54This cause came for consideration on a Motion for Summary
64Final Order filed by Respondent, Florida Birth - Related
73Neurological Injury Compensation Association ( NICA ), on
83August 29, 2019.
86STATEMENT OF THE CASE
90On January 30, 2019, Petitioners, Ashley Andrews and Halen
99McFadden, as parents and natural guardians of Ashton McFaddon
108( As hton ), a minor, filed a Petition for Benefits Pursuant to
123Florida Statute Section 766.301 Et Seq. (the Petition ), with the
136Division of Administrative Hearings ( DOAH ) for the determination
148of compensability under the Florida Birth - Related Neurological
157Injury Compensation Plan (the Plan ).
165The Petition named Mariel Rotundo - Patino, D.O., as the
175physician who provided obstetric services at the birth of Ashton
185on October 16, 2016, at Intervenor, Galencare, Inc., d/b/a Brandon
195Regional Hospital (the Hospit al ) , in Brandon, Florida.
206DOAH served Dr. Rotundo - Patino with a copy of the Petition on
219or about February 26, 2019, and served the Hospital that same
230date. NICA was also served with a copy of the Petition on
242February 26, 2019.
245On August 29, 2019, NIC A filed a Motion for Summary Final
257Order requesting the a dministrative law ju dge enter a summary
268final order finding that the claim is not compensable because
278Ashton did not suffer a birth - related neurological injury as
291defined in section 766.302(2), Flo rida Statutes. NICA asserts
300that Ashton s birth weight fell below the statutory threshold of
3122,500 grams.
315On September 11, 2019, the undersigned issued an Order to
325Show Cause directing Petitioners to show cause, in writing, why
335NICA s motion should not be granted. As of the date of this
349Order, Petitioners have not responded to NICA s motion or the
361Order to Show Cause.
365FINDINGS OF FACT
3681. Based on all available evidence, the undersigned
376administrative law judge makes the findings of fact detailed
385below.
3862. Ashton was born on October 16, 2016, at the Hospital
397located in Brandon, Florida.
4013. Petitioners filed the Petition with DOAH on January 30,
4112019. With the Petition, Petitioners produced certain medical
419records relevant to the claim. The medical rec ords document that
430Ashton s weight at birth was 2,420 grams.
4404. A review of the medical records submitted in this matter
451reveals no evidence disputing a finding that Ashton weighed under
4612,500 grams at his birth.
4675. Based on the evidence that Ashton we ighed less than
4782,500 grams at birth, NICA determined that Petitioners claim was
490not compensable. NICA subsequently filed a Motion for Summary
499Final Order asserting that Ashton did not suffered a birth -
511related neurological injury as defined by section 766.302(2).
520CONCLUSIONS OF LAW
5236. An administrative law judge has exclusive jurisdiction
531over the subject matter of this proceeding. § 766.304, Fla. Stat.
5427. The Florida Legislature established the Plan for the
552purpose of providing compensation, irresp ective of fault, for
561birth - related neurological injury claims relating to births
571occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
5828. The injured infant, her or his personal representative,
591parents, dependents, and next of kin may seek com pensation under
602the Plan by filing a claim for compensation with DOAH.
612§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA, which
621administers the Plan, then has 45 days from the date of service
634of a complete claim . . . in which to file a respons e to the
650petition and to submit relevant written information relating to
659the issue of whether the injury is a birth - related neurological
671injury. § 766.305(4), Fla. Stat.
6779. If NICA determines that the injury alleged in a claim is
689a compensable birth - rel ated neurological injury, it may award
700compensation to the claimant, provided that the award is approved
710by the administrative law judge to whom the claim has been
721assigned. § 766.305(7), Fla. Stat.
72610. In this matter, however, NICA determined that
734Pet itioners claim is not compensable under the Plan. Therefore,
745NICA filed a Motion for Summary Final Order, requesting an order
756be entered finding that the claim is not compensable.
76511. In ruling on NICA s motion, section 766.309(1) provides
776that the admi nistrative law judge must make the following
786determination based upon the available evidence:
792(a) Whether the injury claimed is a birth -
801related neurological injury.
80412. The term birth - related neurological injury is defined
816in section 766.302(2) as f ollows:
822 Birth - related neurological injury means
830injury to the brain or spinal cord of a live
840infant weighing at least 2,500 grams for a
849single gestation or, in the case of a multiple
858gestation, a live infant weighing at least
8652,000 grams at birth caused by oxygen
873deprivation or mechanical injury occurring in
879the course of labor, delivery, or
885resuscitation in the immediate postdelivery
890period in a hospital, which renders the infant
898permanently and substantially mentally and
903physically impaired. This defin ition shall
909apply to live births only and shall not
917include disability or death caused by genetic
924or congenital abnormality.
92713. The undisputed evidence in the record establishes that
936Ashton did not weigh at least 2,500 grams at birth. Accordingly,
948the undersigned determines that Ashton has not suffered a birth -
960related neurological injury as defined in section 766.302(2), and
970is not eligible for NICA benefits.
976DISPOSITION
977Based upon the foregoing Findings of Fact and Conclusions of
987Law, it is ORDERED that the Petition is dismissed, with
997prejudice.
998DONE AND ORDERED this 2nd day of October , 2019 , in
