53On August 20, 2019, Petitioners and Respondent filed a

89On August 21, 2019, the administrative law judge entered an
99Order instructing Intervenor to notify the Division o f
108Administrative Hearings no later than August 28, 2019, whether
117he objected to the entry of a f inal o rder approving the
130Stipulation and Joint Petition. That same day, Intervenor filed
139a response stat ing that he had no objection to the entry of a

162Petitioner s and Respondent seek the entry of an order
172approving the resolution of a claim for benefits filed in
182accordance with the provisions of chapter 766 , Florida Statutes .
192FINDINGS OF FACT
195Based on the stipulation of Petitioner s and Respondent, the
205following facts are found:
2091. Elizabeth Midland and Christopher Midland (Petitioners)
216are the parents and legal guardians of Jolee Harper Midland
226(Jolee), and are the ÐClaimantsÑ as defined by section
235766.30 2(3).
2372. Jolee incurred a Ðbirth - related neurological injuryÑ as
247defined in section 766.302(2), on or about January 18, 2018,
257which was the sole and proximate cause of JoleeÓs current
267medical condition.
2693. At birth, Jolee weighed 2,850 grams.
2774. Stephan ie Caywood, M.D., rendered obstetrical services
285in the delivery of Jolee and, at all times material to this
297proceeding, was a Ðparticipating physicianÑ as defined in
305section 766.302(7).
3075. Fort Walton Beach Medical Center is a hospital located
317in Fort Wal ton Beach, Florida, and is the ÐhospitalÑ as that
329term is defined in section 766.302(6).
3356. Petitioners filed a petition pursuant to section
343766.305, seeking compensation from the Florida Birth - Related
352Neurological Injury Compensation Association ( NICA ) , and that
361petition is incorporated herein by reference in its entirety,
370including all attachments. Any reference made within this
378document to NICA encompasses, where appropriate, the Florida
386Birth - Related Neurological Injury Compensation Plan (Plan).
394CONCL USIONS OF LAW
3987. The Division of Administrative Hearings has
405jurisdiction over the subject matter and the parties to this
415proceeding pursuant to section 766.301.
4208. Section 766.305(7) requires the presiding
426administrative law judge to approve the settlem ent of any claim
437where NICA determines that the injury is compensable.
445CONCLUSION
446Based on the Findings of Fact and Conclusion s of Law,
457It is ORDERED:
4601. The Stipulation and Joint Petition filed August 20,
4692019, is approved, and the parties are directed t o comply with
481the provisions of the Stipulation and Joint Petition.
4892. Petitioners, Elizabeth Midland and Christopher Midland,
496as the parents and legal guardians of Jolee Harper Midland, are
507awarded one hundred thousand dollars ($100,000), to be paid to
518t he parents as periodic payments, pursuant to section
527766.31(1)(b), as well as payment of benefits as authorized
536pursuant to section 766.31(1)(a), subject to the provisions of
545paragraph 19 of the partiesÓ Stipulation and Joint Petition.
5543. Upon the payment of the award of $100,000, and past
566benefits/expenses, PetitionersÓ claims shall be deemed fully
573satisfied and extinguished, except for RespondentÓs continuing
580obligation under section 766.31(2) to pay future expenses as
589incurred.
5904. The Division of Admin istrative Hearings retains
598jurisdiction over this matter to resolve any disputes, should
607they arise, regarding the partiesÓ compliance with the terms of
617this Order.
