incurred in connection with the
4116filing of the claim, including reasonable attorneys fees and costs; and the
4128amount owing for expenses previously incurred. If not resolved within such
4139period, the parties shall so advise the ALJ, and a hearing will be scheduled to
4154resolve such issues . Once resolved, an award will be made consistent with
4167section 766.31.
